**שֶׁלֹּא לִבְנוֹת עִיר הַנִּדַּחַת** – שֶׁלֹּא לִבְנוֹת עִיר הַנִּדַּחַת לְעוֹלָם, וְעַל זֶה נֶאֱמַר (דברים יג יז) וְהָיְתָה תֵּל עוֹלָם לֹא תִבָּנֶה עוֹד.

**To not rebuild an enticed city:** To not ever rebuild an enticed city. And about this is it stated (Deuteronomy 13:17), “and it shall be an everlasting mound; you shall not build it again.”

מִדִּינֵי הַמִּצְוָה. מָה שֶׁאָמְרוּ זִכְרוֹנָם לִבְרָכָה (סנהדרין קיא, ב) בְּפֵרוּשׁ לֹא תִבָּנֶה, שֶׁאֵין בּוֹנִין אוֹתָהּ לַעֲשׂוֹתָהּ מְדִינָה, דְּהַיְנוּ בָּתִּים כְּמוֹ שֶׁהָיְתָה, אֲבָל מֻתָּר לַעֲשׂוֹתָהּ גַּנּוֹת וּפַרְדֵּסִים. וְיֶתֶר פְּרָטֶיהָ, מְבֹאָרִים בְּפֶרֶק עֲשִׂירִי מִסַּנְהֶדְרִין. וְאִסּוּר זֶה נוֹהֵג בִּזְכָרִים וּנְקֵבוֹת בִּזְמַן שֶׁדִּין עִיר הַנִּדַּחַת נוֹהֵג, וְהוּא בִּזְמַן שֶׁיִּשְׂרָאֵל עַל אַדְמָתָן וְסַנְהֶדְרִין יוֹשְׁבִין בִּמְקוֹמָן, כְּמוֹ שֶׁכָּתַבְתִּי לְמַעְלָה (מצוה תסד).

From the laws of the commandment — that which they, may their memory be blessed, said (Sanhedrin 111b) about the understanding of “you shall not build,” that we do not build it to make it a city, meaning houses like it was, but it is permitted to make it into gardens and orchards; and the rest of its details — are elucidated in the tenth chapter of Sanhedrin. And this prohibition is practiced by males and females at the time that the law of an enticed city is practiced — and that is at the time that Israel is on their Land and the Sanhedrin is sitting in its place, as I have written above (Sefer HaChinukh 464).
