**הלבנה נסתרת בכל חדש וכו'.** בפ"ק דר"ה (דף כ':) אמרינן אמר ר' זירא אמר ר' נחמן עשרים וארבע שעי מיכסי סיהרא לדידן שית מעתיקא ותמני סרי מחדתא לדידהו שית מחדתא ותמני סרי מעתיקא ע"כ. וא"כ קשה על רבינו ז"ל איך כתב שהיא נסתרת שני ימים ואולי י"ל דרבינו ז"ל דבר כפי הרוב שמחכמתו באצטגנינות ראה שכן הוא וגמרא קאמרא דלפחות לא ימעיט מכ"ד שעי:

**אין ראיית הירח מסורה לכל אדם וכו'.** פרק קמא דראש השנה (דף כ"ב) אמרו דרבי שמעון סבר דהחדש הזה לכם עדות זו תהא כשרה בכם ורבנן סברי עדות זו תהא מסורה לכם. וכדברי רבנן כתב רבינו ז"ל דהלכתא כוותייהו:

**בית דין מחשבין בחשבונות וכו'.** בפ"ק (דף כ':) אמרו נולד קודם חצות בידוע שנראה סמוך לשקיעת החמה לא נולד קודם חצות בידוע שלא נראה סמוך לשקיעת החמה למאי נפקא מינה וכו' לאכחושי סהדי, כלומר אם נולד אחר חצות ובאו עדים ואמרו ראינו החדש קודם שקיעת החמה כדי לקדשו היום עדי שקר הם וכן אמרו שם עוד עניינים אחרים לאכחושי סהדי:

**מצות עשה מן התורה על ב"ד שיחשבו וידעו וכו'.** היינו משום דכתיב החדש הזה לכם דהיינו עדות זו מסורה לכם:

**וישלחו ויודיעו וכו'.** בפ״ק בסופו (דף כ"ב) אמרו מחללין את השבת ויוצאין לעדות החדש שנאמר אלה מועדי ה' מקראי קדש אשר תקראו אותם במועדם עד כאן. ומכאן למד רבינו ז״ל דמצוה לשלוח ולהודיע שהרי משמע מן הברייתא דענין שלוח השלוחים נכנס בכלל קריאה והא דהוי החיוב על בית דין משום דבפרק אם אינן מכירין (ראש השנה דף כ"ה) דרשו אתם ואפילו שוגגים אתם ואפילו מוטעים וזה הוי לב״ד:
