▪ בזמן האחרון עורכים בצבא סדרות חינוך בנושא זה, וכל חייל נשאל: במידה ותקבל פקודה לפנות ישוב, האם תמלא אחר הוראות הפקודה או לא? ומאחר וחיילים רבים עונים שלא יבצעו את הפקודה, נציגי חיל חינוך מסבירים להם שזו חובה דמוקרטית וכו', ואף מאיימים ומודיעים שיש עונשים חמורים לסירוב פקודה. וחיילים רבים שואלים האם הם יכולים להסתיר את דעתם ממפקדיהם כדי שלא להגיע לעימות עמם, דבר שעלול להתנקם בהם, באפשרויות הקידום לקצונה.

נ"ב אגב שאלה זו, אפנה בשאלה שמטרידה כיום רבים ביחס לדעת הרב בנושא הגולן. כי כפי שהבנתי הרב מייחס גם לגולן ערך של ישוב הארץ אלא שמדרגתו נמוכה יותר, אלא שמאחר שהרב צפה שממשלת ישראל לא תוכל לעמוד בלחץ הבינלאומי, וודאי תיסוג מחלקים בארץ, ולכן התיר הרב לסגת מהגולן כדי לשמור על עיקר הארץ המקודשת – יהודה ושומרון. משום שאם מצב המלחמה עם סוריה יסתיים, לא יהיה יותר לחץ ממשי על ישראל לוותר על יש"ע. והשאלה האם גם כיום, לאחר שהממשלה הסכימה להיכנס לתהליך שעיקרו וויתור על יש"ע, יש מקום להתיר נסיגה מהגולן.

א. ברור כי לפי ההלכה חייל שמקבל פקודה הנוגדת את חוקי התורה, עליו לקיים את ההלכה של התורה ולא את הפקודה החילונית. קל וחומר ממלך, שדרשו חז"ל במס' סנהדרין מ"ט, א', את המקרא (יהושע א, יח): "כָּל אִישׁ אֲשֶׁר יַמְרֶה אֶת פִּיךָ וְלֹא יִשְׁמַע אֶת דְּבָרֶיךָ לְכֹל אֲשֶׁר תְּצַוֶּנּוּ יוּמָת", יכול אפילו לדברי תורה? תלמוד לומר: "רַק חֲזַק וֶאֱמָץ". ופירש רש"י: "רקין – מיעוטין. שאם בא המלך לבטל דברי תורה, אין שומעין לו". וכך פסק הרמב"ם בהלכות מלכים (ג, ט): "המבטל גזירת המלך בשביל שנתעסק במצוות, אפילו במצווה קלה, הרי זה פטור, דברי הרב ודברי העבד, דברי הרב קודמין. ואין צריך לומר אם גזר המלך לבטל מצווה שאין שומעין לו". על אחת כמה וכמה שאין לציית לפקודה צבאית הנוגדת את מצוות התורה, והרי ברור שמצוות ישוב ארץ ישראל היא חמורה, מפני שהיא שקולה כנגד כל המצוות שבתורה, כמו ששנינו בתוספתא עבודה זרה (פ"ד ה"ג), וכן שנינו בספרי דבי רב פרשת ראה (פיסקה פ'), הדורש את הפסוק "וִירִשְׁתֶּם אֹתָהּ וִישַׁבְתֶּם בָּהּ", אמרו: ישיבת ארץ ישראל שקולה כנגד כל המצוות שבתורה. ברור איפוא שפקודה מהצבא, המפירה את המצווה החמורה הזאת, אין לה תוקף. מה אם מצווה דוחה את פקודותיו של המלך, על אחת כמה וכמה שהיא דוחה פקודות של הצבא.

מכאן תשובה לספקותיך שכתבת "או שמא מאחר שהממשלה שנבחרה באופן דמוקרטי הטילה עליו לפנות ישוב יהודי, שמא עליו לבצע את הפקודה". הרי גם המלך נבחר בישראל בצורה דמוקרטית ועל פי נביא, אף על פי כן אין כח בפקודת המלך לדחות קיום מצווה כנ"ל, למרות שמעמדו של המלך עולה על מעמד של כל ממשלה חילונית בישראל. בודאי שאין בסמכותה להכריח חייל לעבור על מצוות התורה.⁹

בנידון דידן לא רק מצוות ישוב ארץ ישראל עומדת בפני הפקודה הצבאית אלא גם איסור "לא תחנם" שדרשו חז"ל במס' עבודה זרה כ', א': לא תתן להם (לגוים) חניה בקרקע. וכן פסק הרמב"ם בפרק י' מהלכות עבודת כוכבים הלכה ד', שאסור למכור לנכרים קרקע בארץ ישראל, כמו שכתב שם הרמב"ם: "ומפני מה אין מוכרין להם, שנאמר: ולא תחנם, לא תתן להם חנייה בקרקע, שאם לא יהיה להם קרקע – ישיבתם ישיבת עראי היא". וכאן הרי (פקודת) פינוי הישובים מיהודה ושומרון היא כדי להסגיר את האדמה של הישובים לערבים, שהיא עבירה כפולה ומכופלת, בודאי שאין לכפות על חייל לעבור כמה עבירות חמורות של התורה.

תשובה שניה נוספת לשאלתך היא, כי הממשלה הזאת אינה נשענת על רוב יהודי, אלא על קולות של הערבים, ומבחינת ההלכה אין לה תוקף של רוב, לכן הוראות הממשלה לפנות את הישובים היהודים אין לה שום תוקף וסמכות של רוב העם. אי לזאת, ברור שהחיילים צריכים לסרב לפקודות לפנות ישובים יהודים בארץ ישראל הסותרות את מצוות התורה, ועל זה אמרו חז"ל: "דברי הרב ודברי התלמיד דברי הרב שומעין".

בנוסף לכך, הרי מקרא מפורש הוא בתורה (במדבר לג, נא-נה): "כִּי אַתֶּם עֹבְרִים אֶת הַיַּרְדֵּן אֶל אֶרֶץ כְּנָעַן. וְהוֹרַשְׁתֶּם אֶת כָּל יֹשְׁבֵי הָאָרֶץ מִפְּנֵיכֶם… וְהוֹרַשְׁתֶּם אֶת הָאָרֶץ וִישַׁבְתֶּם בָּהּ כִּי לָכֶם נָתַתִּי אֶת הָאָרֶץ לָרֶשֶׁת אֹתָהּ… וְאִם לֹא תוֹרִישׁוּ אֶת יֹשְׁבֵי הָאָרֶץ מִפְּנֵיכֶם וְהָיָה אֲשֶׁר תּוֹתִירוּ מֵהֶם לְשִׂכִּים בְּעֵינֵיכֶם וְלִצְנִינִם בְּצִדֵּיכֶם וְצָרֲרוּ אֶתְכֶם עַל הָאָרֶץ אֲשֶׁר אַתֶּם יֹשְׁבִים בָּהּ". על אחת כמה וכמה שאסור לנו באיסור חמור ביותר לפנות ישובים יהודים שבנו אותם בעמלם ויושבים בהם יהודים, כדי להסגיר אותם לערבים, שאין להם חלק ונחלה בארץ הזאת.

**כיצד יענו חיילים לשואליהם**

באשר לשאלה ב' איך יענו החיילים שנשאלים בסדרות חינוך, אם יבצעו את הפקודות לפנות ישובים יהודים, תשובתי היא שעליהם לשתוק ולא לענות על שאלות אלו, כי אסור להם לשקר ולומר שהם יצייתו לפקודה, כי "מדבר שקר תרחק", ולענות שהם יפרו את הפקודה גם כן אינם צריכים, כדי לא לעורר נגדם שנאה, לכן מוטב שישתקו ולא יענו עליה כלל, ויקיימו את מאמר חז"ל: "מלה בסלע שתיקה בשני סלעים".¹⁰

¹⁰ . עלי לספר כאן, כי בתחילה רצה הרב גורן להשיב, כי החיילים חייבים לומר שלא יקיימו את הפקודה, וכך גם התבטא בעל פה בתקשורת. ובשיחה בישיבה הביא לכך ראיה (אולי מים של שלמה, ב"ק פ"ד אות ט): "… דאסור לשנות דברי תורה אף כי הסכנה, וחייב למסור עצמו עליה"). והתווכחתי שאם לא יענו דבר, מה איסור יעברו. והוספתי להפציר בו להקל בזה עבור הקצינים או החיילים הרוצים להתקדם בצבא, ובדוחק נעתר להסכים שאינם חייבים לומר את האמת, ובלבד שלא יאמרו שיצייתו לפקודה, וכך כתב בתשובתו. אולם ברור שחייל שהיה אומר באומץ שיסרב היה זוכה לכבוד רב מאת הרב גורן.

מדברי הרצי"ה קוק זצ"ל (סעיף ג' מכרוז שנכתב בי"ד באלול תשכ"ז, מובא בארץ הצבי עמ' יט): "אין שום צד היתר, לאיסור תורה זה של מסירת נפש קרקעותינו לגויים, ח"ו, לצמיתות ובהחלט, ולפיכך החיוב מוטל על כל אדם מישראל, ועל כל גדול תורה מישראל, ועל כל איש צבא בישראל, למנוע ולעכב את זה בכל אומץ ועוז, ומן השמים יסייעונו".
