**וכן ארבע אמות של אדם וכו' וקטנה תזכה לה חצרה וכו' עד שיזכה לו בה אחר:** כתב הראב"ד ז"ל אין דבר זה מחוור במתנה אלא במציאה עכ"ל: **ואני** אומר עיקר זאת ההלכה פ"ק דמציעא ובגיטין בכמה מקומות ודעת רבינו משה ז"ל והעומדים בשיטתו אם מטעם שיש לו יד או שליחות מ"ש מתנה ומאי שנא מציאה ודעת הראב"ד ז"ל והעומדים בשיטתו דשאני מתנה הואיל ודעת אחרת מקנה עדיפא להו ולכלם יש בתלמוד פנים:

**המתנה כגט שאין אדם יכול למסור דברים לשליח וכו' עד למקבל לא קנה:** כתב הראב"ד ז"ל ה"ה אם אמר להם תנו עכ"ל: **ואני** אומר גם ההלכה זו עיקרה פרק כל הגט וסברת ראב"ד ז"ל יש לה פנים לפי הסוגיא דמסגי להו בסגנון אחר ור"מ ז"ל לא כתבה לפי שאינה פשוטה בגמרא וכמ"ש בזה החיבור כמה פעמים כי לכך קראו משנה תורה:

**מקבל מתנה שטוען ואומר וכו' עד ותחזור לבעליה:** כתב הראב"ד ז"ל רעיון רוח ונשבע שבועת היסת עכ"ל: **ואני** אומר דעת ר"מ ז"ל מסוגיין דפ' השולח ופרק המביא אשם תלוי דעביד טענת המקבל כטענת הנותן וא"כ אית לן למימר מה הנותן נשבע היסת אף המקבל כן. ומ"ש הראב"ד ז"ל לפטרו לגמרי מפני שהיא הודאת בע"ד כמאה עדים ולא מצינו שבועה בהודאה והאמת יורה דרכו:
