**And Gilead begot Jephthah.** That is to say, nevertheless everyone knew that Gilead had fathered him, for she was designated to him as a concubine.

**And they said to him, “You shall not inherit.”** This was not in accordance with the law: (a) for the son of a concubine inherits a portion along with the other sons; (b) and their driving Jephthah out of the city was clear injustice.

**And he fled.** This indicates that they sought to kill him, so that he was compelled to flee, and that the elders of the city did not administer justice.

**Questions (6–11): In verse 6 they said “commander,” but in verse 8 they said “head”? At first they said “and we will fight,” and afterward “and I will fight”? What is the force of the argument, “Did you not hate me?” — for even so, would they not seek his help if they expected benefit from him? And what did they mean by “Therefore now…” — how does this follow from what preceded? What is new in “I will be your head” — had they not already agreed to this? And what did they mean by replying, “According to your words, so shall we do,” since they had already said the same to him? Until now they conditioned that if he fought and was victorious, then he would be head; how, then, did they appoint him head immediately, before he had won and before he had fought?**

**לכה והייתה לנו לקצין.** יש הבדל בין ראש וקצין, הקצין הוא העומד בקצה המחנה מחמת חשיבותו ומעלתו בגבורה, או בעושר או בחכמה הגם שאינו ראש ומושל עליהם, כמו שמלה לכה קצין תהיה לנו, והנה הם לא דברו אתו תחלה על שכרו אחרי המלחמה, רק על עתה, אמרו שיהיה הוא בקציהם מצד חשיבותו כי הוא גבור מכולם, ולכן אמרו ונלחמה בבני עמון בלשון רבים. כי הקצין אינו הראש שתתיחס המעשה אליו לבדו כי במלחמה כולם שוים עמו, רק הוא עומד בקציהם.

**Sefaria Community Translation:**
**Come and be our commander.** There is a distinction between “head” and “commander.” A commander is one who stands at the edge of the camp because of his importance and superiority — whether in valor, wealth, or wisdom — even though he is not the head or ruler over them, as in “Come, be our commander.” They did not initially speak with him about his reward after the war, but only about the present. They asked that he stand at their edge on account of his prominence, since he was mightier than all of them; therefore they said, “and we will fight against the children of Ammon,” in the plural. For the commander is not the head to whom the action is attributed alone, since in war all are equal with him — he merely stands at their forefront.

**ויאמר יפתח.** השיב להם איך תאמרו שאני אהיה לקצין מפני חשיבותי, כאילו לא קראתם אותי מפני הצורך רק מפני החשיבות ומפני אהבתכם אותי, הלא אתם שנאתם אותי, וגם ותגרשוני מבית אבי כי הייתי שפל ונבזה אצלכם, זאת שנית שאם הייתם באים אלי בעת שלוה הייתי מוחל על העבר, אבל אתם באתם אלי עתה רק כאשר צר לכם, באופן שלא הניעכם הנה החרטה על העבר, ולא אהבה וחשיבות, רק ההכרח, ולמה אלך לעזר אתכם חנם בלא בצע, כאילו ברית אהבה בינינו מה שאינו כן.

**And Jephthah said.** He replied to them: How can you say that I should be your commander on account of my distinction, as though you had not summoned me out of need but out of esteem and affection? Did you not hate me, and drive me from my father’s house, for I was lowly and despised in your eyes? Moreover, had you come to me in a time of peace, I might have forgiven the past; but you have come to me now only when you are in distress. Thus it was not remorse for what you did, nor love and respect, that moved you — but necessity alone. Why, then, should I go to help you for nothing, without gain—as though there were a covenant of friendship between us, when in truth there is none?

**ויאמרו כו' לכן עתה שבנו אליך.** רצה לומר אמת כדברך כי מקדם שנאנו אותך והרעונו לך, אבל לכן עתה שבנו אליך באופן שלא תלך בעבור אהבה ובעבורנו רק תקח משכורתך, שע"י שוהלכת עמנו ונלחמת כי אתה תהיה הלוחם והנצחון יקרא על שמך ומזה יחויב שאחר שתנצח והיית לנו לראש כדין המנצח במלחמה והמציל את העם שאף אם הוא מפחותי העם יושם לראש ומושל.

**Sefaria Community Translation:**
**And they said… therefore now we have returned to you.** That is to say, it is true, as you have spoken, that formerly we hated you and wronged you; but for that very reason we have now come back to you, so that you will not go on our account out of love or affection, but will receive your compensation — for you shall go with us and fight, and you will be the one who wages the battle, and the victory will be attributed to your name. From this it follows that after you prevail, you shall be our head, in accordance with the law that the victor in war and the deliverer of the people — even if he be among the lowly of the nation — is appointed head and ruler.

**ויאמר יפתח.** השיב להם, הנה בזה עדן לא הראיתם לי אות אהבה וסימן חרטה על העבר ויתראה כאילו אני הולך עם אויבי לעזור להם בעד משכורת, כי מה שהבטחתם שאחר המלחמה והנצחון תשימוני לראש, זה דבר שאינו תלוי בהסכמתכם שזה יהיה ממילא, שאם משיבים אתם אותי וכו' ונתן ה' אותם לפני אנכי אהיה לכם לראש מעצמי על כרחכם, כדין הנוצח. ומה תבטיחו לי אתם?

**Sefaria Community Translation:**
**And Jephthah said.** He replied to them: Even now you have shown me no sign of affection or indication of remorse for the past; it appears as though I am going with my enemies to help them merely for payment. For what you have promised — that after the war and victory you will appoint me as head — is not something that depends upon your agreement, since it would follow of itself. If you bring me back… and Hashem delivers them before me, I shall become your head on my own, even against your will, according to the law of the victor. What, then, are you promising me?

וכוונתו מבוארת שהיה חפץ שישימו אותו לראש תיכף, עד שתיכף בלכתו לא ילך כקצין רק כראש, וכמו שאמר אל מלך בני עמון מה לי ולך כי באת אלי להלחם בארצי שזה אמר מצד שהיה כבר המושל ואדוני הארץ.

**Sefaria Community Translation:**
His intention is clear: he desired that they appoint him head immediately, so that from the outset he would not go merely as a commander but as head — as he later said to the king of the children of Ammon, “What is there between me and you, that you have come to fight against my land?” — which he spoke from the position of one who was already ruler and lord of the land.

**And they said… according to your word, so shall we do.** That is to say, they would appoint him head immediately upon his arrival in Gilead.

**Sefaria Community Translation:**
**As it says, “And he went… and they appointed him over them as head and commander.”** They chose him immediately as head, and also as commander on account of his distinction. “And Jephthah spoke all his words before Hashem” — he stipulated with them the laws of authority, defining the extent of his rule, just as Samuel spoke to them of the ordinances of kingship when he anointed Saul.

**מה לי ולך.** כי מלחמה שתתהוה בין שני מלכים (אם תהיה כפי נמוסי המלכים לא בדרך עשק) יש לה בהכרח איזה עילה, כמו מריבה או טענה וכדומה, ולרוב יוכלו להתפשר ביניהם בטוב טרם נשקה המלחמה, ושאל שיודיעהו סבת המלחמה, ומה רוצה ממנו.

**Sefaria Community Translation:**
**What is there between me and you?** For a war that arises between two kings — if conducted according to the norms of kingship and not by way of oppression — must necessarily have some cause, such as a dispute, a claim, or the like; and often they can reach an understanding between them peacefully before war breaks out. He therefore asked that he inform him of the reason for the war, and what he sought from him.

**ויאמר מלך בני עמון כו' כי לקח ישראל את ארצי כו'.** הודיע לו שיש לו טענה על הארץ שהיתה למואב בימי קדם טרם שכבשה סיחון ורוצה שישובו הערים אל בעליהם הראשונים (וכפי הנראה היה מלך בני עמון מושל אז גם על ארץ מואב) וטען בעד מואב שלקחו ארצו וגם שמה שלקחו מסיחון היה גם מבני עמו. כמו שאמר (יהושע יב) סיחון וכו' מערוער וכו' גבול בני עמון ושם (יג כה) ויהי להם הגבול יעזר וכו' וחצי ארץ בני עמון:

**Sefaria Community Translation:**
**And the king of the children of Ammon said… because Israel took my land…** He informed him that he had a claim to the land, which had belonged to Moab in earlier times before Sihon conquered it, and he demanded that the cities be returned to their original owners. (Apparently, the king of the children of Ammon then ruled also over the land of Moab.) He argued on behalf of Moab that Israel had taken its land, and also that what they had taken from Sihon had included territory that had belonged to his own people — as it is said (Joshua 12), “Sihon… from Aroer… to the border of the children of Ammon,” and there (Joshua 13:25), “And their border was Jazer… and half the land of the children of Ammon.”

**כה אמר יפתח.** טען ארבעה טענות: א) שישראל לא לקח מארץ מואב ובני עמון מאומה (כי הוא אין לו טענה רק אם היו לוקחים מידו בלי אמצעי (ונהפוך הוא שעת שלחו מלאכים אל מלך מואב ואל מלך אדום ולא אבו לעזבם לעבור גבולם (הגם שהיה בזה עילה למלחמה) הסבו את ארצם ולא באו בגבול מואב כי ארנון היה גבול מואב בימים ההם:

**Sefaria Community Translation:**
**Thus said Jephthah.** He advanced four arguments: (a) that Israel did not take anything from the land of Moab or from the children of Ammon — for he would have a claim only if Israel had taken it directly from him without intermediary. On the contrary, when they sent messengers to the king of Moab and to the king of Edom and they did not consent to let them pass through their territory (even though this could have been grounds for war), Israel turned away from their land and did not enter the border of Moab, for the Arnon was the boundary of Moab in those days.

(טענה ב) הארצות שהזכיר כבשו מסיחון שהיו אז תחת ממשלתו, וגם זה לא היה שלא כדין עד שיוכל לטעון עליהם, כי בעת שלח מלאכים גם על סיחון, החל סיחון לתגר בם מלחמה, ולא הספיק לו מה שלא הניחם לעבור בארצו, רק ולא האמין סיחון את ישראל עבר בגבלו, רצה לומר שלא הניחם אף ללכת בגבול ארצו ולסבבה כמו שסבבו ארץ אדום ומואב כי לא האמין להם, ולכן אסף את עמו וילחם בם, באופן שהוא התחיל במלחמה וה' נתנו ביד ישראל ולקחו את ארצו שהיא ארץ האמורי, לא ארץ מואב כי הארצות האלה היו אז לאמורי.

**Sefaria Community Translation:**
(Second argument:) The lands he mentioned were conquered from Sihon, who at that time ruled over them; and even this was not done unlawfully so that he could claim against them. For when they sent messengers also to Sihon, Sihon himself initiated war against them. It was not enough for him that he did not allow them to pass through his land, but “Sihon did not trust Israel to pass through his border” — that is, he would not even permit them to go along the edge of his territory and circumvent it, as they had done around the land of Edom and Moab, for he did not trust them. Therefore he gathered his people and fought against them, so that he was the one who began the war; and Hashem delivered him into the hand of Israel, and they took his land, which was the land of the Amorites — not the land of Moab, for those territories were at that time under Amorite rule.

**Sefaria Community Translation:**
(Third argument:) “And now Hashem, the God of Israel, has dispossessed…” That is to say, the war of Israel at that time was a divine matter, and all the nations knew this — that Hashem had driven them out. If Hashem, to whom the whole earth belongs, dispossessed the Amorite, how can you dispossess him? **“Is it not that which Chemosh your god gives you to possess?”** What right have you to speak against that which is the wonder of God and His providence?

**Sefaria Community Translation:**
**(Fourth argument:) And now, are you any better…?** Balak was king at that time and remained silent; and after him many kings arose, and three hundred years have already passed during which Israel has dwelt in and possessed the land — and you were silent. This constitutes a strong presumption of ownership and carries a legal claim. So too Abarbanel explains these verses along these lines.

**ואנכי לא חטאתי לך.** רצה לומר אחר שאין לך טענה על הארץ לא יצויר סבה למלחמה רק אם א' חטא נגד חברו בכבודו וכדומה וזה לא היה כי לא חטאתי, וא"כ אתה עשה אתי רעה להלחם בי הוא דבר רע נגד חוקי המלכים ונמוסי המדינות, ואם אין בינינו מוכיח ישפט ה' השופט וכו':

**And I have not sinned against you.** That is to say, since you have no claim to the land, no cause for war can be imagined except if one had wronged the other in honor or the like — and this has not occurred, for I have not sinned against you. Therefore, you are doing me wrong by waging war against me, which is evil against the laws of kings and the customs of nations. And if there is no arbiter between us, let Hashem the Judge decide…

**ויעבר את הגלעד.** כבר אמר שמלך בני עמון חנה בגלעד, וכפ"ז הי' מחכמת יפתח שעבר בגלעד מן הצד דרך מצפה גלעד אל ארץ בני עמון, שבעוד שמלך בני עמון עם מחנהו עמדו בגלעד היה נקל לכבוש מדינת בני עמון ולהכות מכה גדולה בערי בני עמון ועי"כ נכנעו כי הוצרכו לשוב להגן על עריהם.

**And he passed through Gilead.** It was already stated that the king of the children of Ammon had encamped in Gilead; accordingly, it was Jephthah’s strategy to pass through Gilead by way of Mizpeh of Gilead toward the land of the children of Ammon. While the king of the children of Ammon and his camp were stationed in Gilead, it was easy to strike their territory and inflict a heavy blow upon the cities of Ammon, and through this they were subdued, for they were compelled to return to defend their cities.

**And she was his only one.** Since the term “only” can be used even when there are other children who are not regarded as significant, such as the sons of concubines — as in the case of Isaac, “your son, your only one,” although he had Ishmael — therefore it says “she alone was his only one,” and explains: “he had none besides her,” meaning that no son or daughter had been born to Jephthah.

**אהה בתי.** נראה פי' שרצה להתחרט ולשאול על הנדר כיון שיש לו פתח חרטה וזה שאמר: אהה בתי וכי הכרע הכרעתיני או את היית בעוכרי ואיך אעשה לך הדבר הזה ואנכי פציתי פי אל ה' ולא אוכל לשוב אתמהה? הלא הנדרים לה' נתרים בפתח וחרטה ואינם דומים כדברים שמבטיחים לבני אדם שמוכרחים לקיים הבטחתם, כי הנודר לה' יש לו התרה.

**Sefaria Community Translation:**
**Alas, my daughter.** It appears that he wished to reconsider and seek release from his vow, since he had grounds for regret. Thus he said: “Alas, my daughter! Have you indeed brought me low? Are you the cause of my trouble? How can I do this thing to you, when I have opened my mouth to Hashem and cannot turn back?” — in astonishment. Are not vows made to Hashem subject to annulment through grounds and regret? They are not like promises made to human beings, which one is obligated to fulfill; for one who vows to Hashem has the possibility of release.

**ותאמר אליו.** השיבה לו שאין דבר זה דומה לשאר נדרים שע"י חרטה דמעיקרא החכם עוקר הנדר מעיקרו אבל אתה אין לך חרטה דמעיקרא רק חרטה דהשתא, אחרי אשר עשה לך ה' נקמות מאויבך שע"י הנדר נצחת את אויביך וא"א שיהיה לך חרטה על גוף הנדר מעיקרא. וזה גרם טעות ליפתח שלא הלך אצל החכמים לשאול על נדרו כי באמת היא טענת הבל שגם חרטה דהשתא מועיל לעקור על כל פנים את הנדר מכאן ולהבא.

**Sefaria Community Translation:**
**And she said to him.** She replied that this matter is not like other vows, which through prior regret a sage uproots from the outset; but in your case there is no regret from the beginning, only regret now — after Hashem has taken vengeance for you upon your enemies, since through the vow you were victorious over them, and it is impossible for you to have regret over the essence of the vow from the beginning. This caused Jephthah’s error, for he did not go to the sages to seek release from his vow; yet in truth this is a mistaken argument, for even regret arising now can at least uproot the vow from that point onward.

**Sefaria Community Translation:**
**And he fulfilled his vow to her… and she had not known a man.** In this way he carried out his vow — in that she did not know a man, but remained secluded and unmarried until her death; and according to his understanding, this was a mitzvah. But the view of the Sages is that he actually offered her up as a burnt offering.
