**כל עיר שאין בה שני חכמים גדולים וכו' סנהדרין שיש בה שנים וכו' עד סנהדרי חכמה:** כתב הראב"ד ז"ל כן ראוי להגיה שנים ראויין ללמד ולהורות וכו' סנהדרין שיש בה שנים אחד ראוי לשמוע ושנים ראוין לדבר הרי זו ראויה לסנהדרין וכו': **ואני** אומר עיקר הלכה זו שלהי פ"ק דסנהדרין דגרסינן ואמר רב יהודה אמר רב כל עיר שאין בה שנים לדבר ואחד לשמוע אין מושיבין בה סנהדרין ובביתר היו שלשה וביבנה ארבעה ורבי אליעזר ורבי עקיבא ורבי שמעון התימני דן לפניהם בקרקע ואותבינן עלה מיהא שלישית חכמה רביעית אין למעלה הימנה ופרקינן הוא דאמר כי האי תנא שניה חכמה שלישית אין למעלה ממנה ור"מ ז"ל פירש דברי רב שנים אחד מהם יודע לדבר כלומר ללמד ולהורות ואחד מהם שראוי לשמוע מושיבין בה סנהדרין כלומר והם הם מכללן והיא המדרגה הראשונה היו בה שלשה או ארבעה הם כביתר ויבנה דקאמרינן ובההיא ברייתא דקא מותיב ליה מינה משום דלא קתני בה שניה וקס"ד המדרגה הראשונה היתה שלישית כלומר שיהיו בה שלשה יודעין ופריק הוא דאמר כלומר רב דאמר מדרגה ראשונה להושיב בה סנהדרין בשנים ס"ל כי האי תנא דקרי לה לשנים חכמה כלומר מדרגה שניה שהיא למעלה מן הראשונה שהם מסנהדרין ונקראת חכמה הם שנים לדבר ואחד לשמוע שכולם הם שלשה ושנים מהם לדבר ואחד לשמוע והברייתא לא פרשה אלא שניה שהוא לשון כלל למדרגה השניה ולשנים היודעין לדבר ולהורות שהם עיקר כביתר והמדרגה השלישית שאין למעלה ממנה כשהיא משולשת בשלשה יודעין לדבר ולהורות כיבנה והיא היא הברייתא גופה דאותביה מינה אלא לפי שפירש בה בהא בתרייתא שניה כדפירש רב למילתיה אוקמא כותיה ומיהו לא פליגי וזה דעת ר"מ ז"ל לפי גרסתנו וכן גורס ר"ח ז"ל או באולי שהיה לו גירסא אחרת ואנכי לא ידעתי ורש"י ז"ל פירשה בידיעת שבעים לשון ולשון הראב"ד איני יכול להולמו בלשון הגמרא:
