**וכן אם יצא שטר חוב לפניו וכו' עד אלא בשבועה:** כתב הראב"ד ז"ל דבר זה הוציא ממה שפר"ח ז"ל וכו': **ואני** אומר אין צריך לומר מפר"ח ז"ל לבדו אלא גם הלך בשיטת רבותיו נ"ע שכן כתב ר"י אלפס ז"ל פ' הכותב בההוא עובדא דבת רב חסדא ושהביא גם הראב"ד ז"ל קרענא שטרא אפומיה ומקשי תלמודא קרענא ס"ד אלא אימא מרענא שטרא אפומיה וכתב רב אלפס ז"ל ולא מיפרע מיניה אלא בשבועה עכ"ל. ומיהו אם כתוב בה נאמנות לא פירש אחד מהם ולפי דעתי טעה הסופר שכתב ההשגות ונתחלף לו פרק אע"פ בפרק הכותב כי בפרק אע"פ אין שם זכר לזה וכיוצא בו ומה שהוא בפרק הכותב זה הוא שאמרנו דמרענא שטרא אפומיה ויכול לפרש אותה כפירוש שני שפירש ר"י אלפס ז"ל שודא דדייני או כמו שפירש הוא בעצמו ז"ל בכאן ושבפרק שבועת הדיינין נמי איתא גבי אל תפרעני אלא בפני פלוני ופלוני כו' עד דאמרינן איתרע שטרא וכל אחד יכול לפרש כפי רצונו ולא מצאתי און לי רק פ"ק דמציעא דאמר הכי תלמודא להדיא וההיא גופה לאו ראיה היא דמיירי בשמצאו וכיון דנפל אתרע טפי דאם איתא דלא פרעיה מנטר הוה נטר ליה ואי לא נטריה איהו דאפסיד אנפשיה כדאיתא פרק הכותב גבי שובר לכך צדקו דברי ר"מ ז"ל מכל צד:
