**ויהי בימים ההם ומלך אין בישראל.** וגם מעשה זו היה סבתה מה שאין מלך לבער החוטאים ולעשות משפט, שאז לא היה העם כמאכולת אש וחרב איש באחיו:

**Sefaria Community Translation:**
**And it was in those days, and there was no king in Israel.** This incident as well was caused by the fact that there was no king to remove the sinners and administer justice; for at that time the people were like fuel for fire, and each man’s sword was against his brother.

**ותזנה עליו פילגשו.** היה לומר ותזנה מאחריו, כי מלת עליו שבא אצל זנות מוסב על הנואף עמה, (ותזן על) [ותזני אל בני] מצרים (יחזקאל טז, כו), וזה מורה כדעת חז"ל (גיטין ו ב) שלא זנתה ורק עשתה נגדו דבר שלא לרצונו: **ותלך מאתו.** לא לחוץ אל הזונים, רק **אל בית אביה**:

**Sefaria Community Translation:**
"**And his concubine acted unfaithfully toward him.** It should have said “acted unfaithfully from him,” for the word “upon him” when used regarding immorality normally refers to the man with whom she committed adultery (as in “and you committed harlotry with the sons of Egypt” — Ezekiel 16:26). This indicates, according to the Sages (Gittin 6b), that she did not actually commit adultery, but only did something against his will.**And she went from him.** Not out to lovers, but rather **to her father’s house.**"

**ויקם אישה.** גם זה מעיד שלא זנתה, כי קוראהו אישה, שאם זנתה היתה אסורה עליו לדעת האומר דפילגש היא בקדושין: **ויראהו אבי הנערה** כו' **ויחזק בו חותנו.** השמות באו לפי הענין, שמח בו מצד שהוא אביה ורוצה שלא תהיה צרורה עגונה, והחזיק בו מצד שהוא חותנו:

**Sefaria Community Translation:**
"**And her husband arose.** This too indicates that she had not committed adultery, for Scripture calls him her husband; had she committed adultery, she would have been forbidden to him—according to the opinion that a concubine has kiddushin.

**And the young woman’s father saw him** … **and his father-in-law prevailed upon him.** The terms are used according to the context: he rejoiced in him insofar as he was her father and wished that she not remain bound and deserted; and he pressed him to stay insofar as he was his father-in-law."

**וישכימו בבקר** וכו' **וישתו** וכו'. ר"ל ביום הראשון היה עדיין בקר, רק ששתו ואמר שילין מצד ששתה והדרך מבלבל שותי יין. וביום שאח"ז נזהר מלשתות רק שהאכילה נמשכה עד נטות היום:

**Sefaria Community Translation:**
"**And they arose early in the morning** … **and they drank** … That is, on the first day it was still morning, but they drank, and he urged him to stay overnight because he had drunk, and the road confuses those who drink wine. On the following day, however, he was careful not to drink; only the meal extended until the day declined."

**הנה נא רפה היום.** פי' מהרי"א שא"ל, א] **הנה רפה היום**, ועת ללון. ב] אחר שבלא זה לא תגיע עד ביתך ותצטרך לחנות בדרך, **חנות היום לין פה**, עשה החניה פה ומחר תשכימו ותגיע ביום אחד עד אהלך ולא תצטרך ללון בדרך:

**Sefaria Community Translation:**
"**Behold now, the day is waning.** The Maharai”a explains that he said to him:
(1) **Behold, the day is slackening** — it is already time to lodge.
(2) Even aside from that, you will not reach your home today and will have to camp along the way; therefore, **camp today and lodge here**. Make your stop here, and tomorrow you may rise early and in a single day reach your tent, without needing to lodge on the road."

**Sefaria Community Translation:**
"**And with him.** This serves as an explanation for why he did not lodge in the field: for with him were **a pair of saddled donkeys**, carrying all his goods, and he feared bandits.
Secondly, **because of his concubine**, for a woman is of delicate constitution and not suited to lodge in the field. For these same two reasons he did not turn aside into a foreign city—because of bandits, and because of possible violation of his concubine."

**Sefaria Community Translation:**
"**To a foreign city which is not of the children of Israel.** That is, there were Canaanite cities that belonged to Israel and were subject to them for tribute, and the fear of Israel was upon them. But Jebus was a foreign city that was not of the children of Israel—meaning that they were not subject to Israel, for they had not been placed under tribute (as mentioned above in 1:21)."

**Sefaria Community Translation:**
**And behold, an old man.** Just as the text recounts the disgrace of the men of Gibeah, who shut their doors to a traveler even though they were residents of the city and were not pressed for space, so it relates the praise of this old man:

(1) though he was elderly; 
(2) **that he had just come** at that very moment; 
(3) that he came **from his work**, the hard labor **in the field**; 
(4) and that he was **a sojourner in Gibeah**, so the obligation of hospitality did not rest upon him more than upon the townspeople—yet nevertheless he acted as he did.

**Sefaria Community Translation:**
**And he said to him, “We are passing through.”** That is, our journey is **from Bethlehem of Judah to the far reaches of the hill country of Ephraim**, and it is impossible to reach there while it is still day, for **I am from there**, and that is my home district.

And lest he think that he was a peddler going about from town to town, he said that he went only **as far as Bethlehem**.

And lest he suppose that he was one of Micah’s men who worshiped the idol (for Micah was in the hill country of Ephraim), he said, **“and I am going to the House of Hashem.”**

Yet despite all this, **there is no one who gathers me into his house**, and therefore I have remained outside.

ובל תחשוב שתצטרך לתת יבול לחמורים, לז"א **גם תבן גם מספוא יש לחמורינו.** וכן לא תצטרך ליתן לי לאכול ולא לנער, כי **גם לחם ויין יש**, וגם יש יותר מן הצורך עד שהנער יאכל עם עבדיך מן הלחם ויין שאתן לחלקו, וכן גם שאר דברים תבלין וכדומה, כי **אין מחסור כל דבר**:

**Sefaria Community Translation:**
And lest you think that you will need to provide fodder for the donkeys, therefore he said, **“There is both straw and feed for our donkeys.”**

And likewise, you will not need to give food to me or to the servant, for **“there is also bread and wine.”** Indeed, there is more than enough—so that the servant may eat with your servants from the bread and wine that I will give as his portion. And so too with other provisions, spices and the like—**there is no lack of anything.**

**Sefaria Community Translation:**
**While they were enjoying themselves, behold the men of the town, etc.:** Wise scholars have already spoken about this, how the matter of Giveah is different from the sin of Sodom, upon which He rained down brimstone and fire and overturned cities from the root, whereas the hands of heaven were stayed about punishing these [men of Giveah] who acted like [in] the story of Sodom. And they said there is a difference between an evildoer and a sinner. That means to say that the sin of the people of Sodom was very great from [their] intellect. For they legislated laws that were not good, and judgments through which they could not live [a proper] civil life. Yet they accepted these laws as righteous justice — that a wayfarer not pass through their land and that one who passed through be punished according to their corrupted mores. So they did not do what they did because of their desires, but rather because of their corrupted mores. Not so with the people of Giveah, it was not their intellect that was [the basis for] this treachery and they did not do it because of laws and mores, but rather out of their desire. As that which they did not host the man was because they were stingy and miserly, and that which they wanted to have intercourse with her was only because of their desire. And the test of this is: A) Lot brought the angels in secretly (as it is explicitly written in the Torah in that which he said, *turn aside to your servant’s house* [Genesis 19:2]). And the angels wanted to sleep in the square because they were afraid of the mores, whereas the old man in Giveah brought them openly into his house. B) There it is written: *when the men of the city, the men of Sodom, encircled over the house, young and old alike* (Genesis 19:4), which included all the people of the city, from the angle that they were people of Sodom and hospitality was against their laws. Whereas here it is written, *the men of the city, base men*, meaning the base men in the city and the rabble that were in it had a desire, not all of [the city's] men. And it was not from the angle of their mores, but rather from the angle that they were base men and doing something against the law and justice. C) There it is written, *they encircled over (nasavu al) the house*, since they wanted to fight with the homeowner who transgressed their laws. But here it is written: *they encircled (nasavu et) the house*, to guard that the guest not escape. It was not that they surrounded over the house to fight. And that is why they did not want his daughter. Since they did not want to do harm to the old man. And that is why it is written, "*mitdafkim* [were pounding]" in the *hitpael* [reflexive] form, which indicates a feigned action — as in *mitasher* [acting like a rich person] or *mitroshesh* [acting like a poor man] (Proverbs 13:7) — as they [only] appeared to be pounding, but were not actually pounding, since they did not come in the way of a fight. This was not the case in Sodom, [there] it is written: *and they came near to break the door* (Genesis 19:9). And also there, Lot closed the door behind them because he was afraid of them, which is not the case here — it states, *And he went out to them* — since he knew they would not have the gumption to enter his house. D) Since he said to them that it was a disgrace, behold, their intellect was in place to know that it was a disgrace, which was not the case with Lot. He only mentioned the first argument, that they should not do [the strangers] evil since they had come to his house. But he did not say to them that it was a disgrace, since it was a good thing to them and something fitting according to their statutes.

**הנה בתי.** ר"ל למלאות תאותכם הנה נא בתי ופילגשהו, והגם שהוא ג"כ נבלה, אין בשתן מרובה כבושת האיש, וז"ש שנית **ולאיש הזה לא תעשו דבר הנבלה הזאת**:

**Behold, my daughter.** That is, to satisfy your desire, behold my daughter and his concubine. And although this too would be a disgrace, the shame involved is not as great as the disgrace of violating the man. Therefore he repeats, **“but to this man you shall not do this vile thing.”**

**ולא אבו.** פי' המפ' שלא רצו בקלון בת הזקן: **ויחזק האיש בפילגשו.** וגם זה ראיה שהיה זה רק למלאת תאותם, וע"כ כשמצאו את פילגשו נאותה לתאותם, הסתפקו בזה: **וידעו אותה.** כדרכה: **ויתעללו בה.** שלא כדרכה:

**Sefaria Community Translation:**
**But they would not listen.** The commentators explain that they did not desire the disgrace of the old man’s daughter.

**And the man seized his concubine.** This too is proof that their intent was merely to satisfy their lust; therefore, when they found his concubine suitable for their desire, they were satisfied with her.

**And they knew her** — in the usual manner.

**And they abused her** — in an unnatural manner.

**וינתחה לעצמיה לשנים עשר נתחים.** הראה להם בזה כי שבטי יה מתאחדים כגוף אחד, וכמו שלא יצויר יחול רוח החיים והשכל בגויה אם תנותח לנתחיה כי אז האיברים פגרים מתים, כן לא יצויר יחול רוח החיים והשכינה על כלל האומה אם חלקיה יתפרדו ושבטיה לא יתאחדו כאשר יתאחדו כל האיברים להעמדת החי בכלל. וכמו שאם יתעפש אבר אחד ויעלה בו רקבון, היא רעה חולה לכל הגויה וישתדלו לרפאותו או לחתכו בל יפסיד את הגויה בכללה, כן הדבר הזה אם יופסדו אישים קצתיים מכלל האומה, שבהכרח ישתדלו להשיבם בתשובה או לאבדם מקרבם, וכששלח הנתחים בודאי שלח ספור המעשה ג"כ להודיע כי שערוריה נהיתה בארץ:

**And he cut her into twelve pieces.** By this he demonstrated that the tribes of God are united like one body. Just as it is impossible for the spirit of life and intellect to dwell in a body once it has been dismembered—its limbs becoming lifeless corpses—so too the spirit of life and the Divine Presence cannot rest upon the nation as a whole if its parts are divided and its tribes fail to unite as the limbs of a living body must unite to sustain life.



And just as when one limb becomes infected and decay sets in, it is a grievous illness for the entire body, and efforts are made either to heal it or to amputate it lest it corrupt the whole—so too in this matter: if certain individuals within the nation become corrupted, the people must necessarily strive to bring them back to repentance or remove them from their midst.



And when he sent the pieces, he certainly also sent an account of the incident, to make known that an outrage had occurred in the land.

**והיה כל הראה ואמר לא נהיתה.** ועכ"פ אם נהיתה **לא נראתה**, כי היה בסתר. לכן **שימו לכם עליה**, לחקור ולדרוש אם אמת נכון הדבר, ואח"כ **עוצו** איך לתקן המעוות, כי המיעץ יחשב על כל חלקי הסותר והאפשריות, ואח"כ **ודברו**, דבר מוחלט, שהיא ההסכמה שאחרי העצה:

**Sefaria Community Translation:**
**And it was that everyone who saw it said, “It has not happened.”** And even if something like it had happened, **it had not been seen**, for it was done in secret.

Therefore, **“consider it”** — investigate and inquire whether the matter is true and established.

After that, **“take counsel”** — how to rectify the wrong, for one who gives counsel weighs all opposing factors and possibilities.

And afterward, **“and speak”** — a decisive word, meaning the firm resolution that follows deliberation.
