האדם אף שנאמר בו "**נפש חיה**", לא נקרא בשם 'חיה' (ולא כפי הנראה משטחות דברי הרמב"ם בהל' מאכלות אסורות). (שמיני ס' עב).

The human being, even though it says **נפש חיה** (living soul)⁵⁹² about him, he is not called a חיה (a human being is not called according to his superficial appearance, according to Maimonides in the *Laws of Forbidden Foods, Mishnah Torah*).

וחיית הים נקראים בשם "**חיה אשר במים**". ובלשון "**נפש חיה אשר במים**" נכלל גם חיית הים שיש לה צורת אדם. (שמיני ס' פ)
