**מי שנתחייב מיתה בחולו של מועד וכו'.** ריש פרק ואלו מגלחין (דף י"ד:) אמרינן אתו מצפרא ומעייני בדיניה ואכלי ושתו כולי יומא והדר אתו בשקיעת החמה וגמרי לדיניה וקטלי ליה ע"כ וטעמא מפרש התם משום דאי קטלי ליה בצפרא צריך להתענות כל היום משום לא תאכלו על הדם ואתי לאימנועי משמחת יו"ט אבל כי קטלי ליה סמוך לשקיעת החמה אכלי כולי יומא עד ההיא שעתא משום דלא נאסר לאכול אלא אחר הריגה אבל קודם שהרגוהו לא ומשמע מדברי רבינו דאיסורא דאורייתא מיהא איכא ופשוט הוא והקשה בעל קרית ספר שכיון שהוא איסור דאורייתא נגמר דינו בחולו של מועד אמאי אוכלין ושותין הא איסור עינוי דחולו של מועד אינו אלא מדרבנן ואית לן למידחי איסורא דרבנן מקמי איסורא דאורייתא, ואני שמעתי ולא אבין דאין הכי נמי דאם עברו ב"ד וגמרו דיניה וקטלי ליה בחולו של מועד יתענו כל אותו היום דאיסור עינוי אינו אלא מדרבנן אבל מאחר דאנו יכולים לתקן את שתיהן איסורא דאורייתא דלא תאכלו ואיסורא דרבנן דעינוי בכי האי גוונא דגמרי ליה לדיניה סמוך לשקיעת החמה אמאי לא מקיימינן:

**מי שנגמר דינו כו'.** משנה סוף פ"ק דמכות מי שנגמר דינו וברח וכו' (עיין בכ"מ) והקשו בגמ' לפני אותו בית דין הוא דאין סותרין הא לפני ב"ד אחר סותרין וכו' ותירצו לא קשיא כאן בא"י כאן בחו"ל דתניא ר' יהודה בן דוסתאי אומר ברח מא"י לחוצה לארץ אין סותרין את דינו מחוצה לארץ לארץ סותרין את דינו משום זכותה של א"י ע"כ. ומה שכתב בד"א ברוצח כו'. נתבאר ממימרא דשמואל פרק נגמר הדין נקטעה יד העדים כו' שהזכרתי למעלה שפירשו מתני' בהן הן עדיו משום דבעינן יד העדים אבל הרוצח מבואר שם דרבי קרא ממות יומת:

**מי שנגמר דינו וכו'.** כבר נתבאר מברייתא דסוף פ"ק דמכות שהבאתי. ומ"ש רבינו על כל פנים הוא מפני שבחלוקה הקודמת חלוק בשאר חייבי מיתות בין היכא שהיו עדים הראשונים להיכא שהיו אחרים מפני כן כתב כאן דבין שהיו אותם העדים עצמם שאמרו שנגמר דינו בין שיהיו אחרים סותרים את דינו דזכותא דא"י מסייעא ליה כמבואר שם:
