אם היהודי הולך לחנות הפתוחה בשבתות ובימים טובים וכו' – אינו יכול להתמנות למשרה של גבאי בבית־הכנסת.

א. אם אינו הולך לחנות בימים הנ"ל, אלא שהגוי לבדו מתעסק בחנות והתנו ביניהם בשעת השותפות שהרווחים משבתות וימים טובים יהיו לגוי ואילו היהודי יקבל כנגד זה רווחים מימים אחרים – יכול אותו יהודי להתמנות גבאי לבית־כנסת⁴⁰.
