**ואחד המקלל עצמו או חבירו וכו' עד הרי הן בכלל הכנויין:** כתב הראב"ד ז"ל אינו לוקה אלא בשם המיוחד והכי איתא בירושלמי עכ"ל **ואני** אומר הוא הניח הירושלמי וסמך על הבבלי דפ' שבועת העדות וכן פירש בספר המצות שחיבר בלשון ערבי וכן הסכימו רוב המפרשים ז"ל הואיל והבבלי אחרון אחר אחרון אני בא ולשון העכו"ם שכתב יש לו ראיה פ"ק דנדרים לגבי כנויי נדרים דאמרינן לשון עכו"ם הם:
