והשם שבא שני פעמים וצריך לבוא בסמיכות – יבוא בפעם הראשון בסמיכות ובפעם השני יבוא בה"א הידיעה. כי בתחילה יבאר מהותו על ידי סמיכות ואחר כך כבר נודע ובא בידיעה ולא בהפך.

And a noun that comes twice and needs to come in construct state – it comes the first time in construct state and the second time with the definite article ה, since in the beginning, it clarifies its nature through construct state and afterwards it is already known, so it comes with a definite article, and never the reverse.

ועל כן "ועלתה יבמתו אל **הזקנים** וקראו לו **זקן עירו**" הוא שלא כמשפט הלשון. ומזה הכריחו חז"ל שמה שכתוב "זקני עירו" יכוין על זקנים אחרים שבעיר (ויקרא ס' רמט)

Thus, ועלתה יבמתו אל **הזקנים** וקראו לו **זקן עירו** (then his brother's wife shall go up to the gate to the elders, and say: ‘My husband's brother refuses to raise up to his brother a name in Israel; he will not perform the duty of a husband's brother to me.’ Then the elders of his city shall call him)³²¹ is not in accordance with the rules of the language. And from this, the sages of blessed memory are forced to conclude that when it is written זקני עירו (elders of his city) it is intended to mean other elders that are in the city.

והוא הדין כשבא פעם הראשון בה"א ופעם השני בלא ה"א הוא שם אחר.

And the same applies when it comes the first time with the letter ה and the second time without the letter ה - it will be another noun.

ומה שכתוב "והבשר כל טהור יאכל בשר" הוא זרות בלשון ונדרש (צו ס' קכח)

And when it is written והבשר כל טהור יאכל בשר (And the flesh that touches any unclean thing shall not be eaten; it shall be burnt with fire. And as for the flesh, every one that is clean may eat thereof)³²², it is peculiar in language, and there is a homiletical interpretation.

וכן הוכיחו שמ"ש "והנותר בשמן" אינו ה"א הידיעה – כי בודאי נותר, רק הוא ה"א התנאי – אם נותר. דהא תחילה אמר "ומיתר השמן" בלא ה"א – הרי אין ודאי וידוע שיותר וכל שכן שלא יצדק ידיעה על הנותרת (מצורע ס' נו)

And moreover, it is proven that when it is written והנותר בשמן (And the rest of the oil)³²³, it is not a definite article ה, in which it would definitely remain; rather it is a conditional ה – *if it remains* - since in the previous verse, it says ומיתר השמן(and of the rest of the oil)³²⁴ without a ה – that it is not for certain that it remains and all the more so it is not correct to place a definite article on נותר in the next verse.
