**כיצד דנין דיני נפשות וכו'.** משנה ריש פרק היו בודקין מכירין אתם אותו התריתם בו כו'. ונראה מדברי רבינו שמפרש מכירין אתם אותו להורג כלומר יודעים אתם בודאי שזה הוא שמא נתחלף לכם זה באחר אבל רש"י ז"ל פירש מכירים את ההרוג כדאמרינן בברייתא עכו"ם הרג או ישראל הרג ורבינו שלא הזכיר הך דעכו"ם הרג או ישראל לא כאן ולא בהלכות עדות אע"ג דהוזכר בברייתא אפשר דלא חש דמאחר דאינו מכלל החקירות אלא מהבדיקות הרי כבר אמר בהלכות עדות כל המרבה בבדיקות הרי זה משובח:

**אחד תלמיד חכם וכו'.** בפרקא קמא דסנהדרין (דף ח') אמרינן וקא מיפלגי בפלוגתא דר' יוסי ורבנן וכו'. ורבינו ז"ל פסק כרבנן ואע"ג דנתן טעם לדבריו דצריך התראה דהמוזכר בדברי ר' יוסי דאמר אינו צריך התראה לאו מילתא הוא דמאי דקאמר ר' יוסי בין שוגג ומזיד הוא שוגג ומזיד בענין הדין שלא ידע אם אסור אם מותר כדפירש"י שם ומפני כן חכם שידע הדין אין צריך התראה ושוגג ומזיד שכתב רבינו אינו אלא שוגג ומזיד בענין המעשה שלא היה דעתו לעשותו ומפני כן אפילו חכם צריך התראה אחרי כן ראיתי לה"ה שפירש כן פרק ראשון מהל' איסורי ביאה:

**וכיצד מתרין בו כו'.** ענין ההתראה הוא פשוט. ומ"ש

**וכן אם שתק וכו'.** בפרק היו בודקין (דף מ':) קבל עליו התראה התיר עצמו למיתה המית בתוך כדי דיבור ע"כ ופירוש קבל עליו התראה פירש"י ז"ל יודע אני שכן אני מוזהר שלא לעשות. ומדכלל רבינו מלקות עם מיתה משמע דסבירא ליה דה"ה למלקות דבעינן שיתיר עצמו וקבל התראה וכ"כ לקמן בפירוש בפי"ח וטעמו משום דמלקות במקום מיתה עומדת ובכלל הפרקים הבאים כשהזכיר המלקות לא הזכיר שום אחד מאלו התנאים מפני שסמך על מ"ש כאן ובפי"ח:

**אמרו העדים היתה לו התראה כו'.** משנה בפרק אחד דיני ממונות כלשון רבינו ובמתני' יש עוד תוספת ביאור ורבינו קיצר בשאר הדברים האמורים שם שאינם צורך בענין ומה שאומרים להם אינו אלא זה בלבד:

**לפיכך כל אחד ואחד יכול כו'.** כלומר מאחר שאין צורותיהן דומות זו לזו הוה ליה כל אחד ואחד באנפי נפשיה ויכול כל אחד לומר בשבילי נברא העולם כלומר חשוב אני כעולם מלא ולא אטריד עצמי מן העולם בעבירה אחת:

**אם עמדו בדבריהן וכו'.** משנה פרק היו בודקין. ומ"ש שמכניסין תחלה לגדול שבעדים הוא מפני שבפרק זה בורר גבי דיני ממונות אמר במשנה ומשיירים את הגדול שבעדים כו':

**נמצאו כל דברי העדים מכוונים וכו'.** שם היו מזדווגים זוגות זוגות כו' ונושאין ונותנין בלילה כלומר נושאין ונותנין בלילה זוג זוג או כל אחד ואחד לעצמו וכן פירש"י וכל שאר הבבא מפורשת שם במשנה:

**ואם טעו בדבר ולא ידעו וכו'.** שם טעו בדבר סופרי הדיינים מזכירים אותם ואפשר לפרש טעו בדבר ששינו הטענות ושכחו אותם כדתריץ בפרק אחד דיני ממונות (דף ל"ד.) מינשו טעמייהו אע"ג דאיכא שני סופרי הדיינים כו' ולפירוש זה לא נפקא לן כלל מענין הטעות אלא לענין הטעמים ולא לענין הדין אבל רבינו פירש הדבר דנפקא מינה לענין הדין כדי שלא ירבו המזכים על המחייבים או המחייבים על המזכים:

**מקום שהורגין וכו'.** משנה ריש פרק נגמר הדין ופריך בגמ' ותו לא והתניא בית הסקילה חוץ לשלש מחנות ותירצו אין כדקאמרת והא דקתני הכי נפקא מינה דאי נפק בי דינא ויתיב כו' והשיעור שנתן רבינו הוא היכא דנפיק ויתיב חוץ לשלש מחנות כדאמרו בגמ' ומפני כן נתן השיעור במה דאיכא בין שתי המחנות שהוא מחנה של משה ומחנה של ישראל:

**משנגמר דינו אין משהין אותו כו'.** משנה סוף פ"ק דערכין. ומה שאמר ישבה על המשבר וכו'. בזה יש מחלוקת דלדעת רש"י ז"ל צריך שתשב על המשבר קודם גמר דין ולדעת התוספות אחר גמר דין ורבינו לא ביאר דעתו בזה:
