**דיני השאלה והשכרה לעכו"ם בשבת. ובו ה סעיפים:**
מותר להשאיל ולהשכיר כליו לעכו"ם ואע"פ שהוא עושה בהם מלאכה בשבת מפני שאין אנו מצווים על שביתת כלים וי"א דכלים שעושין בהם מלאכה כגון מחרישה וכיוצא בה אסור להשכיר לעכו"ם בע"ש וביום הה' מות' להשכיר לו ובלבד שלא יטול שכר שבת אלא בהבלעה כגון שישכיר לו לחדש או לשבוע ולהשאיל לו מותר אפי' בערב שבת: הגה וכן עיקר כסברא האחרונה ומותר להשאיל לו בערב שבת (טור וסמ"ג וסמ"ק ותו' פ"ק דשבת) אע"ג שמתנה שהעכו"ם יחזור וישאיל לו לא אמרינן בכי האי גוונא דהוי כשכירות (הגהת מיי' פ"ז):

**Mishna Berura Yomi:**
It’s permissible to lend or to rent tools to a non-Jew, even though he would do work with them on Shabbat because we’re not commanded about Shabbat for our vessels. Some say that tools that one does work with, such as a plow, etc., it is forbidden to rent to a non-Jew on Friday. And on Thursday it is permissible to rent to him as long as you don’t take Shabbat rent explicitly, rather it is subsumed by the rest. For example, you rent to him for a month or a week. Lending to him is permissible even on Friday. Rema: And so the main point is like the last reasoning and it’s permissible to lend to him on Friday (Tur; Sma"g; Sma"k; Tosefos) even though it is stipulated that the non-Jew will return and lend to him, we don’t say things like this are considered profits. אסור להשאיל שום כלי לעכו"ם בשבת ואפילו בערב שבת אם הוא סמוך לחשיכה כל שאין שהות להוציאו מפתח ביתו של המשאיל קודם חשיכה מפני שהרואה סבור שישראל צוהו להוציאו:

**Mishna Berura Yomi:**
It is forbidden to lend any tool to a non-Jew on Shabbat, even Friday if it’s close to nightfall. All so that he doesn’t wait to take out from the opening of the lender’s house before nightfall because those who see will think that the Jew commanded him to take it out.

אסור להשכיר או להשאיל בהמתו לעכו"ם כדי שיעשה בה מלאכה בשבת שאדם מצווה על שביתת בהמתו: הגה אבל יכול להשכירה או להשאילה ולהתנו' שיחזירנו לו קודם השבת אבל לא מהני אם מתנה עם העכו"ם שתנוח בשבת כי אין העכו"ם נאמן על כך. [סמ"ג וסה"ת ומרדכי פ"ק דשבת] ואם השאילה או השכירה לעכו"ם והתנה עמו להחזירה לו קוד' השבת ועיכבה בשבת יפקירנה בינו לבין עצמו קודם השבת או יאמ' בהמתי קנויה לעכו"ם כדי שינצל מאיסורא דאורייתא: הגה ואם רוצה יכול להפקירה לפני ג' בני אדם כדין שאר הפקר ואפי' הכי אין שום אדם יכול לזכות בה דודאי אין כוונתו רק כדי להפקיע מעליו איסור שבת (טור) ודוקא בשבת אבל ביום טוב אין אדם מצווה על שביתת בהמתו ביום טוב. **Mishna Berura Yomi:**
It is forbidden to rent or lend his animal to a non-Jew such that he will do work with it on Shabbat because people are commanded regarding the Shabbat of their animals. Rema: But he is able to rent or lend and stipulate that he will return it to him before Shabbat. But it doesn’t help if he stipulated with the non-Jew that he will rest it on Shabbat because non-Jews aren’t believed about this. [Sma"g; Mordechai] And if he lent or rented to a non-Jew and stipulated with him to return it before Shabbat, and he delayed on Shabbat and he should make it ownerless between himself and him before Shabbat or he says, “my animal is acquired to the non-Jew” in order that he will be saved from the Torah prohibition. Rema: If he wants he can make it ownerless in front of 3 people like the other laws of ownerlessness and even if there is no one who acquires the animal, that certainly isn’t his intention, only that he remove the prohibition of Shabbat (Tur). And this is specifically for Shabbat, but regarding holidays, people are not commanded regarding the Shabbat of their animals on holidays. (Beis Yosef, in the name of Shibulei HaLeket).

ישראל שהשכיר שוורים לעכו"ם לחרוש בהם וחורש בהם יש מתירים אם קבל עליו העכו"ם אחריות מיתה וגזילה וגניבה ויוקרא וזולא וי"א דכיון שאין העכו"ם יכול למכר' אם ירצה נקראת בהמת ישראל [ועיין למטה בסי' זה]:

**Mishna Berura Yomi:**
A Jew that rents out oxen to a non-Jew to plow with them: many permit it if the non-Jew accepted responsibility in case the animal dies, is stolen, etc. and some say that since the non-Jew cannot sell it, if he wants he can say the animal belongs to a Jew. [See below in this Siman]

אם ישראל ועכו"ם שותפין בבהמה מות' לעשות בה עכו"ם מלאכה בשבת ע"י שיתנה עם העכו"ם בתחלה כשקנו אות' שיטול העכו"ם בשבת וישראל ביום חול ואם לא התנו מתחלה אסור אע"פ שהתנו אחר כך ואם ילוה אותה לעכו"ם בהלואה גמורה שיהא רשות בידו להוציאה אם ירצה שלא ברשות ישראל ויזקוף הדמי' על העכו"ם ואחריות השוורים על העכו"ם מותר ויש מתירים אפי' לא יהא רשות ביד העכו"ם להוציאם על ידי שיזקוף הדמים על העכו"ם במלוה ויחזור העכ"ם ויעשם אפותיקי (פירוש אפו תהא קאי כלומר לא יהיה לך פרעון אלא מזה) לישראל או יהרהנם [פירוש משכון בלשון ישמעאל רהן) אצלו ובלבד שלא יאמר לו מעכשיו ויש מתירים על ידי שיזהיר ישראל את העכו"ם שלא יעשה בה מלאכ' בשבת ואם יעבור ויעשה תהיה אחריות עליו אפילו מהאונסים ויכתוב כן בערכאותיהם דהשתא אם בא לעשות בו מלאכה בשבת אינה בהמת ישראל שהרי קנא' העכו"ם להתחייב באונסיה: הגה וכל צדדי היתרים אלו הלכתא נינהו ויכול לעשות איזה מהן שירצה ואפי' אם הבהמה כולה של ישראל דינו כאלו היתה בשותפות העכו"ם רק שיפרסם שעשה דרך היתר:

If a Jew and a Non-Jew are partners in an animal, the Non-Jew may use it for work on Shabbat if it was established with the non-Jew at the beginning, when it was bought, that the non-Jew will assume control of it on Shabbat and the Jew will have control of it during the weekdays. If they did not stipulate to this at the beginning, it is forbidden, even though they may have stipulated to this afterwards....
