**לספור כו'.** דיני המצוה מבוארים בר"מ פ"ז מהתו"מ וברי"ף סוף פסחים והשיטות אלו שמביא המחבר תמצא שם בר"נ ובבעה"מ. וע' תוס' מנחות ומבואר בטא"ח ובב"י סי' תפ"ט ובש"ע ובאחרונים. וע' ש"ס מנחות וספרתם לכם שתהא ספירה לכאו"א. וע' תוס' מנחות דע"ה ע"ב ד"ה וספרתם כו' ביובל כתיב וספרת שם המצוה לב"ד ויבואר לקמן בעזה"י במקומו. ועיין בגמרא ובמג"א שם דעתו נוטה דאינו יוצא בספירת חבירו אף על פי ששמע ול"ד לקידוש וכדומה שיוצא בשמיעת חבירו דגזרת הכתוב הוא דכ"א מחייב לספור לעצמו וע"ש שמביא בשם הב"י שיוצא אם שומע מחבירו וע"ש שהניח בצ"ע דין זה ובספר חק יעקב דעתו ג"כ דאינו יוצא בשמיעה מחבירו ובפר"ח פלפל ודעתו דבדיעבד יצא אם שמע מחבירו ומביא בשם הספרי דעיקר מה שהזהירה התורה ספירה לכאו"א להוציא שהי' הסברא דרק לב"ד המצוה כמו ביובל. וכבר האריכו האחרונים בזה. ועיין מגן אברהם דספירה היא בכל לשון ולאו דוקא בלה"ק ואם אינו מבין לה"ק וספר לא יצא. והנה דעת רוב הראשונים דספירה בזה"ז שאין עומר הוא רק דרבנן אבל דעת הר"מ שהוא מן התורה ער"נ פסחים ובכ"מ ובב"י. ונשים ועבדים פטורים ממצוה זו דהוי מ"ע שהז"ג ועיין מגן אברהם כתב דהאידנא שווייא עלייהו חובה. וד"ז צ"ע והוא דבר חדש דנשים אם קבלו עליהם לעשות מ"ע שהם פטורין יתחייבו מפני דשוויא עלייהו חובה ולא ראיתי כן בשום מקום ואינו דומה לתפלת ערבית עיין בראשונים וכאן יש דיעות דאסור להו לעשות מ"ע שהז"ג ולכ"ע אינו מצוה כלל והיאך ישוויי' חובה. ולא ידעתי מוצא הדברים של ד' המג"א. ומ"ש הרהמ"ח בסוף המצוה ונוהגת כו'. ועתה בעוה"ר כו' מונין הימים והשבועות נראה דקצת חיסור לשון יש כאן. ונראה דסובר כדעת הראשונים הסוברים ספירה בזה"ז דרבנן וצ"ל ועתה כו' אעפ"כ מונין אנו הימים ושבועות דהיינו לאפוקי מדעת הר"מ שכתב כיון דמונין אנו הימים ושבועות מוכח דספירה היא דאורייתא והרהמ"ח סובר כרוב הראשונים דספירה דרבנן מכל מקום מונין אנו הימים והשבועות עיין בדבריהם. מכל מקום צע"ק שנטה מדעת הר"מ אשר עפ"י רוב נמשך אחריו על כל פנים היה צריך להביא דעת הר"מ ולומר שהוא סובר בסברת רוב הראשונים כדרכו בכל החיבור. והנה נראה פשוט לשיטות הראשונים הסוברים דאם לא מנה בלילה יספור ביום. או אם דלג כ"ה יספור אח"כ דלא הפסיד המצוה אין חילוק בין אם שכח או הזיד ולא מנה או שלא היה מחויב למנות כגון קטן שנתגדל בימי הספירה או עבד שנשתחרר ביום מכל מקום חייב למנות כי זה אינו מהשלמה שנאמר דאם לא היה חייב א"צ להשלים כמו במס' חגיגה גבי חיגר ועוד כמה מקומות לענין תפלה והבדלה כי דין זה דמונה עם כל ישראל כך המצוה דאין יום א' תלוי בחבירו דאי הי' מטעם השלמה היה צריך להשלים ולמנות גם המנין של אתמול וגם אם שכח בלילה ומונה ביום לשיטה זו לאו השלמה היא אלא המצוה נמשך והוי כמו א' שנשתטה בתחלת ליל פסח דפטור ממצה ואחר כך נתפקח בלילה בודאי חייב לאכול מצה דכל הלילה הוא המצוה ואין זה השלמה ה"ה כאן וז"פ. ולשיטת הראשונים דס"ל אם לא מנה יום א' הפסיד המנין והטעם כמ"ש הרהמ"ח דהם מצוה א' ומכיון שלא מנה יום א' בטל ממנו החשבון נראה ג"כ בפשיטות דאין חילוק בין אם לא מנה ששכח או הזיד או שלא מנה שהי' קטן עד אמצע הספירה או נשתחרר כיון שלא מנה בטל החשבון ממנו וגם ז"פ. אך אני מסופק לשיטה זו אם הקטן אף על פי שאינו חייב מכל מקום מנה כדרך הקטנים או עבד מנה קודם שנשחחרר ג"כ כי רשאי לעשות מעשהז"ג כמבואר בכ"מ בש"ס ובאמצע נתגדל הקטן ונשתחרר העבד אי מחויב מן התורה למנות בגדלותו ובגירותו בשנה ההוא מי נימא דבחיוב ובפטור תליא מלתא וכיון שהיה פטור אף שמנה מכל מקום כיון שמצוה א' היא ומקודם לא נתחייב גם עתה אינו חייב מן התורה ואין כופין אותו למנות ככל מ"ע שבתורה או דלמא כיון שמנה אף שהיה בפטור מכל מקום לא בטל החשבון על כל פנים וחייב מכאן ולהבא ומצינו במרדכי במגלה הביא סברת רבינו טוביה מווינא מובא גם כן במג"א סי' קפ"ט דהמחויב מדרבנן מוציא החיוב מן התורה דיוצא בקידוש היום מפלג המנחה ולמעלה ע"ש אם כן כמו דיוצא בקידוש של שבת בזמן דרבנן אם כן בקטן שנתגדל דעכ"פ הגיע לחינוך קודם בודאי מועיל אז הזמן שמחייב מדרבנן להיות חייב אח"כ מן התורה ואין החשבון בטל. אלא בעבד ונשתחרר מסופק אני אם מנה בעבדותו אם בטל החשבון כיון שאינו מחויב או על כל פנים כיון שעשה המצוה אפילו בפטור מועיל על אח"כ דאין החשבון בטל וצ"ע. והי' נראה להביא ראיה קצת לדין זה מפ' הבא על יבמתו הי' לו בנים בגיותו ונתגייר כיון דזרעו מיוחס קיים המצוה של פ"ו אף דעשיית המצוה הי' בזמן שהי' פטור דב"נ אין מצווין על פ"ו כמבוא' בסנהדרין מכל מקום קיים המצוה המוטלת עליו בזמן החיוב כיון דמ"מ יש לו בנים ה"נ אף ע"פ דעתה חל עליו מן התורה החיוב ומקודם היה פטור מכל מקום המצוה שעשה בפטור עלתה לו עתה ג"כ דלא בטל החשבון וחייב מן התורה כנלע"ד. שוב ראיתי בספר ט"א לר"ה בהא דמבואר שם כפאו ואכל מצה כו' אילימא דכפאו שד כו' והתנן עתים חלים ועתים שוטה בשעה שהוא שוטה ה"ה כשוטה לכ"ד וע"ש שפירש דהיינו כיון דהוא כשוטה ושוטה פטור מן המצות אין המצוה שעשה בשעת הפטור פוטרו אח"כ בזמן החיוב כיון דבשעה שעשה המצוה הי' פטור והקשה הט"א מיבמות דהי' לו בנים בגיותו כו' קיים פ"ו אף על פי שעשה המצוה בזמן הפטור ע"ש שפי' פי' אחר בש"ס שם ואח"כ דחה הפי' האחר ומסקנתו כסברא זו ויישב שם מיבמות ע"ש. ולדידי' ל"ק כלל דחילוק גדול יש בין הנושאים דודאי אכילת מצה ושופר וכדומה דהמצוה היא לאכול מצה ולשמוע שופר אם כן בודאי סברא היא דאין עשיית המצוה פוטרת אותו אם עשה בזמן הפטור כיון שקודם לא נתחייב כלל ואח"כ נתחייב מן התורה שיפטור עצמו בזה אבל גבי פ"ו דהמצוה היא להיות לו בנים ולקיחת אשה ולהוליד זו הכשר מצוה דא"א לקיים להיות לו בנים בל"ז והמצוה אין לה הפסק כשאר מצות רק כל ימי חייו היא המצוה ובכל רגע מקיים המצוה והא ראיה דר"י בעצמו סובר שם דאם הי' לו בנים ומתו לא קיים המצוה חזינן אף על גב דעשה המצוה והוליד מכל מקום כיון שמתו נפסק המצוה אם כן עיקר המצוה שיש לו בנים ע"כ אע"ג דהכשר מצוה הי' בגיותו מכל מקום עתה שנתגייר וחייב במצות ועתה יש לו בנים מקיים המצוה כי מצוה זו נמשכת תמיד ועושה המצוה בחיוב רק הכשר מצוה עשה בפטור אבל במצה וכדומה בשאר מצות דאין המצוה נמשכת רק המצוה היא העשיי' אם כן לאחר עשיית המצוה פסקה המצוה בודאי אין מועיל מה שעשה המצוה בעת שהי' פטור כיון דעת' בעת שהתור' חייבתו לא עשה כלל ומה מועיל מה שעשה בזמן שלא חייבה אותו התורה כלל אבל בפ"ו אין המצוה לעשות רק הכשר מצוה אבל עיקר המצוה מה שיש לו בנים ואם מתו לא קיים כלל אע"ג דלקח אשה והוליד והמצוה נמשכת אם כן עושה גם עתה בעת החיוב המצוה ע"כ יצא כי אינו מקיים המצוה מחמת גיותו כי גם עתה בגירותו מקיים כמו כ"א מישראל דהמצוה היא הבנים אבל במצוה שתלוי בעשייה ועכשיו בזמן החיוב לא עשה כלל בודאי אינו יוצא כי לא עשה המצוה עתה ומה שעשה אז לא הי' חייב כלל ואחר העשיי' נפסקה המצוה ואינו עושה ולמה יצא בזה י"ח המצוה וע"ש ביבמות דר"י סובר דבהי' לו בנים בגיותו יצא והוא בעצמו סובר דהי' לו בנים ומתו לא קיים המצוה אם כן כיון דהמצוה נמשכת ע"כ יצא אף שעשה בזמן הפטור כי הוא מקיים גם עתה בזמן החיוב אבל מה שתלוי באיזה עשייה והמצוה נפסקת בודאי אינו מועיל מה שעשה בזמן הפטור. וע"ש בט"א שדבריו תמוהין שכתב דר"י סובר דקיים דהוא משום לשבת כו' אע"ג דר"י פליג על ר"ה וסובר דאם היה לו בנים ומתו דקיים פ"ו מכל מקום כאן מודה כו' ובאמת הוא העלמת עין אדרבא ר"י סובר דהי' לו בנים לא קיים דשבת בעינן ועיין בש"ס שם ומכל מקום כאן נוכל לומר דהיא מצוה נמשכת אף שהיא חדא מצוה מכל מקום לא בטל שם החשבון וחייב אח"כ בנשתחרר אם מנה מקודם כנלע"ד בעזה"י. וכעין סברא זו תמצא בר"ן פ"ב דביצה לענין חילוק של עירוב תבשילין ובין עירובי תחומין וחצרות. והנה עבד פטור דה"ל הזמן גרמא. וח"ע וחב"ח להסוברים דבספירה מוציא את חבירו אם כן צריך לשמוע מב"ח גמור לצאת י"ח כמו שופר ומגילה דח"ע וחב"ח אף לעצמו אינו מוציא דלא אתי צד עבדות דידי' ומפיק צד חירות דידיה וצריך לשמוע מאחר. אך להפוסקים דא"י י"ח מאחר דספירה לכ"א בעינן אם כן הוא פטור מסה"ע כיון דהוא בעצמו צריך לספור וצד עבדות דידיה לא מפיק צד חירות דידיה אף דצד חירות חייב בכל המצות מכל מקום כאן מה יעשה כיון דהעבדות מעכב עליו וכ"כ גבי שופר אי ליכא אחר שישמע ממנו א"צ לתקוע בעצמו דאינו יוצא כלל ולמה יתקע וכן בשאר מצות ויבואר עוד בעזרת השי"ת. ואפ"ל דגם גבי שופר דוקא אם יכול לשמוע מאחר א"י ע"י עצמו אבל אם ליכא אחר אפשר דמחויב לעשות המצוה בעצמו כי החלק דצד חירות חייב וצ"ע. ועיין מ"ש לקמן במצות שופר. וטומטום ואנדרוגינוס דינם כמו בכל המצות שהזכרים חייבים ולא נשים. ועיין נוב"י מ"ק דין אונן בליל ספירה דעתו שימנה ויש לפלפל בדבריו. ואם שכח למנות עד בה"ש להסוברים ספירה בזמן הזה מן התורה היא סד"א ולחומרא ואם ספירה בזה"ז דרבנן ה"ל סד"ר כמו סוכה ולולב ע"ש פ' לולב וערבה. ולענין מצות צריכות כוונה הדין כאן כמו בכל המצות התלויות בדבור עיין בש"ע ואין כאן מקומו:

To count, etc.; the laws of the commandment are explained in the Rambam chapter seven of Temidin U'Musafin and in the Rif at the end of Pesachim, and these positions brought by the author you will find there in the Ran and the Ba'al HaMaor, and see Tosafot Menachot, and it is clarified in the Tur Orach Chaim and Beit Yosef section 489 and in the Shulchan Aruch and the later commentators, and see the Talmud Menachot "and you shall count for yourselves" that there shall be a counting for each and every one, and see Tosafot Menachot page 75b starting with "and you shall count" etc. regarding the Jubilee it is written "and you shall count" [in the singular] there the commandment is for the Court and it will be explained later with God's help in its place, and see in the Gemara and in the Magen Avraham there his opinion tends that one does not fulfill the obligation through the counting of his fellow even though he heard and it is not similar to Kiddush and the like where one fulfills through the hearing of his fellow for it is a Scriptural decree that each one is obligated to count for himself and see there that he brings in the name of the Beit Yosef that one fulfills if he hears from his fellow and see there that he left this law in a state of "Tzarich Iyun" (needing further study) and in the book Chok Yaakov his opinion is also that one does not fulfill through hearing from his fellow and in the Pri Chadash he debated and his opinion is that after the fact one fulfilled if he heard from his fellow and he brings in the name of the Sifri that the essence of what the Torah warned concerning a counting for each and every one was to exclude the logic that the commandment was only for the Court like in the Jubilee, and the later authorities have already elaborated on this, and see Magen Avraham that counting is in any language and not specifically in the Holy Tongue and if he does not understand the Holy Tongue and counted he did not fulfill, and behold the opinion of most of the early authorities is that counting in this time when there is no Omer is only Rabbinic but the opinion of the Rambam is that it is from the Torah see Ran Pesachim and Kesef Mishneh and Beit Yosef, and women and servants are exempt from this commandment for it is a positive time-bound commandment and see Magen Avraham wrote that nowadays they have made it an obligation upon themselves and this matter needs study and it is a new thing that women if they accepted upon themselves to perform a positive commandment from which they are exempt should become obligated because they made it an obligation upon themselves and I have not seen such in any place and it is not similar to the evening prayer see in the early authorities and here there are opinions that it is forbidden for them to perform positive time-bound commandments and according to all it is not a commandment at all and how shall they make it an obligation and I do not know the source of the words of the Magen Avraham, and what the author wrote at the end of the commandment "and it is practiced" etc. "and now in our great sins" etc. "we count the days and the weeks" it appears that there is a slight lack of language here and it seems that he holds like the opinion of the early authorities who hold counting in this time is Rabbinic and it should say "and now" etc. "even so we count the days and weeks" that is to exclude the opinion of the Rambam who wrote since we count the days and weeks it proves that counting is from the Torah and the author holds like most early authorities that counting is Rabbinic nevertheless we count the days and the weeks see in their words, nevertheless it is slightly difficult that he deviated from the opinion of the Rambam whom he mostly follows after at all events he should have brought the opinion of the Rambam and said that he holds like the logic of most early authorities as is his way in the whole composition, and behold it seems simple according to the positions of the early authorities who hold that if he did not count at night he should count in the day or if he skipped a whole day he should count afterward that he did not lose the commandment there is no difference between if he forgot or intentionally did not count or if he was not obligated to count such as a minor who became an adult during the days of counting or a servant who was liberated in the day nevertheless he is obligated to count for this is not of "completion" to say that if he was not obligated he does not need to complete like in tractate Chagigah regarding a lame person and several other places regarding prayer and Havdalah for this law of counting with all Israel is such that the commandment is that one day is not dependent on its fellow for if it were for the sake of completion he would need to complete and count also the count of yesterday and also if he forgot at night and counts in the day according to this position it is not completion rather the commandment continues and it is like one who went insane at the start of the night of Passover who is exempt from Matzah and afterward became sane in the night certainly he is obligated to eat Matzah for the whole night is the commandment and this is not completion so too here and this is simple, and according to the position of the early authorities who hold if he did not count one day he lost the count and the reason is as the author wrote that they are one commandment and since he did not count one day the calculation was canceled from him it seems also simply that there is no difference between if he did not count because he forgot or intentionally or that he did not count because he was a minor until the middle of the counting or was liberated since he did not count the calculation was canceled from him and this too is simple, but I am in doubt according to this position if the minor even though he is not obligated nevertheless counted in the way of minors or a servant counted before he was liberated also because he is permitted to perform a positive time-bound commandment as explained in many places in the Talmud and in the middle the minor became an adult and the servant was liberated if he is obligated from the Torah to count in his adulthood and his status as a free man in that year do we say that in obligation and exemption the matter depends and since he was exempt even though he counted nevertheless since it is one commandment and previously he was not obligated also now he is not obligated from the Torah and we do not compel him to count like all positive commandments in the Torah or perhaps since he counted even though he was in a state of exemption nevertheless the calculation was not canceled at any rate and he is obligated from here on and we find in the Mordechai regarding the Megillah he brought the logic of Rabbeinu Tuvia of Vienna brought also in Magen Avraham section 189 that one who is obligated Rabbinically fulfills the obligation for one who is from the Torah for one fulfills the sanctification of the day from the "Plag HaMincha" and above see there if so just as one fulfills the sanctification of the Sabbath in a Rabbinic time if so in a minor who became an adult since at any rate he reached the age of education previously certainly the time that he is obligated Rabbinically is effective to be obligated afterward from the Torah and the calculation is not canceled, but regarding a servant and he was liberated I am in doubt if he counted in his servitude if the calculation was canceled since he is not obligated or at any rate since he performed the commandment even in exemption it is effective for afterward that the calculation is not canceled and it needs study, and it seemed to bring a slight proof to this law from the chapter "He who comes upon his sister-in-law" [Yebamot] if he had children in his gentile state and converted since his seed is attributed to him he fulfilled the commandment of procreation even though the performance of the commandment was at a time when he was exempt for children of Noah are not commanded regarding procreation as explained in Sanhedrin nevertheless he fulfilled the commandment placed upon him at the time of obligation since at any rate he has children so too here even though now the obligation from the Torah falls upon him and previously he was exempt nevertheless the commandment that he performed in exemption counts for him now also that the calculation was not canceled and he is obligated from the Torah as it appears to my humble opinion, again I saw in the book Turei Even regarding Rosh Hashanah in that which is explained there "if they forced him and he ate Matzah" etc. if we say that a demon forced him etc. and surely we learned "sometimes healthy and sometimes insane" at the hour he is insane he is like an insane person for all matters and see there that he explained that is since he is like an insane person and an insane person is exempt from commandments the commandment he performed at the time of exemption does not exempt him afterward at the time of obligation since at the hour he performed the commandment he was exempt and the Turei Even asked from Yebamot regarding one who had children in his gentile state etc. he fulfilled procreation even though he performed the commandment at the time of exemption see there that he explained another explanation in the Talmud there and afterward he rejected the other explanation and his conclusion is like this logic and he settled it there from Yebamot see there, and according to him there is no difficulty at all for there is a great distinction between the subjects for certainly eating Matzah and Shofar and the like where the commandment is to eat Matzah and to hear Shofar if so certainly it is logical that the performance of the commandment does not exempt him if he performed at the time of exemption since previously he was not obligated at all and afterward he was obligated from the Torah that he should exempt himself with this but regarding procreation where the commandment is to have children and taking a wife and begetting is the preparation for the commandment for it is impossible to fulfill having children without this and the commandment has no interruption like other commandments rather all the days of his life is the commandment and in every moment he fulfills the commandment and this is the proof for Rabbi Yochanan himself holds there that if he had children and they died he did not fulfill the commandment we see even though he performed the commandment and begot nevertheless since they died the commandment was interrupted if so the essence of the commandment is that he has children therefore even though the preparation of the commandment was in his gentile state nevertheless now that he converted and is obligated in commandments and now he has children he fulfills the commandment because this commandment continues always and he performs the commandment in obligation only the preparation of the commandment he performed in exemption but in Matzah and the like in other commandments where the commandment does not continue rather the commandment is the performance if so after the performance of the commandment the commandment ceased certainly it is not effective what he performed the commandment at the time that he was exempt since now at the time the Torah obligated him he did not perform at all and what does it help what he performed at a time when the Torah did not obligate him at all but in procreation the commandment is not to perform rather only the preparation of the commandment but the essence of the commandment is what he has children and if they died he did not fulfill at all even though he took a wife and begot and the commandment continues if so he performs also now at the time of obligation the commandment therefore he fulfilled because he does not fulfill the commandment on account of his gentile state for also now in his conversion he fulfills like each and every one of Israel for the commandment is the children but in a commandment that depends on performance and now at the time of obligation he did not perform at all certainly he does not fulfill because he did not perform the commandment now and what he performed then he was not obligated at all and after the performance the commandment was interrupted and he is not performing and why should he fulfill with this the obligation of the commandment and see there in Yebamot that Rabbi Yochanan holds that in one who had children in his gentile state he fulfilled and he himself holds that if he had children and they died he did not fulfill the commandment if so since the commandment continues therefore he fulfilled even though he performed at the time of exemption because he fulfills also now at the time of obligation but that which depends on some performance and the commandment is interrupted certainly it is not effective what he performed at the time of exemption, and see there in Turei Even that his words are puzzling where he wrote that Rabbi Yochanan holds that he fulfilled that it is because of "for settlement" etc. even though Rabbi Yochanan disagrees with Rav Huna and holds that if he had children and they died he fulfilled procreation nevertheless here he admits etc. and in truth it is an oversight on the contrary Rabbi Yochanan holds if he had children they died he did not fulfill for "settlement" is required and see in the Talmud there and nevertheless here we can say that it is a continuous commandment even though it is one commandment nevertheless the name of the calculation was not canceled and he is obligated afterward in one who was liberated if he counted previously as it appears to my humble opinion with God's help, and similar to this logic you will find in the Ran chapter two of Beitzah regarding the distinction of the Eruv of cooked foods and between the Eruvs of boundaries and courtyards, and behold a servant is exempt for it is time-bound, and one who is half-servant and half-free man for those who hold that in counting one fulfills the obligation for his fellow if so he needs to hear from a completely free man to fulfill the obligation like Shofar and Megillah for one who is half-servant and half-free man even for himself he does not fulfill the obligation for his side of servitude cannot come and fulfill for his side of freedom and he needs to hear from another, but for the decisors who hold that one does not fulfill the obligation from another because "counting for each one" is required if so he is exempt from counting the Omer since he himself needs to count and his side of servitude does not fulfill for his side of freedom even though the side of freedom is obligated in all commandments nevertheless here what shall he do since the servitude prevents him and so it is written regarding Shofar if there is not another from whom he can hear he does not need to blow for himself for he does not fulfill at all and why should he blow and so in other commandments and it will be explained further with the help of God blessed be He, and it is possible to say that even regarding Shofar specifically if he can hear from another he does not fulfill through himself but if there is no other it is possible that he is obligated to perform the commandment himself because the part of the side of freedom is obligated and it needs study, and see what I wrote later in the commandment of Shofar, and a "Tumtum" (one of hidden gender) and "Androgynous" (hermaphrodite) their law is like in all commandments that the males are obligated and not women, and see Noda B'Yehuda second edition the law of an "Onan" (mourner before burial) on the night of counting his opinion is that he should count and there is room to debate his words, and if he forgot to count until twilight
