**(1) Why did Israel assemble for war before they fully knew the details of the incident? What concern was this to all of Israel, since each tribe had its own court to judge the members of its tribe? And why did they not first send a demand that the tribe of Benjamin remove the offenders—saying, “Deliver the men, and we will put them to death”?**

**Sefaria Community Translation:**
**And all the children of Israel went out, and the congregation assembled.** 

If they had proceeded strictly according to the judicial law of the Torah in an individual case, the men of Gibeah would not have been liable to death, as the Ramban explains. For regarding their intent to violate the man, it was only a thought and not carried out in action. Concerning their abuse of the concubine: according to Ramban, a concubine is without kiddushin; and even according to the opinion that she has kiddushin, there were no witnesses and no prior warning. As for her death, it may be said that she died from weakness, since they did not intend to kill her; perhaps she died from the cold or some other cause.

Rather, Israel was aroused with zeal because the act was committed publicly and openly. In such a case, they are judged like heretics—for when many gather brazenly to commit so grave an outrage, and with all the compounded elements of this deed, they approach the status of an “ir hanidachat” (a condemned city). Therefore they could be executed as an extraordinary measure (“le-migder milta”) according to the need of the hour.

Such authority could only be exercised either by the king of Israel, who may execute under the law of the monarchy, or by the entirety of Israel with the Sanhedrin at their head—who stand in place of the king and may destroy a band of evildoers as a king would, especially in a case involving great desecration of the Divine Name.

Thus it says, **“And all the children of Israel went out, and the congregation assembled,”** for as we have explained elsewhere (in my work Torah ve-haMitzvah, Vayikra §241), the term “congregation” refers to Israel assembled with their elders at their head.

**(2–3) Why did they seek to put them to death when there were no witnesses and no prior warning? Especially according to the opinion (Sanhedrin 21a) that a concubine is without kiddushin. And her death was due to her weakness, not because they intended to kill her. Why then did they pour out their wrath upon the entire tribe of Benjamin? And the statement in verse 3, “And the children of Benjamin heard,” does not seem to belong there at all—why is it placed in that context?**

**And the chiefs of all the people stood.** That is, they took their positions according to the order of the banners—Judah and his division to the east, and so on.

And among them were found **all the tribes of Israel in the assembly of the people of God**, for they gathered as the people of God, coming to be zealous for His honor.

And there were **four hundred thousand men**, all of them **foot soldiers**, not riders on horses—who came and assembled out of zeal for the honor of the Divine Name.

**And the children of Benjamin heard.** This teaches that the matter was not hidden from Benjamin. They heard that the children of Israel had gone up to Mizpah, and they also heard that the children of Israel were saying, “How did this evil happen?” Indeed, they heard all the details that are related up to verse 12. Yet despite this, they did not take it to heart to remove the offenders themselves, nor did they come to the assembly to clear themselves.

**And the children of Israel said, “Speak—how did this evil happen?”** For although they had already heard the account from the messengers who carried the pieces, the essential matter depended on the specific details. If this had been the act of isolated individuals who violated his concubine and she died merely as a result of the assault, that alone would not justify all Israel going to war.

Rather, everything depended upon the additional elements that converged in this outrage. Perhaps she had already acted immorally, or perhaps she was not legally bound in marriage, as the Ramban argued in defense of the men of Gibeah. Or perhaps she died from the cold or some other cause. Therefore they sought clarification of the precise circumstances.

**ויען האיש הלוי איש האשה הנרצחה.** בא להוציא שלא היתה פנויה ולא זנתה תחתיו, כי הוא איש האשה בדרך קדושין, ושהיתה מותרת לו כי לא זנתה תחתיו, ושלא מתה מחמת הקור כי נרצחה: **ויאמר הגבעתה אשר לבנימין באתי.** א] הנה חטא זה מתדמה בחיצוניותו לענין סדום, גם שם באו האורחים ללון וקראו אל לוט הוצא האנשים ונדעה אותם, וזה חרפה גדולה לכלל ישראל, וז"ש באתי **ללון**:

**Sefaria Community Translation:**
**And the Levite, the husband of the murdered woman, answered.** This is stated to clarify that she was not unmarried and had not been unfaithful to him, for he was her husband through kiddushin; she was permitted to him, since she had not committed adultery. And she did not die from the cold, but was murdered.

**And he said, “To Gibeah, which belongs to Benjamin, I came.”** First, this sin outwardly resembles the matter of Sodom. There too, guests came to lodge, and they called to Lot, “Bring out the men that we may know them.” This was a great disgrace to all Israel. Therefore he emphasized that he came **to lodge**.

(2) **“And they rose up against me.”** He and she had had no prior dealings with them whatsoever.



(3) It was not merely individuals who rose up, but **“the lords of Gibeah”**—the prominent men and leaders of the city—and this openly.



(4) **“And they surrounded the house against me by night,”** which closely parallels the incident of Sodom.



(5) **“Me they intended to kill,”** for he would certainly have died from the abuse; all the more so in the case of his concubine, whom they afflicted and she died—even though a woman’s body is more accustomed to relations. And though they only intended it and did not carry it out, he was forced to save himself through his concubine.



(6) **“And they afflicted my concubine,”** who was a married woman.



(7) Because they intended to kill him, they therefore abused his concubine—meaning they took her against her will. This was a great public act of violence, as the Maharai”a explains.

**For they committed lewdness and outrage.** The act itself was lewdness; and insofar as it was done publicly, in a manner of brazen defiance, it was an outrage that touched the entire nation of Israel.

**Behold, all of you…** You possess the authority of a king to administer justice according to the need of the hour, in order to make a protective measure.

**“Give your word.”** This refers to issuing the legal ruling—what is to be done with them.

And afterward, **“and counsel”**—how to carry the ruling into effect, to remove the offenders (see what is explained on Isaiah 8:10).

**Sefaria Community Translation:**
**We will not go, each man to his tent** — to remain there. Nor even **will we turn, each man to his house**, whether temporarily or to prepare provisions.

And if you should ask: Who will prepare provisions for the people? **This is the thing that we shall do to Gibeah** — that is, for the matter of Gibeah.

**Against it** — meaning, for its sake, in order to remove the offenders from its midst; for they did not intend to kill all the inhabitants of Gibeah, but only the guilty ones.

**And they sent.** This highlights the wrongdoing of the children of Benjamin: Israel sent messengers to them and opened with words of peace. They said, **“What is this evil?”** — meaning, see how great this evil has become and what it has produced. It **has arisen among you**, and you are the first who should remove the offenders.

**And now, deliver the men.** Then the evil will be removed from you and transferred to the collective responsibility.

**And we will remove the evil** — all of us together, from the midst of Israel.

Yet despite this entire mission, **the children of Benjamin were unwilling to listen**, to surrender the offenders. Even more than that, they gathered for war and were the first to open the strife.

**Questions** 

**(18–29) Why were Israel defeated twice before Benjamin, even though they went to contend Hashem’s cause and to be zealous for His honor? And if they inquired twice through the judgment of the Urim, how was it that the inquiry was not fulfilled and they fell slain?



After it says in verse 22 that the men of Israel strengthened themselves and again set the battle in array, how does the following verse say that they went up to Bethel and sat there—had they not already been before Gibeah and arranged the battle there?



Why in the second instance did they ask in the wording “Shall I again draw near?” and in the third instance did they ask, “Shall I again go out?”



Why in the second instance does it say, “And the children of Israel went up and wept,” whereas in the third instance it says, “And all the children of Israel and all the people went up”? And why does it add that they fasted and offered burnt offerings?



The statement in verses 27–28—“And there was the Ark of the Covenant… and Phinehas…”—would seem to belong earlier, in verse 18, when they inquired the first time. And why is the phrase “in those days” repeated?**

**ויקומו ויעלו בית אל וישאלו באלהים.** חז"ל (פדר"א לח) אמרו הטעם שנגפו בשני פעמים הראשונים, מפני שגם הם היה בקרבם עון פסל מיכה, שהיה ג"כ חטא של רבים, וקצף ה' עליהם על שלא מיחו לכבודו בבני דן על עון ע"ז שהוא חמור יותר, ורק לכבודם מיחו בדבר זימה וחמס שנוגע לתקנת החברה וישוב הארץ. אולם בכתובים עצמם הדברים מבוארים שהיו שלשה הבדלים בין שני הפעמים הראשונים שלא הצליחו במלחמה ובין הפעם האחרון.

**Sefaria Community Translation:**
**And they arose and went up to Bethel, and inquired of God.** 



Our Sages (Pirkei deRabbi Eliezer 38) said that the reason they were defeated the first two times was because they too had within their midst the sin of Micah’s idol, which was also a sin of the many. Hashem was angered with them for not protesting, for the sake of His honor, against the tribe of Dan concerning the sin of idolatry—which is more severe. Yet here they protested only in a matter of immorality and violence, which concerns social order and the settlement of the land.



However, in the verses themselves it is explained that there were three distinctions between the first two occasions, when they did not succeed in war, and the final time.

**Sefaria Community Translation:**
The first distinction: in the beginning they asked, **“Who shall go up for us first to wage war against the children of Benjamin?”**
They did not ask whether they should go up to war at all, nor whether they would succeed in their battle, for they relied on their own strength and on the arm of flesh.
He answered them according to their manner:

**“Judah first.”**

That is, Judah precedes in all matters. It does not say “Judah shall go up,” and certainly it does not state whether they would succeed.
In the second instance it says:

**“And the people, the men of Israel, strengthened themselves and again set the battle in array in the place where they had set it in array on the first day; and the children of Israel went up and wept before Hashem.”**

It is clear from this that at first they went up to battle on their own initiative and did not inquire of Hashem, and they were already positioned in the place where they had arranged themselves on the first day.

Accordingly, when it says, “the children of Israel went up and wept before Hashem,” it cannot mean that all of them went up, for they were already at the battlefield before Gibeah; rather, they sent their elders and judges, and they wept.
And they asked:

**“Shall I again draw near for battle?”**

They did not ask, as in the third instance, **“Shall I again go out?”** — because they had already gone out and were standing before Gibeah; all that remained was to approach and engage the city, as it says:

**“And the children of Israel drew near to the children of Benjamin.”**

Thus the question was only whether they were permitted to wage this war according to the law.

They also did not ask whether they would succeed, for even now they relied on their strength and their great numbers.

Therefore He answered them:

**“Go up against him.”**

That is, you are permitted to go up — but He did not inform them whether they would succeed, for that depends on whether they repent of their sins.

Not so in the third instance: they did not even dare to go out at all. Rather:

**“And all the children of Israel and all the people went up and came to Bethel”** — meaning, not a single man was missing.

And they asked:

**“Shall I again go out?”**

And He answered:

**“For tomorrow I will deliver him into your hand.”**

The second distinction: in the first instance they did not repent at all. In the second instance, where it says, “And the children of Israel went up and wept,” I have already explained that not all of them went up, but only their elders; and they did not weep over their sins, but over the fallen. Therefore they were again defeated in battle.



But in the third instance, when all of them went up and all of them wept—and not only that, but they preceded their request with three actions:



(1) **And they sat before Hashem** — to examine their deeds.



(2) **And they fasted on that day** — to restrain transgression and bring sin to an end.



(3) **And they offered burnt offerings and peace offerings** — offerings of thanksgiving for the remnant that had been spared, for they understood that all of them deserved destruction because of their sin.



Therefore they succeeded on that occasion.

The third distinction: our Sages (Yoma 73b) and the commentators explain that in the first and second instances they did not inquire in the proper place nor through the proper person. Only in the third instance does it explicitly state that they inquired in the proper place, as it says, **“And the Ark of the Covenant of Hashem was there in those days”**—that is, now, at this time. And through the proper person, as it says, “And Phinehas the son of Eleazar stood before it in those **days**”—meaning now, in the third instance. Therefore they were answered.

Meanwhile, the children of Benjamin increased in their wickedness. For whereas Israel’s objective was only against Gibeah—as it says in the first instance, “and they set the battle against them at Gibeah,” and in the second instance, “and they set the battle against Gibeah as at the first”—Benjamin, by contrast, intended to destroy Israel.

They also grew more brazen each time: in the first instance it says, “And the children of Benjamin went out from Gibeah”; in the second, “And Benjamin went out to meet them from Gibeah”—the phrase “to meet them” implying a face-to-face confrontation; and in the third instance it adds that they were drawn away from the city.

Israel had come from Bethel, which lies to the north of the land of Benjamin; thus their camp was to the north. And while Israel was arranging its lines, the first ambush—positioned to the west of Gibeah—emerged from its place, from the cave of Gibeah where it had been concealed in hiding.

All this was related in general terms; from this point onward, the text begins to explain in detail how it unfolded, and proceeds to describe the particulars of the battle.

**And the children of Benjamin saw that they were defeated.** That is, immediately at the outset, when the ambush emerged, the children of Benjamin realized that they were being struck, and their intent was to return to the city.

At that moment, **the men of Israel gave place to Benjamin**—meaning that the camp which stood opposite them to the north began once again to flee.

And it explains why they did this: **for they trusted in the ambush which they had set against Gibeah.** This refers to another ambush positioned on the southern side, prepared to strike down the inhabitants of the city. The arrangement between them was that when the ambush had struck all the men of the city, they would set the city on fire; and when Israel would see the column of smoke, they would turn back against Benjamin and surround them from every side, as will be described.

Therefore it says, “for they trusted in the ambush.”

At that time **Benjamin began to strike down slain… about thirty men.** And the children of Benjamin thought, **“Surely they are utterly defeated before us.”** That is, although in the midst of the fighting they themselves had also been struck, they paid no attention to this, for they assumed that even if Israel had momentarily strengthened themselves, their power had already been broken. Therefore Israel gave place to Benjamin.

Thus, these three verses serve as an explanation and elaboration of what was stated earlier (in verse 36): “And the children of Israel gave place to Benjamin, for they trusted in the ambush which they had set against Gibeah.”

Their route led along the highways, from there before the city on its eastern side, and from there toward the wilderness.

But in this movement **the battle overtook them**, for they were encircled and pursued from three sides. Moreover, **those from the cities destroyed them in their midst**—that is, the divisions of Israel that had come out from the cities penetrated into the center of Benjamin’s camp and destroyed them from within.

Afterward, **they pursued him**—this is a causative action toward a third stage, meaning that they caused him to become the pursuer by making themselves appear defeated, so that he pursued them (as stated in verse 36 and following).

Then, **they drove him relentlessly**, when they set his cities on fire.

And **those from the cities destroyed him in his midst**.

Thus he was struck down until he reached **opposite Gibeah, toward the east of the sun**, for by that route he fled toward the wilderness.
