מעכ״ת הקשה ע״ד הר״ן פ״ק דפסחים [ג,ב סוף דבור ראשון] ־ הביאו הרב״י [או׳׳ח] סוס״י תל״ד – דאין שליחות בנדר והקדש, מסוגיא דגמרא: ״בעי רמי בר חמא, מקדיש עושה תמורה, או מתכפר עושה תמורה, אמר רבא, א״כ (דמקדיש עושה תמורה ־ פירש״י) מצינו ציבור ושותפין עושין תמורה, כגון דשוו שליח לאקוושי״ (תמורה י,א), הא למדת ומצי שוויה שליח גם בהקדש!

ולא ידעתי מאי קא קשיא ליה, דהא שוו שליח לאקדושי, היינו לקנות או להקדיש משלו קרבן בשבילם, וא״כ הרי יש כאן מעשה, ושפיר הוי שליח, וכמ״ש החתם סופר לתרץ דברי הר״ן מסוגיא דנדרים (לו,א) דמדעת בעלים יכול לאפרושי פסח וחטאת (חתם סופר יו״ד סי שכ״א). ולא עוד אלא אף אם השליח מפריש קרבן משלו, אין האמירה גומרת אלא בהפרשת הקרבן והקדשתו לשם הקרבן שהתחייב המתכפר, וא״כ ההפרשה ודאי היא מעשה, ובכל מקום שיש מעשה, האמירה היא טפל למעשה, ומהניא שליחות גם לאמירה משום המעשה שבה, וכמ״ש החתם סופר ז״ל.
