בכל מקום שאין החלוקה תלויה בפעולות האדם רק בדבר שבמציאות – יתפוס דבור המציאות "**הוא**". "אם בן הוא ואם בת היא".

In any place where there is a division that is not dependent on the actions of a person, but only on a matter that is a reality – it will use the word that indicates that it is a reality, **הוא** - אם בן הוא ואם בת היא (if it be a son, then you shall kill him; but if it be a daughter, then she shall live)⁵¹¹.

ומה שכתב "ואם נקבה תלד" בא ללמד שאין צורך שידע מהות הדבר בבירור; ואפילו טומטום ואנדרוגנוס. (תזריע ס' יח)

And when it is written ואם נקבה תלד (But if she bear a maid-child)⁵¹², it comes to teach that one does not need to know the nature of the thing clearly; it can even have an indeterminate gender or be a hermaphrodite.
