**בעית המקבילות**. בתלמוד הירושלמי רגילה התופעה, שסוגיות מועברות ממקום למקום בשלמותן וכצורתן, וזאת מחמת שייכותן המלאה או החלקית למקומן המשני. תופעה זו, המצויה בכל ספרות חז"ל, מתעצמת במיוחד בתלמוד הירושלמי. יש בו סוגיות כפולות ואף משולשות, מהן שאבדו בגלגולי ההעתקה ממקומן העיקרי, ומהן שאינן מתפרשות כלל במקומן המשני. העברת הסוגיות נעשתה על ידי העורכים האחרונים.

לתופעה זו חשיבות רבה לתיקון שיבושי נוסח. לעיתים טעה הסופר בגבולות ההעתקה, והתחיל להעתיק מנקודה שלפני תחילת הסוגיה הכפולה, או שהמשיך להעתיק עד נקודה שאחרי סוף הסוגיה (העתקת יתר), או שהתחיל להעתיק מאמצע הסוגיה במקום מתחילתה, או שסיים להעתיק באמצע הסוגיה במקום בסופה (העתקת חסר). פעמים השמיט הסופר את אמצע הסוגיה.

**המקבילות למדרשי ארץ ישראל העתיקים**. ספרות האגדה נקבעה בכתב זמן רב לפני ספרות ההלכה, כבר בימי האמוראים הראשונים ("ספרא דאגדתא"). בבראשית רבה, ויקרא רבה, ופסיקתא דרב כהנא ישנן סוגיות מקבילות בהלכה ובאגדה לתלמוד ירושלמי, מהן קצרות ומהן ארוכות ושלמות, מהן הקבלות מלאות ומדויקות ומהן בשינויי לשון רבים. מכאן, ששני המקורות, התלמוד הירושלמי ומדרשי האגדה, שאבו זה מזה, או ממקור שלישי שקדם לשניהם.

**לשון**. לשון התלמוד הירושלמי היא ארמית גלילית מעורבת בלשון חכמים. יש בה מילים רבות ביוונית ומעט בלטינית. הגרוניות נתערערו בה, וחילופי אחה"ע שכיחים בה. עוד מצויים בה חילופי האותיות השפתיות, חילופי ג"כ וחילופי ס"צ. האל"ף נופלת בראש תיבה. שכיחה הרכבת שתי מילים. צורות אלו משקפות מבטא עממי של הארמית הגלילית ושל לשון חכמים, אלא שבנוסח שלפנינו החליפו לעיתים צורות בבליות את צורות הארמית של ארץ ישראל, על פי רוב מחמת הרגל הסופרים. שמות האמוראים רובם עבריים וחלקם ארמיים, יווניים ורומיים.

**סגנון**. לשון התלמוד הירושלמי קצרה. הבעיות קצרות, ורבות מהן נותרות ללא תשובה. קצב הסוגיות נינוח ורחוק מפלפול. דרכו של התלמוד הירושלמי לתרץ קושיה בדרך פשוטה. יש שאינו מפרש משנה סתומה או משנה שיש בתוכה סתירה, ויש שהוא מקשה על משנה ואינו מתרץ. כשיש קושי בהבנת משנה, אינו פותח בקושיה ומתרץ אותה, אלא אומר את פירושה של המשנה. הרבה פעמים הוא רומז למשנה ואינו מביא אותה כלל, וכן הוא אומר על הלכה שהיא כדעת תנא פלוני ואינו מזכיר כלל את המאמר של אותו תנא. לפעמים הוא מביא את הרישא בלבד וכוונתו להקשות מן הסיפא, ולפעמים הוא מביא את הסיפא והקושיה היא מן הרישא. בהרבה מקומות נאמר ששני אמוראים חולקים, אחד אמר כך ואחר אמר כך, ולא נזכרו שמות האמוראים האלה. משפטים רבים באים בתמיהה. הסגנון בהיר ותמציתי.

שיבושים מיוחדים לתלמוד הירושלמי הם: מאמרים הפוכים, ציוני הלכות שלא במקומן ו"גופים זרים" (קטעים גדולים וקטנים שנשתרבבו בטעות מסיבות שונות. "גופים זרים" הם בדרך כלל שיבושים קדומים, ונוצרו מהעתקה לקויה של מקבילות או משיבוץ קטעים שלא במקומם). יש שנכנסו בתלמוד הירושלמי זה ליד זה שתי צורות של מילים, שני נוסחים של מילים או של משפטים, מילים וביטויים נרדפים, טעות ותיקונה, מילה או ביטוי ופירושם שחדר מן הגיליון ונכנס לפנים (כפלי גרסה).

**התלמוד הירושלמי והתלמוד הבבלי**. בתקופת האמוראים היו אמוראים שהעבירו שמועות וסוגיות בין ארץ ישראל ובבל, כך שתורת שני המרכזים היתה ידועה בשתי הארצות. בתלמוד הירושלמי מימרות של אמוראי בבל שאינן בתלמוד הבבלי, וכן יש בו נוסחאות שונות של שמועות שנמסרו בבבל. חלק מן השמועות ההדדיות שהובאו במפורש בשני התלמודים מצויות בתלמוד ארץ המוצא בלשון אחרת וחלקן סותרות זו לזו. יש גם חילופים בשמות החכמים וכן סתירות בנוסחן של הברייתות ובמימרות האמוראים.

**א) כתב יד ליידן** (סוף המאה ה-13 למניינם) הוא היחיד המכיל את התלמוד הירושלמי בשלמותו. הוא גם כתב היד שממנו ישירות נדפס הירושלמי לראשונה בוונציה (בשנת 1523 למניינם). למעשה כתב יד זה הוא החוליה היחידה כמעט המקשרת בינינו לבין עורכי התלמוד הירושלמי, ומכאן ייחודו וחשיבותו.

סופרו של כתב היד הוא ר' יחיאל ממשפחת הענווים באיטליה. הוא הוסיף תיקונים, השלמות ונוסחאות אחרות על הגיליון ובין השורות. כתב יד זה הגיהו והכינו לדפוס מדפיסי ונציה. הם מחקו, תיקנו, השלימו והוסיפו מאמרים בגיליונות ובין השורות. הרבה מתיקוניהם אינם אלא שיבושים. את הנוסח הנכון שיירו בכתבי היד, כך שאפשר ללמוד הרבה ממנו. רובם המכריע של דפוסי התלמוד הירושלמי בנויים על דפוס ונציה. שיבושים גדולים וקטנים חלו בירושלמי גם לאורך כל תקופת הדפוס, למן הדפוס הראשון שנדפס ישירות מכתב יד ליידן המוגה.

נוסח הירושלמי הלך והשתבש במהלך מסירתו, למן הימים שהוא יצא מידי עורכיו. אין אנו יודעים כמה גלגולי העתקה עבר נוסח הירושלמי עד להעתקתו בידי סופר כתב יד ליידן. כל העתקה הוסיפה שיבושים משלה.

בעית הנוסח המשובש, בנוסף לבעיות המינוח והלשון, הן הגורמים להזנחת הירושלמי לאורך כל הדורות, למן ימי הראשונים ועד לימינו. מפרשי הירושלמי וחוקריו חיפשו מאז ומתמיד דרכים לתיקון נוסחו, ובעיקר על ידי כתבי יד, אך הם לא מצאו שום כתב יד שיכול היה לפתור את בעיות הנוסח. לומדי הירושלמי ומפרשיו לא ידעו על קיומו של כתב היד שהיה מונח בליידן שבהולנד. על קיומו של כתב היד נודע באמצע המאה ה-19 למניינם, אך התעלמו לחלוטין ממנו ולא נסתייעו בו. רק כעבור כ-70 שנה נודעה חשיבותו הגדולה של כתב היד לתיקון נוסח הירושלמי.

סופר כתב יד ליידן העתיק מכתב יד משובש מאוד, ונאלץ לתקן ולהגיה אותו. הגהותיו ותיקוניו של הסופר נעשו בין השורות ועל הגיליונות. יש להניח שגם בהעתקה עצמה נפלו שגיאות ושינויים בלתי מכוונים, כדרך כל העתקה.

בכתב יד ליידן נוספו משניות, פסקאות וחלוקות להלכות, בעוד שבנוסח המקורי של הירושלמי לא היו כל אלה, אלא הכל היה עשוי כחטיבה אחת רצופה של התלמוד, ללא משניות וללא פסקאות. בראש כל פרק של תלמוד בא פרק שלם של משנה ולאחריו נוסח התלמוד. בתוך פרק התלמוד חוזרות פסקות קצרות מן המשנה ואחריהן סוגיות התלמוד. סימון חלוקת ההלכות אינו אחיד. כתב היד מפוסק על ידי נקודה.

כתב היד המקורי כפי שהוא יצא מידי הסופר הוא משובש, ומצויות בו השמטות גדולות וקטנות רבות. יש בכתב היד קטעים שלמים שלא במקומם ושיבושי סופרים רגילים. הסופר גם שיבש את הלשון וצורות הכתיב הארץ ישראליות. במשך הזמן נוספו בכתב היד הגהות ותיקונים מרובים בידי כמה מגיהים, ששיפרו את נוסחו המשובש של כתב היד. המגיהים השלימו חלק גדול מההשמטות שהיו בכתב היד המקורי ותיקנו שיבושים מרובים שהיו בו. ההגהות העיקריות נעשו לצורך התקנת כתב היד לקראת הדפסתו בוונציה. הרבה מהגהותיהם נעשו על סמך כתבי יד אחרים. אין ספק שהמגיהים שיבשו לא מעט. מרובים השיבושים של המגיהים בלשון הירושלמי, בסגנונו, במונחיו ובכתיבו המיוחד. הם הותירו חסרונות ושיבושים מרובים. לא תמיד הוסיפו את השלמותיהם במקום הנכון, לעיתים לא השלימו די הצורך, ולעיתים השלימו קטעים שחשבו בטעות שהם חסרונות.

גם לאחר כל ההשלמות המרובות שנעשו בכתב היד בידי המגיהים, עדיין רבות ההשמטות בנוסח הירושלמי. כמו כן מרובים בכתב היד הייתורים, החילופים והסירוסים במשפטים שלמים ובחלקי משפטים, ו"גופים זרים" שהשתרבבו. מרובות גם טעויות ההעתקה הרגילות בכל הספרים. בשל השפעת התלמוד הבבלי, כתב יד ליידן שונה מהנוסח המקורי של הירושלמי בכל תחומי הלשון: באוצר המילים, בצורות דקדוקיות, בכתיב, בסגנון ובמינוח. מרובים השיבושים גם בשמות החכמים ובדרך מסירת מאמריהם. למרות כל חסרונותיו, ניתן לתקן את נוסחו על פי כתבי יד נוספים, מקבילות, מובאות הראשונים והכרה טובה של לשונו, סגנונו ומונחיו של התלמוד הירושלמי, וכך להעמיד את הנוסח המקורי של התלמוד הירושלמי.

**ג) "שרידי הירושלמי"** הוא אוסף גדול של קטעי התלמוד הירושלמי, ששרדו בגניזה. קטעי הגניזה הקדומים ביותר הם כנראה מן המאה ה-9 למניינם. חשיבותם של קטעי הגניזה בכך, ששמרו על צורתו המקורית של התלמוד הירושלמי, על כתיבו ועל גרסאות משובחות לרוב.

ונכתב שם בהערה: יעוין בספר "תוספות אהרן" מהגר"א מפינסק בחידושי מסכת ראש השנה שהביא תשובה זו וביאר על פי אומרם: "במחשכים הושיבני" (איכה ג,ו) - זה תלמודה של בבל (בבלי סנהדרין כד,א), ו"לישרים" אותיות "יר(ו)שלמי", ורצונו לומר שיש לפרש סוגית הבבלי על פי דברי הירושלמי שם.
