**אי זהו לאו שבכללות זה לאו אחד שכולל וכו' כיצד כגון זה שנאמר אל תאכלו ממנו נא וכו' עד מפי השמועה למדו שזה לחלק:** כתב הראב"ד ז"ל זהו דלא כאביי ורבא עכ"ל: **ואני** אומר לא כתב כן על לאו שבכללות דלא תאכלו על הדם שזה מפורש פרק ארבע מיתות בסנהדרין וגם במכות פרק הלוקין אבל כתבו על ענין הנא והמבושל ואילו ראה הראב"ד ז"ל ספר המצות שחיבר ר"מ ז"ל בלשון ערב ומ"ש שם בעיקר התשיעי לא היה כותב השגה זאת וגם איני צריך לכתוב הצלתו כי הקדים דברו לרפואתו וז"ל אמר אביי אכל נא לוקה שתים מבושל לוקה שתים נא ומבושל לוקה שלש וזה שהוא יסבור שלוקין על לאו שבכללות ואחר שאכל נא עבר על שני לאוין האחד מהן אל תאכלו ממנו נא שיצא לנו מכלל מה שאמר כי אם צלי אש שהוא כאילו אמר אל תאכלו אלא צלי והוא אכלו בלתי צלי וכשאכל נא ומבושל לוקה לפי דעתו שלש אחת על אכלו נא ואחת על אכלו מבושל שלישית על אכלו בלתי צלי ואמרו שם בסדר זה הדבר ורבא אמר אין לוקין על לאו שבכללות איכא דאמרי חדא מיהא לקי כלומר כשאכל נא ומבושל לוקה אחת ואיכא דאמרי חדא נמי לא לקי דלא מייחד לאויה כלאו דחסימה כלומר אמרו יתברך לא תחסום שור בדישו שהוא לאו אחד ימנע מדבר אחד ואולם זה הלאו המונע משני הדברים נא ומבושל אין לוקין עליו וכבר נתבאר בגמרא סנהדרין אין לוקין על לאו שבכללות ולפיכך מאמר אביי הוא נדחה והאמת שהוא לוקה אחת בין שאכל נא או מבושל או נא ומבושל אחת בלבד הוא דלוקה ולפיכך נמנה אמרו יתברך אל תאכלו ממנו נא ובשל מבושל במים מצוה אחת עכ"ל והדין עמו דקי"ל בכוליה תלמודא אביי ורבא הילכתא כרבא בר מיע"ל קג"ם וזה פשוט ונכון ואולי בגירסת הראב"ד ז"ל מהפך דברי אביי לרבא ומרבא לאביי כאשר מצאתי אני בגירסאות הצרפתיות ואעפ"כ מן התימה שיכתוב דלא כאביי ולא כרבא והנוסחא הספרדית היא עיקר:
