**אחד ב"ד הגדול וכו'.** פ"ק דסנהדרין (דף י"ג:) תנא סמיכה וסמיכת זקנים בשלשה ומתבאר מן הגמ' שצריך שיהיה בהם אחד שיהיה סמוך מפי סמוך וזה יסמוך לאחרים כההיא עובדא דר' יהודה בן בבא. ומה שאמר רבינו צריך שיהיה אחד מהם סמוך כלומר שזה יסמוך לאחרים אבל ודאי דבין בית דין הגדול בין בית דין כ"ג בין בית דין שלשה לדיני קנסות בעינן דלהוו כולהו סמוכים כמבואר בפרקים הבאים:

**וכיצד היא הסמיכה וכו'.** שם בגמרא שאלו בידא ממש סמכין ליה והשיבו סמכין ליה בשמא קרו ליה רבי ויהבי ליה רשות למידן דיני קנסות:

**אין קרוי אלהים וכו'.** בריש פרק החובל (דף פ"ד) אמרינן אלהים בעינן וליכא כלומר דכיון דאינן סמוכים אינם אלהים:

**בראשונה היה וכו'.** בירושלמי פ' קמא דסנהדרין אמר רבי אבא בראשונה היה כל אחד ואחד וכו'. אבל אין כתוב שם כמ"ש כאן רבינו אלא ענין דומה לו:

**והוא שיהיו שנים עמו וכו'.** כבר הוכחתי דהכי איתא בגמרא דאפילו ר' יהודה אפשר דיודה בהא דהא לא פליג עליה דר' שמעון אלא בסמיכת פר אבל בסמיכת חבר לא פליגי דבשלשה סגי דודאי עדיפא סמיכת פר מלמיסמך חבר דהא התם בעינן שיהיו מן הסנהדרין וכאן באחד סמוך סגי אבל בעל ההגה"ה כתב דהוא דלא כר' יהודה והוא תימה ואפשר שדקדק כן מלשון שאין סמיכה פחות משלשה דמשמע שום סמיכה אפי' סמיכת (הפר) [חבר] ומה שאמר והוא שיהיו שנים עמו אע"פ שכתבו למעלה הוא לאשמועינן דאע"פ שהוא ברשות הנשיא לא אמרינן דבחד סגי:

**אין סומכין זקנים וכו'.** פ' דיני ממונות (דף י"ד.) אמר ריב"ל אין סמיכה בח"ל והקשו על מה דלא דייני דיני קנסות כלל בחוצה לארץ והתנן סנהדרין נוהגת וכו' ותירצו אלא דלא סמכינן בחוצה לארץ ע"כ:

**היו שניהם בארץ וכו'.** מתבאר ממה שכתבתי דהרי לא אמרו שם שאין סומכין אלא מפני שאחד בא"י ואחד בח"ל אבל אם היו כולהו בארץ אע"פ שאין שניהם במקום אחד הוי סמיכה:

**יש לסומכין לסמוך וכו'.** ירושלמי בפרק חלק ר' ברכיה בשם רבי אבא בר כהנא אמר תשעים אלף זקנים מינה דוד ביום אחד וכו' ורבינו היה גורס שלשים אלף:

**ויש להם למנות וכו'.** פרק קמא דסנהדרין (דף ה'.) אמר ליה רבי חייא לרבי בן אחי יורד לבבל יורה יורה ידין ידין וכו' יתיר בכורות אל יתיר וא"ת איך כתב כאן רבינו או יתנו לו רשות להורות באיסור והיתר הא מוכח בגמ' דלהורות באיסור והיתר לא בעינן רשות מב"ד אלא רשות מרבו וכדאקשינן התם וכי מאחר דגמיר רשותא למה ליה למשקל ותירצו משום מעשה שהיה וי"ל דודאי רשות בעינן להורות באיסור והיתר כדי שאם טועה ליפטר כדמוכח בפרק אחד דיני ממונות (דף ל"ג.) וכמו שכתבו שם התוס' ומאי דפריך בגמ' למה לי רשותא כבר תירצו התוספות דהכי קאמר למה לי למשקל רשותא בתרתי בהוראות ודין:

**והוא שיהיה ראוי לכל הדברים וכו'.** ירושלמי פ"ק דחגיגה מהו למנות זקנים לדברים יחידים נשמעיניה מן הדא רב מניתיה רבי להתיר נדרים ולראות כתמים וכו'. עוד שם אע"ג דאתמר ממנין זקנים לדברים יחידים והוא שיהיה ראוי לכל הדברים כהדא ר' יהושע בן לוי וכו'. כלומר שיהיה חכם ומופלא בכל התורה כלה וגם שלא יהיה סומא באחת מעיניו שאז אינו ראוי לכל הדברים כמ"ש רבינו אחר כן:

**וכן יש לסומכין וכו'.** פרק קמא דסנהדרין (דף ה':) פשיטא לפלגא הא קאמר דמהני על תנאי מאי תא שמע דאמר ליה ר' יוחנן וכו'. וכן בירושלמי פ"ק דחגיגה מהו למנות זקנים לימים נשמעיניה מן הדא כו':

**נראין לי הדברים וכו'.** כאן כתב רבינו והדבר צריך הכרע ובפירוש המשנה הכריע הדבר וכבר רצה הרב הגדול מהרר"י בי רב ז"ל להסכים דבריו עם פירוש המשנה והרב מהר"ר לוי ן' חביב חולק עליו כמבואר בפסקיו בארוכה:

**ראשי גליות כו'.** שם פ"ק דסנהדרין פשיטא מהכא להכא ומהתם להתם ומהכא להתם מהני דהכא שבט והתם מחוקק מהתם להכא מאי ופשיט דלא מהני ואע"ג דנאמר דבר זה בגמ' למאן דבעי למידן דינא וטעה אי ליפטר בהאי רשותא מ"מ הוא הדין לכוף את האדם לדון לפניו דהא בהא תליא וכדמוכח בדברי הריב"ש סי' רע"א. ואין כן דעת התוס' והרא"ש ז"ל שכתבו על ההיא דת"ר ואם היה מומחה לרבים דן ואפי' יחידי דמכאן משמע דיחיד מומחה יכול לכוף את האדם לדון לפניו בעל כרחו משמע דאפילו דלא נטל רשות יכול לכוף את האדם לדון לפניו ואמת הוא שחילקו בין היכא דאומר לא אדון בפני זה אלא בפני זה להיכא דאומר לא אדון כלל אבל רבינו מדלא חילק משמע דסבירא ליה דבכל ענין יחיד מומחה אינו יכול לכוף את האדם לדון בעל כרחו דהא ודאי במומחה איירי וזהו שכתב ראוי לדון דאי לא תימא הכי יקשה מדידיה אדידיה דלקמן בפ"ו כתב שמי שאינו מומחה אין דיניו דין אפילו לא טעה ואפי' נאמר שרבינו חלק במה שחילקו התוס' והרא"ש ז"ל ונסכים דבריו עם דבריהם מ"מ עכ"פ למדנו מדבריו דהיכא דרוצה לבא לדון אינו יכול לכוף את האדם לדון לפניו וזה פשוט בדברי רבינו וא"כ דברי הטור בחשן משפט סימן י"ג מתמיהין שהביא לשון רבינו שכתב בריש פ"ז אפילו היה האחד כו' ורצה להסכים דבריו עם סברתו ולומר דרבינו סובר דאפי' שרוצה לבא לדון יכול לכוף את האדם לדון לפניו שכתב ואפשר לומר דעת הרמב"ם דהיינו דוקא היכא דבירר משמע דהיכא דלא בירר אפילו שרוצה לבא לדון יכול לכוף את האדם לדון בעל כרחו וזה אי אפשר ממ"ש רבינו כאן כמו שהוכחתי והיה לו לטור לדקדק מכאן שהוא הפך דבריו בבירור וצ"ע. ומה שאמר רבינו אע"פ שיש לדון דיני קנסות וכו'. קצת תימה דא"כ דדיני קנסות דנין בחו"ל בעל כרחם אפילו שיסמכוהו בארץ כשהקשו בפ"ק דסנהדרין על ההיא דאמרינן אין סמיכה בח"ל אילימא דלא דייני וכו' אמאי לא משני דמאי דקאמר אין סמיכה ר"ל דאפילו (לא) יסמכוהו בארץ אין סמיכה מועלת לו בח"ל לכוף את האדם לדון לפניו. וי"ל דאין סמיכה בח"ל משמע אינה מועלת כלל בח"ל:
