**בכ"מ,** וצ"ע בפ' הנשרפין כו' מגדף הוראת שעה היתה. ע"ש (ע"ח:) דפירש"י דהחבישה היתה הוראת שעה. אבל הסקילה משמע מפי' דהיתה כדין אף דלא אתרו ביה דהא לא הוו ידעי אם חייב מיתה כלל. וא"כ אדרבה מוכח דס"ל כהרמב"ם. ומש"כ מפ"ק דתניא ושאר כל חייבי מיתות כו', הלא ע"כ האי כללא ל"ד דהרי עדים זוממין א"צ התראה לכ"ע:

משמע דכל היכא דליכא מעשה לא בעי התראה. ק"ל דהא מקלל אביו ואמו נמי חשיב בתו"כ שהביאו רש"י בסנהדרין (ס"ה:) לאין בו מעשה ואפ"ה כתב הרמב"ם ברפ"ה מהל' ממרים דצריך עדים והתראה:
