**תשע חנויות כו'.**כתב הרא"ה בס' בדק הבית דף ק"ך סוף ע"א דה"ה אם היו בעיר עשר חנויות מוחזקות לנו כולן בבשר שחוטה ולקח מאחת מהן ואינו יודע מאיזו היא ואח"כ נתברר לנו שא' מחנויות אלו בשר נבילה דאסור דלא דמי לפירש שאין תולדות הספק מצד עצמה אלא מצד ברירת החנויות שנתברר עכשיו שא' מהן אסורה ומתוך כך נולד בה ספק על אותה שעה שהיה פירשה בידי הלוקח מהן ואם כן ספק זה אינו מחודש אלא גילוי מילתא בעלמא הוא שתחלתה היה נעלם ממנו שהיה סבור שכולן מותרות וכשנתברר שהיא אסורה איגלאי מילתא למפרע שבשעת מקח חתיכה זו כשפירשה מהן באותה שעה היה ספק שלה וזה ברור עכ"ל ואף הרשב"א במשמרת הבית שם מודה לו בזה אלא שמחלק שם וביאר דבריו שבתורת הבית שהעתיקם המחבר בס"ה דדוקא כשנולד ספק טרפה במקולין כגון שנתערב טרפה בין הכשרות בחה"ל או אפילו ודאי טרפה ולא נודע אלא עד אחר שלקח ויש ספק אם היתה הודאי טרפה במקולין זו שלקח אבל מ"מ יודע הוא מאיזה מקולין לקח נמצא אין הספק מצד ברירת החנויות אלא שאינו יודע אם לקח מן הכשרה או מן הטריפה וא"כ כיון שלקח קודם שנמצאת הטריפה לא אזלינן בתר האי שעתא אלא בתר השתא דהוי פירש ממילא ושרי כן הוא דעת הרשב"א במשמרת הבית שם ע"ש ודוק אבל הר"ן כתב בפג"ה אקבוע דט' חנויות וז"ל וכתבו התוס' דלא מיקרי קבוע אלא כשהיה האיסור נודע קודם שלקח אבל אם לא נודע האיסור בשעה שלקח אע"פ שלאחר שלקח נתגלה האיסור ונעשה קבוע לא אמרינן דלהוי קבוע למפרע ונ"מ למי שלקח בשר מן המקולין ואח"כ נודע שהיתה טרפה ביניהם דשרי דכיון דבשעה שלקח לא היה קבוע דדין קבוע שיהא כמחצה על מחצה חידוש הוא ואין לך בו אלא משעת חידושו ואילך כלומר משנעשה קבוע אבל למפרע לא עכ"ל וכן לפי מה שפירשו הב"ח והאחרונים דברי הטור דס"ל אם ידוע שיש טרפה בחנות אחת ולא נודע באיזה מהן ולקח מא' מהן וידוע מאיזה מהן לקח) ה"ל קבוע כיון דאין תערובות בחתיכות אלא כל חתיכה עומדת בפ"ע והתערובות הוא בחנות א"כ מוכח דס"ל להטור כהר"ן דהא כתב ע"ז וכ"כ א"א הרא"ש ז"ל דכל מה שלקחו קודם ספיקא הכל מותר ולאחר שנולד הספק הכל אסור עכ"ל אבל באמת לא משמע כן בתשובת הרא"ש כלל ך' סימן י"ז דמיירי התם להדיא בנתערבו החתיכות זו בתוך זו דאע"פ שהן חה"ל שרי כשלקחו קודם ספיקא מטעמא דלא גזרינן שמא יקח מן הקבוע מאחר שאז היו כולן בחזקת היתר ועדיף טפי מפירש ממילא אבל לא בספיקא דחניות וגם דברי הטור לכאורה לא משמע כן וגם הב"י הבינם דמיירי בתערובות דחתיכות וכ"כ בדרישה סי"ט בשם הב"י ע"ש:

**The one found, etc.**Specifically here, in the first shop the matter is evident by itself. But where it is known that there is one treifah in a shop and it is not known in which shop, even though the status is kavua (fixed) as written in subsection 14, nevertheless if he explained it as “not in our presence” it appears that the Rash (Rosh) and his school would forbid, as stated later in subsection 35 regarding a kavua that he explained as “mimla” (i.e., not in our presence), even though anyone who separates more is treated as a decree because perhaps he will take from the fixed source. Others distinguish between four and nine shops, since in that case the prohibition is known to be in one of them as neveilah or as kosher, and therefore there is no concern that he will take from the fixed source. Here, since the prohibition is not known, there is likewise a concern that he might take from the fixed source. This is also implied in the Bach at paragraph 6 regarding the Rosh’s statement. But the Rosh’s position is stated there as a general rule that we do not rely on a rabbinic decree forbidding lest one take from the fixed source before the doubt arose, as long as they stand under the presumption of permissibility, etc. All this was written with respect to the case where the prohibition in fact stands de jure as fixed, but the place of the fixed prohibition is not known. **And since the first doubt is from the Torah, etc.** Indeed, if it were forbidden because of a mixture, it would not be permitted [even] if it were subsequently mixed into [another] mixture, as [discussed] below in Section 8. Rather, it comes to exclude [the case where] if it were a doubt of an item forbidden by Rabbinic law, it would be permitted in a mixture, as [discussed] below in Subparagraph 53. Alternatively, it teaches us so that you should not say that it is even worse than a mixture because Kavuah (a fixed source) is a novelty; it teaches us that since the first doubt is forbidden by the Torah, we do not say this. And I required all of this [explanation] for the Rav [Rama] in the Gloss, who holds below in Section 8 that the second mixture is forbidden to be eaten even if one does not eat it all at once. However, regarding the Issur V'Heter itself, it works out well, for I wrote below in Subparagraph 54 in his name that in two [stages of] mixtures, the second mixture is permitted when one does not eat them all at once. If so, it informs us here that it is worse than a mixture and is like a doubtful Treifah that was mixed in, as [discussed] below in Section 9, and the mixture is forbidden even if one does not eat it all at once. **But to take from here onward.** The Bach wrote at the end of paragraph 6 that this refers specifically to pieces that were mixed into one another. But if the shop in which the prohibition is fixed is not known — for example, when a treif lung is found and it is not known from which shop it came — we follow the Rosh and our master (that is, according to the way he explained the words of the Rosh and the Tur there, although this is not necessarily so, as I wrote in subparagraph 14) that by law all the pieces in the butcheries are forbidden, even if they are not ‘pieces fit for guests’ (ChaHaL). And it is possible that the Rashba likewise does not disagree about this, since he did not state anything there and did not comment on it. End of quote. **Once the mixtures became known, they are forbidden.** But before the mixtures were known they are permitted — even according to those who explain it as ‘mimla.’ This is possible according to the Rosh and the Tur, and the Maharshal agreed (ch. 35, sec. 21) and so rule the later authorities, and not like the Rashba and the Beit Yosef. The Rosh wrote in a responsum that the reason it is forbidden (when known) according to his explanation of ‘mimla’ is because of concern that one might take by hand from the fixed source; such a decree is not established except where they already stand under a presumption of prohibition. But before the doubt arose, it is not appropriate to enact a decree, since they all stand under a presumption of permissibility. What do you mean ‘lest he take’ after the doubt arose? Such a decree is not established in the Talmud. Furthermore, in this case one cannot argue that because he may have taken while it was under the presumption of permissibility, therefore he should be prevented from taking after they were forbidden.

**Permitted.** The Rosh and many poskim ruled that according to the explanation “mimla” (i.e., “not in our presence”) it is forbidden in the case of four to ten shops, because there the prohibition is evident on its face and we do not fear that one will take from the fixed source. This is not the case here, where everything is mixed together. Likewise the Mahari in his gloss to Siman 44 writes that this is the customary practice, and Ranash cites it in his commentary; similarly the Maharshal (P"g" §85 siman 23) and likewise in Avuh generally §26 law 11. Also the rabbi in Torat Ḥaṭat at the head of the general rules (§43) wrote that it is good to be stringent, and in the sections there he states simply “forbidden.” So too in the work Afi Rebbe Rebbe at the beginning (folio 51) — it appears proper to be stringent. The Bach in §11 raised an objection to the author and his view is to distinguish between animals and other valuable items: with animals, since it is possible by confining them that movable ones are permitted according to the explanation “mimla”, whereas with other valuable items they are forbidden. He sought to derive this from the words of the Rashba and elaborated at length; I did not follow him through all his arguments, but there is no real disagreement as implied by the words of the poskim.

There are those who say that a davar she‑yesh lo matirin, etc. This implies that even the third mixture is forbidden when it is a davar she‑yesh lo matirin. And so it appears in the Or Zarua HaGadol, Klal 27, end of din 9. And in the Mordechai, end of Perek Kol HaTzelamim, it also says that one may not permit a davar she‑yesh lo matirin through a safek‑safeka, and there it is speaking about two mixtures — and it implies that the same applies to three mixtures, for it is the same reasoning. For it is implied from his words there that although in general two mixtures are permitted, in the case of davar she‑yesh lo matirin it is forbidden, since it has another way to become permitted; therefore the same applies to three mixtures. And so it is written in the marginal notes to the Or Zarua HaGadol there, end of din 1, that since a davar she‑yesh lo matirin is not permitted through a safek‑safeka, there is no difference between two mixtures and three. However, it is difficult, for in Orach Chaim 497:4 the Rav (the Rema) rules simply like the Mechaber, that a doubtful case of mukhan on the second day of Yom Tov is permitted because it is a safek‑safeka — even though it is a davar she‑yesh lo matirin. And this is based on the Ran, who writes at the beginning of Beitzah that a safek‑safeka is permitted even in a davar she‑yesh lo matirin. And one can say that that case is different, as the Ran himself writes there: since we observe the second day of Yom Tov only because of the custom of our ancestors, we do not act more stringently than they did; and just as for them it was a doubt, for us too it is a doubt, and therefore it becomes a safek‑safeka. And therefore, although in general one should be stringent, nevertheless the second day of Yom Tov — which is only a custom — they established according to the lenient law. Alternatively, one can say that the second day of Yom Tov is considered a case of tzorekh (need), and that is primary, as the Rosh writes in a responsum, Klal 2, end of din 1: ‘And what they wrote in the name of our teacher (i.e., Maharam of Rothenburg), that a davar she‑yesh lo matirin is forbidden even with a safek‑safeka — that is only in mixtures. For although in general a safek‑safeka is permitted, in a davar she‑yesh lo matirin the Sages were stringent that it is not nullified even in a thousand, even with a safek‑safeka, for what difference does it make to permit it through nullification when it has another way to become permitted? But a safek‑safeka such as this — regarding grain — where I say that it is old, and if you say it is new, perhaps it took root before the Omer, and there is no prohibition of chadash at all — in such a case we do not forbid a safek‑safeka in a davar she‑yesh lo matirin.’ End quote. And the case of mukhan on the second day of Yom Tov is exactly like the case of chadash. And although the Rav in Taz, end of Klal 74, brings the words of the Ran and writes that the Or Zarua HaGadol in Klal 26 writes that the custom is to forbid a safek‑safeka even in a davar she‑yesh lo matirin — that is because the Or Zarua there forbids explicitly even a complete safek‑safeka. But nevertheless, it is possible that the Rav’s intention here in the gloss is to distinguish like the Rosh, as explained. And now it is understandable why the Rav writes later in Siman 293 that ordinary grain is permitted because of a safek‑safeka — and that is based on the Rosh cited above. However, even without this, one can say that in that case it is certainly for a need.

One may not permit on the basis of a safek‑safeka. And according to this, it seems that certainly one may not permit a davar she‑yesh lo matirin when one of the pieces fell into the sea. And what the Mechaber wrote earlier in §7 — that even a davar she‑yesh lo matirin becomes permitted when one of the pieces fell into the sea — that is only because he brought in his Beit Yosef the opinion of the Rashba, and the Rashba indeed writes that even in two mixtures, a davar she‑yesh lo matirin is permitted. If so, the Mechaber’s view here is that even a davar she‑yesh lo matirin is permitted. (And likewise the Taz copied the Mechaber’s words in §7 and omitted the words of the Rema here — which shows that he held that since one piece fell away, it is permitted, and all the more so in three mixtures. Nevertheless, he did not understand correctly, for he should have written the Rema’s reasoning to be stringent even when a piece fell away. And all this caused him not to know from where the Rema derived his words. And I already brought in the previous se’if‑katan the great poskim who hold this way.) But the Rema — who forbids in the case of three mixtures when it is a davar she‑yesh lo matirin — certainly forbids when one of the pieces fell into the sea. This is obvious. **Since the first doubt was in the object itself, etc.** Meaning: this is why it is not comparable to the case of two mixtures, where the second mixture is permitted because of a safek‑safeka, as I wrote in se’if‑katan 49 — for there, the first doubt was not in the object itself, but only in the mixture. This is unlike the case here, where the first doubt was in the object itself. 
So write the Tur, the Rashba, and the other poskim. But it is difficult: The Tur, the Rashba, and the poskim needed this distinction only according to their own view — that the second mixture is permitted. But the Mechaber, who holds in se’if 8 that the second mixture is forbidden — then even if the first doubt had not been in the object itself, the safek‑safeka that arises after mixing would still be forbidden, since it is only two mixtures. If so, why does the Mechaber need the reasoning that “the first doubt was in the object itself”? And why did he need to write this entire law of a doubtful tereifah that became mixed with others? What basis is there to think it is better than the case of two mixtures? All the poskim agree that it is certainly no better than two mixtures. And similarly, it is difficult regarding the Rema: why does he need the reasoning that the first doubt is biblically forbidden? And one cannot say that the Mechaber and the Rema came to teach that even a doubtful tereifah that became mixed into two mixtures — the second mixture is forbidden, and it is not comparable to the case of three mixtures, where the third mixture is permitted — because here the first doubt is in the object itself and is biblically forbidden. For certainly, in the case of the second mixture here, it should be permitted — for this is a proper safek‑safeka, since the first doubt is not in the object itself and is not biblically forbidden, as will be explained below in se’if‑katan 63, end of din 4. And so the Rema writes in se’if 8, that in a doubtful prohibition the second mixture is permitted. This requires further investigation.

In such a case, the doubt is rabbinic, and we rule stringently. And as explained below in se’if‑katan 63, din 18 — according to the Mechaber, it is not nullified in a mixture, even though the first doubt is rabbinic, since it is a doubt in the object itself. But according to the Rema in his gloss, it is nullified (as explained below in se’if‑katan 63, din 17), since the first doubt is not biblical; therefore it becomes a safek‑safeka. And one can say that even the Mechaber only said his ruling in a case where the first doubt in the object itself is a biblical prohibition. And the Rema in his gloss is stringent even when the first doubt is not in the object itself, since it is biblical, and therefore not a safek‑safeka. Or one may say that each one stated one point, and they do not actually disagree: the Rema merely adds that in a safek‑safeka, if there is any doubt at all, it is permitted — even when the doubt is in the object itself. The Laws of Safek‑Safeka (Double Doubt). 
1) **This is not considered a safek‑safeka.** Even if the first doubt was not known until after the mixture occurred — for example, several eggs were mixed together, and afterward a doubt of terefah was discovered in a chicken, and it became known that one of the eggs came from that chicken and was laid after the doubt of terefah arose — and similarly in all such cases: Even though no doubt of prohibition was known at all until after the mixture, and therefore both doubts became known together and arrived simultaneously, nevertheless, since the first doubt involves a biblical prohibition, it is not considered a safek‑safeka. So ruled the Darkei Moshe, end of siman 57, and the Taz, Klal 43, din 7. But the Avi Ezri, at the end of siman 57, quoting the Mahari”k, disagreed and permitted the case even when the first doubt was not known before the mixture, because of safek‑safeka.And this is what the Rema concludes in his gloss: “But if there are two doubts whether any prohibition exists at all, and both doubts became known together…” — implying that in the first case, even when both doubts became known together, it is not a safek‑safeka. 
And this also appears from the words of the poskim, and not like the responsum of Mish’at Binyamin, siman 37, who challenged the Rema on this point. His main argument was that from the source where the Rema derived this ruling — the Or Zarua HaGadol, Klal 26 — it does not appear this way. Rather, he claimed that only in the glosses on the Or Zarua is this written, and that we should rely more on the author of the Or Zarua himself, who was a great and authoritative rabbi, than on the glosses. 
**But this is not correct.**
For in the Or Zarua itself it is clear in many places that even when the doubt was not known beforehand, it is still forbidden.
He writes in his conclusion that the two doubts are not from the same category: 
The first doubt is inherent — “perhaps it is not a terefah.”
 Only after the mixture does the second doubt arise — “perhaps this is not the forbidden one.”
Furthermore, the two doubts are not in the same object: If you say it is a terefah, perhaps this is not the egg — meaning two separate bodies. 
But when the two doubts are in the same body — for example, in the case of safek tachtav (“doubt whether the blood came from under her”) or the case of a man and woman who relieved themselves into the same vessel (Niddah 59b, explained later in siman 191:6) — then the blood itself contains a safek‑safeka:
“Perhaps it is not from the woman,”
and if it is from the woman, “perhaps it came from the vestibule.”Thus, according to both reasons, even if the doubt was not known beforehand, the two doubts are not from the same category nor from the same body. 
And furthermore, he writes that this case is not comparable to safek tachtav or the case of the man and woman — and in those cases, certainly the doubt was not known beforehand.
And this is evident to anyone who examines the Or Zarua in many places: **he does not distinguish between whether the doubt was known beforehand or not.**And the glosses on the Or Zarua are merely explanations of his words. **This is clear.**

2) The Or Zarua HaGadol **writes** there, in din 4, as follows: “Even an egg that is found inside its shell in a chicken that recently became a terefah is considered a biblical doubt (safek de‑oraita). For perhaps at the moment the chicken became a terefah, the egg had not yet formed its shell, and it was still considered part of the mother’s flesh (yerech ha‑em), and it grew in a state of prohibition. And if such an egg became mixed with others, it is not nullified even in a thousand.Nor may one separate the eggs and permit each one individually through a safek‑safeka — by saying:
‘Perhaps the shell was already formed before the chicken became a terefah,’
and if not, ‘perhaps this is not that egg.’ This is because the first doubt is biblical, and the two doubts are not from the same category, nor are they in the same object. 
And even in a chicken in which a doubt of terefah arose, one may not permit the egg it laid — or an egg found inside it — through a safek‑safeka: 
‘Perhaps the chicken is not a terefah,’
and if it is a terefah, ‘perhaps at the time it became a terefah the egg already had its shell.’ For regarding the egg itself, the two doubts involve two different bodies, and the doubts are not from the same category, and the chicken had a presumption of being a terefah at the time it laid the egg or at the time the egg was found inside it. 
(This is not comparable to the case of cheeses made from an animal that was later found to be a terefah, where we say ‘it became a terefah only now,’ as above in siman 81:2 — because there, the animal did not have a presumption of being a terefah at the time it was milked, unlike here. And so writes the Or Zarua HaGadol, Klal 49, din 2, regarding cheese made from a terefah animal, that we say ‘it became a terefah only now.’ His words are: ‘Maharam and Ribak answered that regarding an animal, we do not say “it was terefah and came, terefah and came,” as we do regarding a mikveh. And it is also not comparable to eggs in a case of doubtful terefah, because there the bird already had a presumption of doubt at the time it laid the egg.’ So ends the quotation from the Or Zarua HaGadol.

4) **And this is specifically** when the egg is definitely from a chicken that had a doubt of terefah (as above), or when there is a doubt whether it is from a definitely terefah chicken (and there is also a doubt whether it had its shell before the chicken became terefah or not)―for example, an egg found in a courtyard where there are only two chickens, one kosher and one terefah. But if the chicken itself only has a doubt of terefah, then the egg is permitted even without any mixture at all, because of a safek‑safeka: 
 - perhaps the chicken did not lay this egg, and even if it did lay it, 
 - perhaps it is not a terefah. 
And even though the mixture is only “one against one” (meaning: the chickens themselves were mixed one with one; but if the chickens had not first been mixed one with one, and each was still identifiable, then the first doubt would be a biblical doubt—because how could you later say “and if it is from this one, perhaps it is not a terefah,” when you have already forbidden it from the Torah because of the doubt—consider this well), nevertheless the first doubt is not considered a **biblical safek de‑oraita**, as will be explained below, since the chicken is not definitely terefah. And the two doubts are in one matter and one body, and they arise simultaneously. So ends his words.
 And it seems that in this last ruling, it is permitted even when it is known that at the time the doubt of terefah arose in the chicken, the egg had not yet formed its shell—because of this *safek‑safeka*:
 * perhaps the chicken did not lay it and the egg is not from it, 
* and even if it is from it, perhaps the chicken is not a terefah.
And this is *not comparable* to the case of a doubtful egg of a terefah that became mixed, where all are forbidden and we do not permit through safek‑safeka, because there the doubts are not from one matter and one body.
For in that case, you cannot begin by saying “perhaps there is no prohibition here at all,” since there is certainly a doubtful terefah in this mixture. You are therefore forced to begin by saying “perhaps it is not a terefah,” and thus your first doubt is a biblical prohibition.
And when you then say, “and if it is a terefah, perhaps this is not the one,” in the second doubt you are being lenient and saying “perhaps this is not it,” which makes it two bodies and two separate matters.
This is unlike our case, where the starting point is that we do not know where this egg came from. Therefore you begin by saying, “perhaps it is from the kosher chicken, and there is no prohibition here at all.”
And when you later wish to be stringent and say, “perhaps it is from the terefah chicken,” then regarding this very body about which you wish to be stringent, I say: “perhaps it is not a terefah.”
And you cannot say: “But we already forbade it because of the doubt, and the first doubt is biblical,” because here the chickens were mixed one with one, and the first doubt is *not* biblical.
Therefore, even though the doubts are, in form, from two matters and two bodies, they are in truth from one body and one matter, since the first doubt is: “perhaps this egg is from the kosher chicken, and there is no prohibition here at all.”
Only when you come to be stringent and say, “perhaps it is from the terefah chicken,” and you thereby create two bodies and two matters in order to be stringent, I say: “perhaps it is not a terefah” in that very body and matter about which you are coming to be stringent.
And this is exactly comparable to the case of:
* “perhaps the blood is not from the woman, and if it is from the woman, perhaps it is from the vestibule.”
For even though there too the doubts are two matters and two bodies, they are truly from one matter and one body, as the Or Zarua wrote and I cited above in law (1).
The reason is that you certainly do not begin by saying “perhaps it is from the womb,” since at the outset we do not know where the blood came from at all.
Therefore, the first doubt is: from where did this blood come? And so at the beginning I say: “perhaps it is from the man, and there is no prohibition here at all,” and the first doubt is not a biblical prohibition.
And when you come to be stringent and judge with two bodies and two matters, saying that it is from the woman, I say to you regarding that very body you are judging—namely, the woman—“perhaps it is from the vestibule.”
And I found written in the handwriting of Rabbi Moshe Isserles in the margin of the Or Zarua on that case of an egg found in a courtyard, and it is not known whether it is from the kosher chicken or from the doubtful‑terefah chicken. His words:

“Nevertheless, the first doubt is not a biblical doubt, because the first doubt did not arise immediately, but only together with the second; whereas if the prohibition were based on a single doubt alone, then it would be called a biblical doubt of prohibition, as he wrote at the beginning of this responsum.”

End of his words—whose explanation is as I have written.
**Therefore**, it is also not considered a safek‑safeka in the case of a chicken in which a doubt of terefah arose recently, and it then laid an egg, and it is not known whether the egg was completed before that or not.
For when you begin by saying “doubt whether the chicken is terefah, doubt whether it is not terefah,” you are beginning with a doubt that is a biblical prohibition.
And when I say, “and if it is terefah,” you have still not yet created two bodies and two matters.
And when you then say, “perhaps the egg was completed earlier,” you are inventing another doubt to be lenient, with two bodies and two matters.
Similarly, even if you begin by saying, “and if it was not completed earlier, perhaps the chicken is not a terefah,” you are again being lenient with two bodies and two matters:
 - at first you judged the egg itself,
 - and now you come to judge and be lenient regarding the chicken—these are two bodies;
and at first you judged “perhaps it was completed earlier”, and now you come to judge and be lenient “perhaps it is not a terefah”—these are two matters. 
Likewise, in a case where a single egg is found and it is not known whether it is from a definitely terefah chicken or from a kosher one—even though the chickens were mixed one with one—the first doubt is a biblical prohibition, since there is a definite prohibition in the chicken.
Therefore, you cannot say “perhaps it is from the kosher one,” because that would make the first doubt a biblical prohibition. And if you wish to begin by saying “perhaps the egg was completed earlier,” then all the more so you are beginning with a first doubt that is a biblical prohibition. And even when you then say, “and if it was completed later, perhaps it is not from the terefah but from the kosher one,” you are being lenient with two bodies and two matters. And furthermore, you have already said “perhaps it was completed later,” and thus you have admitted that it came from the terefah—so how can you then go back and say “it is not from it”?
And now it is also understood why, in the case of a doubtful terefah that became mixed into a thousand, all are forbidden—even to eat them one by one—while the second mixture is permitted even all at once, as explained above in se’if‑katan 55.
For what difference is there whether the first mixture is eaten two by two, or the second mixture is eaten all at once? In both cases there is a *safek‑safeka*.Furthermore, the second mixture is certainly permitted when it is not eaten all at once, because we can say: “perhaps this one that I am eating is not the one that fell here”—there you begin with two bodies. Rather, it must be that in the first mixture you cannot say “perhaps there is no prohibition here at all,” since there is certainly a doubtful terefah present. And you cannot begin by saying “perhaps this is not it,” because at the outset you must say: what is the defect in this very piece you are judging? And furthermore, if you begin by saying “perhaps this is not it,” then all the more so you are beginning with two bodies. Therefore, you are forced to begin with “perhaps it is not a terefah,” and thus your first doubt is a biblical prohibition. And even when you then say, “and if it is a terefah, perhaps this is not it,” you are being lenient with two bodies and two matters. But in the second mixture, I begin by saying: “perhaps there is no prohibition at all in this mixture,” and thus the first doubt is a doubt of something permitted by Torah law.
And when you wish to be stringent and say, “perhaps the prohibition that was in the first mixture fell into this one,” and you thereby create two bodies and two matters in order to be stringent, I say regarding this very body and matter about which you are saying that it is here: “perhaps it is not a terefah".

Meaning: just as he says that when there are two chickens, one definitely *terefah* and one kosher, this is not a *safek-safeka*, so too in the case where one chicken is a doubtful *terefah*, and they became mixed one with one, and both lay equally, and now there are two eggs, and it is not known which egg came from the kosher chicken and which from the doubtful-terefah chicken — **this is not a safek-safeka.**

For certainly one of these two eggs contains a doubt of prohibition, and therefore you cannot begin by saying: “perhaps there is no prohibition here at all,” because there is definitely a doubtful prohibition present.

Therefore, you must begin with: “perhaps it is not a *terefah*,” and thus the first doubt with which you begin is a biblical prohibition. And when you then say: “and if it is a *terefah*, perhaps this is not the egg from it,” you are being lenient with two bodies and two separate matters.

And if you begin by saying about each egg: “perhaps this is not from the *terefah*,” then all the more so the first doubt is already in two bodies, and therefore it is not a *safek-safeka*.

6) From what the Or Zarua HaGadol wrote earlier—that if there are two chickens in a courtyard, one a doubtful terefah and one kosher, the egg is permitted because of a double doubt: perhaps the chicken did not lay it, and even if it did lay it, perhaps it is not a terefah, and these two doubts are from one matter, in one body, and arise simultaneously—it appears clearly that even if the doubt of terefah in the chicken was known from the outset, the egg is still permitted.
For what difference does it make that the doubt in the chicken was known? You are not judging the chicken but the egg, and in the egg no doubt of terefah ever existed; only afterward did the first doubt arise together with the second, as explained above in section (d) in the name of the Rema.
Furthermore, the Or Zarua makes no distinction here between a case where the doubt was known beforehand and a case where it was not known; this implies that his ruling applies in all situations.
And since he writes that the two doubts are “from one matter, in one body, and arise simultaneously,” if the law applied only when the doubt was not known beforehand, he should have written so explicitly. But since he states it simply—“they arise simultaneously”—it implies that they always arise simultaneously, for the reason explained above.

It thus appears clear that even if the doubt of terefah in the chicken was known from the beginning, the egg is permitted — for you are not judging the chicken but the egg, and in the egg itself no doubt of terefah originally existed; only afterward did the first doubt arise together with the second, as explained above. Moreover, the Or Zarua does not distinguish here between whether the doubt was known beforehand or not, which implies that his ruling applies in every case. Since he states that the two doubts are “in one matter, in one body, and arise simultaneously,” if that formulation were meant only for the case where the doubt was not known beforehand he would have specified so; because he did not, it implies that they always arise simultaneously for the reason given (the separation argument).

9) **It seems that even** if one of them was lost to another place, one may not permit the remainder by virtue of a safek‑safeka and say “perhaps there is no prohibition here at all,” because certainly there was here a doubtful prohibition; therefore you would have to begin by saying “perhaps this is not the prohibited item and the **prohibited item was lost,”** and then you would be starting with two bodies. And when you then say afterward “this one perhaps is not a terefah,” you are creating two matters in order to be lenient. It appears that even if one of them was lost entirely from the world, that does not help in this case. For even though there are cases where two important items were mixed and one of them fell into the sea or was lost and then the rest were permitted (as above in section 7), there the reason is that by Torah law it was already nullified by majority, and the Sages decreed that in important matters it should not be nullified; they said, however, that if one of them is lost we may rely to be lenient. That is not the case here.

10) The Agur **wrote**: a k’zayit of doubtful milk that was mixed between two measures of grain — a k’zayit of permitted milk mixed among two measures of grain so that it is not distinguishable — and afterward one of those fell into a pot of meat and the pot does not have the measure to nullify a k’zayit that fell (this implies: even though there is no measure to nullify it even by Torah law, for example there is no majority in the pot or it fell into a pot of a different type), it is permitted because of a safek‑safeka: perhaps the first k’zayit that was mixed was fat, and perhaps the other was milk; perhaps it was not the one that fell into the pot — and this first doubt is rabbinic, for by Torah law one against two is nullified. These things are indeed correct, for you can begin by saying “perhaps there is no prohibition here at all,” and then say “but there is a prohibition here,” meaning: this is the one that fell into the two measures as a k’zayit, and then you make it stringent with two bodies and say “perhaps it is not milk.” 
But it is difficult, for the Or Zarua wrote in Klal 26, din 11, that a doubtful terefah which was mixed into a thousand and then one of the mixture was separated back out and mixed into a majority is permitted; however, if it was separated and mixed one‑by‑one, and certainly when it stands by itself it is forbidden. And so it seems from the words of the poskim regarding a doubtful *derusah* (a doubtful forbidden item) that was mixed and then one of the mixture was separated and mixed into a majority — they rule it permitted — but if one of them was separated and stands alone, it is forbidden.
**It therefore appears to be the law:** since in the first mixture each of the items was forbidden — because certainly there was here a doubtful prohibition — then when one of them later stands alone, its status is the same as the mixture itself. We decree this because we fear that one might take from the established (permitted) portion, and we do not rely on safek‑safeka. Even if the items were mixed one‑by‑one, nevertheless whenever there is no majority the rule applies, as is known: that which was separated from the mixture is treated as if it were part of the mixture. Therefore, whenever something was mixed afterward we require a majority; a dry item is not nullified unless it is less than the majority. But if afterward one of them fell into a pot, the pot is permitted, for there we do not judge the single piece itself but only the pot. Thus one may equate the words of the poskim with one another. 
And so the Or Zarua HaGadol divides in Klal 49, din 7, regarding cheese of an idolater: although it is not nullified by majority when dry, it is certainly a prohibition that becomes nullified in a cooked dish by majority, as explained above.

11) We learned at the beginning of Ketubot (amud 9): “One who says ‘an open breach I found; I entrusted him to forbid her’ — why is this a safek? Is it a doubt whether he is under her authority or not? One might answer: ‘under him — a doubt in coercion; not under him — a doubt in consent; in the case of a priest’s wife (who is forbidden in the case of coercion) you do not need [this distinction].’ And if you wish, say: in the case of an Israelite woman, for example where her father accepted kiddushin on her — she is less than three years and one day old (so that we cannot say her virginity returns, as taught in Niddah), [then the question of whether she is “under him” might be raised].”
**Tosafot wrote:** “Thus Abba said regarding an Israelite woman… and one may answer: indeed there is a safek — a doubt of coercion and a doubt of consent — and one may say: in the case of consent, when she is a minor and a seduced minor, it is coercion, as we say regarding ‘he came upon his brother’s wife’ (Bava Kamma 4, 61b). And one may say that there the coercion is a single [type of] coercion.” And so rules the Hagahot at the beginning of chapter 3 of Hilchot Isurei Bi’ah in the name of the commentators: there it is a single doubt because the coercion there is one. Likewise in the Piskei Mahari (siman 110) on the question they asked in siman 129 about two kids born to one goat that was being milked, he wrote: “And further, explain to me whether one may permit the two firstborn kids of one goat on the basis of a safek‑safeka — perhaps this one did not come out first.” And he answered: “If it came out first, perhaps the halacha follows that milk exempts.” But it is somewhat difficult in light of section 49 which says that milk exempts because of the majority of animals that are not milking unless they give birth; therefore there everything is a single doubt — perhaps she already kidded — and it did not come out first; hence the questioner phrased it thus.” The Mahari replied: “Even if there is no one who holds that milk exempts, still there is no one who disputes that this is a safek — perhaps she already kidded — and therefore there is a safek‑safeka: perhaps she already kidded, and these two kids are both simple (non‑firstborn).” And he continued: “If it is not already a firstborn, one may say that one of them was eaten and is not a firstborn.” And there it is a single doubt; there is no certainty that the goat gave birth to a male and a female and we would be in doubt which came out first. This occurred recently in Worms, and Rabbi R. Moshe asked me about the matter, and I answered that there too it is a single doubt. I brought him proofs that a safek is effective even in such cases, and even according to his words one may rely on your safek there, for the last doubt there does not add and permit anything beyond the first; the first is stronger than the last — the doubt “perhaps she already kidded” is decisive — and perhaps the womb already aborted before she gave birth to the twins now. These twins are like that: perhaps the female kidded first and the womb aborted before the male was born; in the female’s body there is no distinction, but in our case the first doubt is more lenient than the last, because if she already kidded then both twins are simple. Thus it is reasonable to consider a safek‑safeka even where the two doubts are not of the same kind.
Nevertheless it seems certainly not effective to rely on a safek‑safeka in such a case, as is explicitly taught in the Shulchan Aruch where a wolf entered a flock and trampled one animal — Rabbi Yitzchak wrote that one may not permit by virtue of a safek‑safeka because perhaps it was trampled by the wolf’s tooth; and one may answer: “in hand, perhaps it is not that one,” since the first doubt is a *de‑oraita doubt* and is not nullified by majority, all the more so when it stands alone. Thus the Mahari seems to concede that where there is a single item there is no *safek‑safeka*.

12) **Rather**, the law is that in this matter it is not a case of “one” (i.e., they are not considered a single item), because the first doubt is more lenient, and likewise even when one of them is a female it is not a case of “one,” since in the first doubt neither of them is a firstborn, even though there is no distinction in the female; nevertheless now neither of them came out first. But certainly where there truly is one item, the Mahari and the commentators cited above hold that it is not a safek‑safeka, and according to their words one must say so in the Talmud. Rather, the Mahari holds that since the first doubt permits more than the last, it is a safek‑safeka and therefore it is not “one” in that case. And now it is fitting: do not press from where the statement in the later section (Klal 122, siman 6–7) that utensils of doubt are not fit for daily use comes from. They wrote there the explanation and the poskim: the reason is that it is a safek that we will use it today, and they said we do use it today — perhaps we will use it in something that spoils the taste or does not give flavor, etc. This is difficult at first glance, for there it is one item; even if one says we do not use it today, it would not be permitted except because it imparts a defect of taste, as explained at the beginning of siman 122. Rather, certainly the reason is the first doubt — namely, perhaps we will not use it today — and if we knew for certain that we would never use it today, it would give a reason for defect in every cooked dish in the world. But the last doubt is that perhaps we will use it in something that spoils this dish or does not give flavor to this dish; and if we knew what we would use it for, then even if it would spoil this dish it might improve another dish. Therefore the first doubt permits more than the last, and it is not “one” in that case.

13) The Agur **wrote**: a safek that you cannot invert does not count as a safek — for example, the case of a slaughtered animal where one finds the knife damaged: there is a safek that perhaps the very jointing‑knife was damaged. One might answer: it was not damaged in the jointing‑knife but perhaps it was damaged in the secondary lesser knife (מיעוט בתרא), and if so this is the safek; and one might say it was not damaged in the secondary lesser knife but in the primary lesser knife (מיעוט קמא), and then certainly it is a nevelah and you cannot say perhaps it was damaged in the secondary lesser knife. One might further say it was not damaged in the secondary lesser knife but in the very knife itself — in which case in both possibilities there is no concern of prohibition, and all is one case: either it was damaged in the knife itself or it was damaged in the secondary lesser knife. Therefore you cannot invert the doubt, for it would not be called a safek and so you cannot reverse it. 
The commentators there explain explicitly: any safek that you cannot invert is not a safek. But I forgot the place where they explained it so; the commentators wrote this. Plainly, this is not a safek because there is an additional deficiency there and the coercion is single. Moreover, immediately one must say: perhaps it was damaged in the hide (בעור) — then it would be a first doubt. See below in section 27.

14) And likewise in the responsum Menachem Azariah (siman 67): an incident occurred with a fowl whose bone was broken at the hip and above, and there is no skin and flesh covering most of it, and the shochet did not feel this break at the time of slaughter. The question: may it be permitted by virtue of a *safek* — perhaps the break occurred after slaughter? He answered: rather, before slaughter — perhaps it did not protrude outside before slaughter.
The answer: you already know that one does not permit any prohibition by virtue of a safek except at a time when the two doubts can be inverted; and here it is impossible to invert them, therefore this is only a single doubt. And one should not say “perhaps it protruded outside after slaughter,” for after slaughter the distinction between protruding or not does not apply; and since you said “it protruded outside,” it must be before slaughter.
So I wrote in siman 55, se’if katan 4, as one answer to know the Semak, the Hagahot Maimaniyot, the Mordechai and other poskim regarding the question whether this is a safek — that it is not a safek here because it does not invert. Likewise at the end of siman Hilchot Olam I wrote that I received from my teacher, the sage N.R., that one does not call a case a safek except when it inverts from two sides — that is, whichever side you take first, the safek remains; but if it does not invert, it is not considered a safek. It is possible that stringency applies to it like an ordinary safek; the analogies are: safek “touched” / “not touched,” and safek “touched” / “creeping thing” / “frog,” and so on — in all such cases there is a safek because they invert. But where it does not invert — for example, safek “entered” / “not entered,” and one might say “entered” and then “touched” — the reverse does not produce two doubts, because once you take the first (e.g., “touched”) you cannot then say again “entered or not.” Thus such cases are not safekim.
So says the Rivash in the name of Tosafot, and likewise in the Rivash’s responsum (siman 122) in the name of Tosafot; and similarly in many later responsa. Also in the responsum Divrei Rivavot (siman 310) that a safek that does not invert is not a safek. There is pressure in that passage from the beginning of Chullin (amud 10 end) where a local knife is discussed and there is a safek whether the defect is in the hide or in the bone, and even if in the hide perhaps the signs of slaughter do not correspond to the defect and it would be like a safek; and they answered that even there one can invert, etc. It seems to me that that is not truly a case of inversion; be precise — the commentators mean that it is only a quasi‑safek, as I explained above in section 27.
There is an **objection**: the Rashba wrote in his novellae (beginning of folio 44) and the Bayit Yosef cites it (siman 57): when a lion’s claw is found lodged in a man’s back and there is doubt whether the lion entered or not, it is permitted because of a *safek* — a doubt whether it entered. And if one would say “it entered,” one might answer: perhaps this claw is not directly from the lion but rubbed against a wall. Now here the doubt does not invert, so one cannot say “perhaps it did not enter.”

15) It seems appropriate to say that here, regarding the broken bone, the two doubts concern the same bone; therefore, since both are in one body, who would say that we may begin by asserting “perhaps it occurred after slaughter,” etc.? Rather, one might say the opposite: “perhaps it protruded outside,” and then you could not afterwards say at all “perhaps it occurred after slaughter.” 
But here, when you want to say “perhaps this claw is directly from the lion,” you thereby take the position that it certainly entered; how then can you assert at the outset that it certainly entered? Therefore from the outset you must decide whether it entered at all, and one may say “it entered — perhaps it did not trample and this claw is from the wall.” Even though you cannot invert it, a plain safek is created, since the first doubt is “perhaps it did not enter.”
This is also how the Rashba’s statement should be understood: for the doubt is on a doubt, not on the opposite, and one may answer that the doubt is “perhaps it did not trample,” etc., as the Bayit Yosef brings there. The Rashba likewise wrote this in a responsum and the Bayit Yosef cites it in siman 84; and the Shulchan Aruch ruled there (seif 9) that if something was cooked within twelve months without inspection it is permitted because of a *safek* — “perhaps there is no worm” — and one answers that perhaps it melted away. Therefore one cannot say the opposite “it did not melt, perhaps there is a worm,” for from the outset you must decide whether there is any prohibition at all. This is proven by the Mordechai at the end of the chapter “All Flesh” and by the responsa of Meimunei (Hilchot Ma) siman 8, where they write in the gloss of Rabbeinu Samson regarding cheeses about which there is doubt whether the casing was fitted on the stomach of a nevelah: they are permitted from a safek‑safeka — perhaps it did not fit the stomach casing — and one answers that perhaps it did fit and therefore imparts flavor. Hence here you cannot invert the doubt; rather, certainly, as explained above. However, see the discussion in Hilchot Olam about “perhaps entered / perhaps not entered” and the possibility that the poskim disagree there, or that in Hilchot Olam they are addressing a case where contact is possible even if entry did not occur — clarify further.
**Again** I found in the responsum Menachem Azariah (siman 126) wording exactly like the above, and I enjoyed it greatly. He writes: “And even though some of the Rabbis in the Bavli relied to permit in a safek‑safeka even when it does not invert, it is reasonable for us to say that there are two cases: that which is not clarified which doubt arose first — in such cases we are stringent and then necessarily we require that they invert in order to be lenient; otherwise what do you see as the basis for permitting in this matter? If not, one side drags the other and it opens to its companion so that there is no later one in that case — and then it is a single doubt. And in Torah matters we go to stringency; but if the matter is such that the single doubt is revealed to us at the outset, then we examine the matter in its own right and we are stringent even though the later doubt exists, and we rely on it to be lenient in a Torah case because the Rabbis said that all prohibitions at the time of finding are treated stringently. In the chapter on these treifot regarding a lung adjacent to the wall, Ran explains leniently in the name of Rav Nachman because of a safek — and one who is lenient there needs to place it in a context where it does not touch a Torah prohibition.”
Thus his words are clear as explained above, but he did not bring clear proofs. I have already brought clear proofs to you that in every such case there is no need for inversion. Yet there is a difficulty: in the case of the broken hip‑bone where it is not known whether the break occurred before or after slaughter, it is a *safek* — is it not possible to invert and say “perhaps the lung was punctured after slaughter,” since after slaughter the distinction of puncturing the lung or not does not apply? One must resolve that in the other case, because there the break does not invalidate by itself but only because of the lung; how then can you begin by saying “perhaps the lung was punctured,” when there is no lung‑defect at all? From the fracture of the hip you come to judge the lung, and therefore from the outset you must examine when the fracture occurred — and that is precise.
 **Again** I saw in She’arit Yosef in the rulings of Mar Shmuel that his opinion is likewise: any safek that does not invert is not a safek. But he left there some difficulties, as they say in the beginning of Bava Kamma (folio 11b): if part of my property was born without a newborn, we do not suspect impurity, and Rashi explains there that it is a safek. But this present safek does not invert: the safek is whether that portion came out of the birth or not, and one answers “it came out — perhaps most of it did not come out,” and if you say “most came out” there is no doubt at all, for then it is like a live birth. Likewise in the chapter of the sender we say: if found in the hand of an idolater, they say it is written there and Rashi explains it is a safek — perhaps they wrote it for an Israelite; and one answers that they wrote it for sale to an Israelite, and if we say they wrote it for an idolater then there is no doubt at all. Also his brother Mar Shmuel agreed there that a safek that does not invert is not a safek. He did not answer those two difficulties. He further disagreed with the author above (Klal 49, sec. 4) who held that in doubt whether a puncture was made by a needle or by a kosher instrument one may permit because of safek; according to the above there is no difficulty at all, for from the outset you must examine whether there was a birth at all, and likewise in the scroll you must from the outset examine whether they wrote for an idolater at all, and in the puncture you must from the outset examine whether there was a needle at all. These matters are clear and self‑evident, and the author’s words stand. Also Rav Bar Shmuel and other later authorities wrote like the author; his brother Mar Shmuel in his glosses agreed with the author.

16) **Where there** is a **safek‑safeka** in a case that is permitted by Torah law but forbidden rabbinically, and there is a rabbinic double doubt that permits leniently — this was explained above in Zimnei Tova and also in the Agur I cited in section (10). Likewise the Semak (siman ר"ה) and the Bayit Yosef (siman פ"ג) write so, and so does the Or Zarua (Klal 13) and the Rav in Batei Chayim (Klal 20, end of din 3).
For example: fish stock made from fish — where there is an oily fish that is forbidden by Torah law and salted fish like herring that are permitted — are permitted on the basis of a *safek‑safeka*: there is a doubt whether they were salted together with impure fish. One may say they were salted and perhaps they had no fat, in which case their stock is only rabbinically forbidden; and one may therefore permit by safek‑safeka — perhaps they were not salted with the impure ones. Thus the ruling is a rabbinic safek that perhaps they were not salted with the impure fish, and one may be lenient. This is straightforward. See Orach Chayim siman 39 and above, siman 24, for further laws of *safek‑safeka*.

17) The Rav in Batei Ḥayim, chapter 43, law 7, **wrote**: The Or HaYashar (Klal 25) wrote that cheeses of an idolater, even though their primary prohibition is only rabbinic, are nevertheless regarded as if they were a full prohibition; and if they became mixed, they are not nullified by a safek‑safeka — “perhaps they were not mixed with something impure” — and one answers: they were mixed, perhaps this is not the one I eat. However, other rabbinic doubts that arise from mixtures are permitted, for in rabbinic matters we do not require that the two doubts be of the same substance. So writes the Or HaYashar (Klal 25), and he adds there that nevertheless when the mixture is by majority we require that it be mixed into a majority, but not one‑by‑one.
Now, if there is a doubt about the piece itself — whether this particular piece is one that carries a rabbinic prohibition or not — even without mixtures it is permitted, because the Sages did not decree in such a case. These are the words of the Taz, and his remarks require explanation because the wording is obscure and the rulings are not exactly as they first appear from the plain sense of his words, as will be clarified below. The Or HaYashar (end of law 12) says: when an idolater’s cheese is found and one took it not in our presence, and its prohibition is only rabbinic, certainly if it was mixed with others it is nullified by majority even though it is ḥalal (permitted) by reason of a *safek‑safeka* — “perhaps this one is kosher” — and he explains that for a rabbinic prohibition there is no need that the two doubts be of the same body.
(It follows that even if it is known to be permitted, since there is no requirement that the two doubts be in the same body, in a pressing case one might say that the law is forgotten when it was not known from the outset that it was rabbinically forbidden; for if it was not known originally, how could one know now?) Nevertheless one still needs a safek‑safeka to permit, for when we say “a rabbinic doubt is lenient” we mean cases like an egg of a nevelah, and so on. But where there is a concern of a Torah prohibition — even though by Torah law it would be permitted by majority — and the Sages forbade it because of the minority, then it is certainly a prohibition: the Sages forbade it because of that very doubt. This will be shown below regarding unmarked cheeses left in the hands of an idolater, which are not nullified except by a second doubt.
Now, if the majority that would permit is present, then why is a safek required? If it was not mixed but rather one‑by‑one, then we do not say that each has a safek that permits it; since the prohibition is certainly within it, and without the majority that would permit it, the whole is forbidden. But if there is a doubt about the piece itself — whether the piece in the market is that one or not — then certainly even without mixtures it is permitted, because the Sages did not decree in such a case.
The Or HaYashar’s words require clarification because they are not obvious and were printed with errors. Moreover, when an idolater’s cheese is found in the market or taken from an idolater not in our presence, do not say that because it is forbidden due to hidden meat one would suspect it might have become a nevelah and therefore treat it like a rabbinic prohibition that carries a Torah‑level suspicion like the cheeses discussed below. Rather, its prohibition is only rabbinic out of a general stringency (because when an idolater’s cheese is found in his possession and taken not in our presence, the Sages forbade it out of stringency). Many Amoraim in the Talmud permit such items, and even those who forbid do so out of stringency, as Tosafot explain in the chapter “Gid Ha‑Nasheh.”
This differs from an egg of a nevelah and similar cases where the rabbinic prohibition is not nullified by majority; the reason there is that an egg of a nevelah is certainly rabbinically forbidden, which is a different matter. But when an idolater’s cheese is found in the market or taken from an idolater not in our presence, its prohibition is only a doubt; therefore if it became mixed it is nullified by majority because of a *safek‑safeka*. The author concludes that nevertheless one still needs a safek‑safeka to permit — that is, one must have the double doubt — because the prohibition is only a stringency. Thus when there is a side of leniency in the law (for example, great loss or other leniencies) or even in a one‑by‑one case, one still needs a safek‑safeka to permit.
And the Or HaYashar says that when we say “a rabbinic doubt is lenient” we mean cases like an egg of a nevelah: if we are uncertain whether it is an egg of a nevelah or a properly slaughtered egg, that is a rabbinic doubt and is lenient (as he writes in law 15: “an egg that is doubtful — nevelah or slaughtered — is permitted even without mixtures, for a rabbinic doubt is lenient because the Sages did not decree in such a case”). This was explained above in section 66, paragraph 3.
But the Or HaYashar continues: where there is a concern of a Torah prohibition — that is, the Sages forbade it not merely out of a stringency but because there is reason to suspect a Torah‑level prohibition in the item itself, even though by Torah law it would be permitted by majority — the Sages forbade it because of that suspicion; therefore it is treated as a definite Torah prohibition and is not nullified in the case of exchange except by a second doubt. This is shown below in Klal 47 regarding cheeses of Israelites left in an idolater’s house and later exchanged, where there is doubt whether the cheese is of an Israelite or of an idolater: although other rabbinic prohibitions are permitted in idolater’s cheeses, here the cheeses of idolaters were forbidden by the Sages because of the fear that there is a Torah‑level impurity in them; therefore they are treated as a definite prohibition and are not nullified in this exchange‑doubt except by a second doubt.
Nevertheless, when the item is found in the market or taken from an idolater not in our presence, the majority that would permit is present, and therefore one still needs a safek‑safeka to permit. If there is a doubt about the piece itself — whether the piece in the market is that one or not — then certainly even without mixtures it is permitted, because the Sages did not decree in such a case. This is the explanation of the Or HaYashar’s words cited above.

18) And **likewise** Or HaYashar at the beginning of Klal 47, regarding cheeses of Israelites that were in the house of an idolater and there is doubt whether they were exchanged for the idolater’s cheeses — Maharam Shmuel bar Baruch answered to forbid them all, because the prohibition now is not merely due to exposure but rather there is certainly a prohibition in them; therefore one must be stringent regarding the doubt of their having been exchanged. Even if there were only a doubt whether they were stuffed into the stomach of a nevelah, they would not be permitted here by virtue of a safek‑safeka (double doubt) — the claim is that they were not exchanged — and one answers that they were exchanged, perhaps they were not stuffed into the stomach of a nevelah; since the Sages forbade idolater’s cheeses because of that concern, it is certainly a prohibition. Therefore one is not permitted by a *safek‑safeka* until there are two independent doubts in addition to the first doubt for which the Sages forbade them. And the point is that a rabbinic prohibition is nullified by a single doubt — a rabbinic safek is lenient because the Sages did not decree in such a case — this applies to things whose primary prohibition is only rabbinic (e.g., an egg of a nevelah, stock of impure fish, foods cooked by idolaters, items born and set aside, etc.). But regarding an idolater’s cheese, and similar cases, even if the Sages had not originally decreed, there would be here a concern of prohibition by the Sages’ decree that is treated as a definite prohibition; and because of that concern there is only one doubt, as I explained above. The Or HaYashar says that cheeses of idolaters are regarded as if they were a definite prohibition and are not nullified; and he continues: other rabbinic‑level doubtful prohibitions — that is, those which the Sages forbade only because of a concern (for example, meat that disappeared from sight, which the Sages forbade because of the worry it might have been exchanged into a nevelah) — since that is merely a stringency, it differs from other rabbinic prohibitions and is nullified by majority. He continues: however, if there is a doubt about the piece itself — whether this particular piece is the one that disappeared from sight and therefore carries a rabbinic prohibition or not — then even without mixtures it is permitted, for in such a case the Sages did not decree a prohibition that would prevent leniency. This is to say: if the doubt is whether this is the piece that certainly carries a rabbinic prohibition (for example, an egg about which we doubt whether it is from a nevelah or from a properly slaughtered animal), then it is permitted even without mixtures, as explained above. And so wrote the Taz; his words need clarification because his phrasing is terse, and the practical rulings are not exactly what a literal reading might suggest, as will be shown. Or HaYashar (end of law 12) explains: when an idolater’s cheese is found and one took it not in our presence, and its prohibition is only rabbinic, then if it was mixed with other cheeses it is nullified by majority even though one might say “perhaps this one is kosher” — because for a rabbinic prohibition we do not require that the two doubts be in the same physical item. Nevertheless, one still needs a *safek‑safeka* to permit in certain cases, because when we say “a rabbinic doubt is lenient” we mean cases like an egg of a nevelah; but where there is a concern of a Torah prohibition — even if by Torah law it would be nullified by majority — and the Sages forbade it because of the minority, then the Sages treated it as effectively a definite prohibition, and one does not permit it except by a second independent doubt. This is the case with unmarked cheeses left in an idolater’s house that were later exchanged: although other rabbinic prohibitions in idolater’s cheeses are treated leniently, here the Sages forbade those cheeses because of fear of a Torah‑level impurity, so they are treated as a definite prohibition and are not nullified by a single doubt of exchange — only by a second doubt. 
Thus, when the majority that would permit is present, one still needs a *safek‑safeka* to permit; but if the doubt concerns the identity of the specific piece in hand — whether that piece is the forbidden one or not — then even without mixtures it is permitted, because the Sages did not enact a decree covering that precise case. From these explanations you can see that my earlier reading of his words in Klal 25 is clear and correct. 
Do not object to the Rema’s statement that where, from the standpoint of the prohibition itself, the case is a *safek d’oraita*, while from another standpoint the doubt is *derabbanan*, we do not rule that a *safek derabbanan* is treated leniently. For later, in siman 111, we say regarding a *d’oraita prohibition* that fell into two pots, and in one pot there is a majority so that by Torah law it is permitted — even though rabbinically it is forbidden — that this is a case where it is not known into which pot it fell, and therefore it is a safek derabbanan and we are lenient. 
One can answer that that case is different: there the doubt is not, in itself, a safek d’oraita, since the pot is entirely permitted (it is wholly of the heter), and the only question is whether there is any prohibition in it at all. 
Therefore we say: even if one concedes that there might be a prohibition there, nevertheless by Torah law it is nullified by the majority (bitul b’rov), and so the doubt is only derabbanan. Because it is possible that there is no prohibition there at all, the doubt arises from the situation itself, and from that standpoint it is derabbanan. That is not the case here, where one cannot say that perhaps there is no concern of prohibition at all, for certainly in these mixtures there is a doubt of treifah — note carefully.
**Similarly**, if there is a doubt about a chaticha (a piece) whether it is fit or possibly a doubtful treifah, it is permitted by Torah law if it was mixed from the outset one‑to‑one, as explained above in simanim 7 and 8. And likewise a issur derabbanan — even when it is not forbidden because of an intrinsic concern of a d’oraita prohibition but only because the Sages decreed it for some other reason (for example, an egg of a nevelah that became mixed into a thousand is not nullified) — is treated so. This is stated by the Or Zarua and likewise is brought in the name of the Rema that an egg of a nevelah is not nullified. The poskim, the Tur, and the Shulchan Arukh in siman 86:3 imply the same.
At the head of siman 101 the Rema writes in his gloss that a chaticha that is forbidden only derabbanan is not nullified; his wording indicates he means this for every issur derabbanan. The fact that he did not exclude cases such as meat that was hidden from the eye and similar cases seems to be because he is speaking only of rabbinic prohibitions enacted as law, not mere stringencies. Indeed he excludes such cases in Darkei Moshe on siman 101 and the Taz (Klal 40, end of se’if 2), citing the Rambam (Hilchot Ma’achalot Assurot ch. 17). The Rambam there discusses fowl cooked with milk and non‑consecrated meat slaughtered in the Temple courtyard — cases where there is no substantive d’oraita concern in the item itself, but the Sages decreed because of some other reason. Above, in se’if katan 98, it was explained that in a matter that can be clarified (davar she‑yesh lo matirin) we do not say that a safek derabbanan is lenient.

20) **And nevertheless** — all of the above applies to a *safek derabbanan* that does not have a chazkat issur. But in a doubt that does have a chazkat issur we rule, in the chapter B’chol Me’arvin (Eruvin 35) and folio 36, that we go to stringency. And even though there the case in the Gemara is different — namely it concerns tum’ah, which has a primary status as *d’oraita* — we nevertheless rule thus. Moreover, there the difference is another: Rabbi Yosi is stringent even regarding a safek derabbanan that has no d’oraita basis, and the halacha follows Rabbi Yosi. And although the Rashba in his responsum (siman ת"א) did not write only the first distinction — that is, he did not explain his words there — it appears from his language that he accepted the simple reading that in every issur derabbanan we rule stringently. The Rashba there intends to say that there is no need for the first distinction. This is proven by what is explained later in siman 26 in the name of *Hamasa’at Binyamin*, that the Rashba forbids in a case of a *safek b’chezkat issur*; and the Rashba in his responsum there likens a rabbinic prohibition that has a chazkat issur to a compounded doubt of a chazkat issur — see there.

21) **It seems that** if a safek derabbanan was mixed one‑for‑one, even though it is not a significant matter, and afterwards one of them was lost and it is not known which one it was, we do not say regarding that doubt safek derabbanan to be lenient; for since there was a chazkat issur on one of the two, the law is that there is a chazkat issur. And this is proven from the Rashba’s responsum, siman ת"א, concerning what he wrote; and even in cases where a chazkat issur is established — for example a forbidden chaticha that was mixed into two permitted pieces, etc. — in such a case the matter is significant like a *chazkat issur*, and therefore we do not say in that type of case that a *safek derabbanan* is to be treated leniently.

22) **But** if one of the two was mixed one‑for‑one, this does not change the law in this matter: if it is something that is not significant and it was mixed with its own kind so that it is nullified by majority — and even if it was mixed not with its own kind — since a safek derabbanan is nullified by majority, for even when they cook them it is impossible that it will lead to a *d’oraita* prohibition, as it says in siman 109, se’if katan 9. And although I wrote there that where there is a total loss one must be stringent when it is not mixed with its own kind because there is no counter‑measure against it, nevertheless it seems that if one of them was lost we should not be so stringent as to say “safek le‑chumra” in this way, and one should not be stringent here as well to say that the prohibition remains by majority even if one was lost and still exists in the world. They were not stringent in this manner except in an important matter, whereas here it is different. Moreover, even without that (i.e., even leaving aside that point) here there are two derabbanan cases.

24) **And from the matter** explained above — that when one‑for‑one there is a *chazkat issur* and a *safek derabbanan* is treated stringently — it follows for us that where, after they were mixed, one of the two in the mixtures was later lost, it is not a safek derabbanan to be lenient and say “perhaps this one (the one I may eat) is the one that fell, and perhaps that one is the permitted one.” Rather, one‑for‑one is not a mere doubt at all but a *chazkat issur*, and it is like a derabbanan prohibition that is not nullified in mixtures. Moreover, one‑for‑one in every case is significant like the substance of the prohibition itself. This is plainly implied in the Orakhot Ha‑Yamim generally, chapter 26, law 11, that a derabbanan prohibition which was mixed one‑for‑one and afterwards one of them became mixed into the mixtures is not nullified — because one‑for‑one is like the substance of the prohibition.

27) **Even** if it had a presumption of prohibition, etc. The Rav wrote in Darkei Moshe at the end of chapter 57 and in Torat Chatat rule 43 at the end of law 7 that the Issur V’Heter wrote that for any matter that has a presumption of prohibition, we do not permit any double doubt. However, his words are not correct, as the Rashba wrote in Responsum 401 that a double doubt is effective even for something that had a presumption of prohibition. On the surface, it implies he is challenging the Issur V’Heter on what he wrote there in rule 26, law 2, regarding a chicken where a doubt occurred during its slaughter and it became mixed with others, that it is not nullified by the logic of a double doubt because the first doubt is from the Torah and also because it had a presumption of prohibition, as a living animal stands in a presumption of prohibition. Regarding this, the Mas’at Binyamin in Responsum 38 challenged the Rav and wrote that, on the contrary, it is implied from that Rashba responsum that a presumption of prohibition in such a case does not benefit from a double doubt. In truth, his words are not compelling, for even though the Rashba’s responsum, where he says “and do not answer me from Rav Huna who said a living animal stands in a presumption of prohibition,” seemingly implies this, nevertheless there is a clerical error in the wording there, and it is possible to emend it so that he holds like the Rav. Furthermore, later in the conclusion of that responsum, the Rashba writes: And you should further know that a double doubt is superior to a majority, and it is possible its power to permit is stronger than a majority, for Rabbi Joshua regarding lineage disqualifies based on one majority but qualifies based on a double doubt; and since that is so, just as we follow the majority to permit all prohibitions in the Torah even where a prohibition was established, such as a piece of forbidden meat mixed with two permitted ones, the same law applies to a double doubt, which is permitted even where a prohibition was established. Thus it is evident that he explicitly permits it even where there is a literal presumption of prohibition like a forbidden piece and similar cases. Also, at the beginning of the responsum, the Rashba seeks to permit a rabbinic doubt even when there is a presumption of prohibition, and it is explicitly proven there that a double doubt and a rabbinic doubt share the same law in this matter, and the Mas’at Binyamin challenged the Rav incorrectly on this. Also, regarding the many proofs he brought from the Talmud and Tosafot to forbid a double doubt in slaughter cases with a presumption of prohibition and the like, writing that they are clear—they are not proofs at all to one who examines all the sources, and this is sufficient for one who understands. His main proof, upon which he built his foundation, is from what we say at the beginning of Chullin and as explained in chapter 18, section 11, that if one slaughtered many animals and afterward the knife was found to be nicked, even the first is forbidden. Yet there are several doubts: a doubt if it was nicked during the first or the last, and if you say during the first, perhaps it was nicked by the neck bone, and if you say it was nicked by the skin, perhaps he did not slaughter the signs against the nick, as the Tosafot wrote there. Even so, it does not help at all since the prohibition was established, for a living animal stands in a presumption of prohibition, and therefore any doubt in slaughter is not considered a doubt of prohibition but a certainty of prohibition due to the presumption. All this is no proof at all, for if so, even if he slaughtered only one, he should have challenged that it should be permitted: perhaps it was nicked at the very end of the signs, or if you say it was not nicked at the end, say it was nicked by the neck bone. Rather, certainly such a case is not considered a double doubt at all, for both possibilities are not concerns of prohibition and it is all one doubt, as the Agur wrote explicitly and as I brought above in law 13. And even though in the Rashba’s responsum it implies he wants to say this is called a double doubt, I have already written above that there is a clerical error in the printing there, and it is possible and likely that the conclusion—that it is not called a double doubt in such a case—is missing. Also, the point that perhaps he did not slaughter the signs against the nick is not a doubt at all, for presumably he slaughtered in the manner of slaughterers and moved the knife back and forth across the entire blade. Furthermore, the Tosafot at the beginning of Chullin only wrote that this is “like” a double doubt. Even the Mishbetzot Zahav himself is forced to admit that this is not a true doubt, otherwise the original difficulty returns: why do we forbid even the first animal? For one cannot say it is a presumption of prohibition, as that would only make the first doubt a certainty.

28) **Nevertheless:** wherever there is a double doubt even without the first doubt, it is certainly permitted, for it is no worse than the substance of a prohibition itself which is permitted by a double doubt. If it were true that he held this to be a true double doubt, then there would be a double doubt even without the first doubt, and in such a case it is certainly permitted. Rather, it is certain that he holds it is not a double doubt but merely "like" a double doubt. Perhaps the Mishbetzot Zahav holds that where there is a presumption of prohibition, even many doubts do not help; but this is not at all logical, for it is surely no worse than the substance of the prohibition itself, as I have explained. This is also the implication of the Responsum of the Rashba that I cited above, that a double doubt regarding a presumption of prohibition is no worse than the substance of the prohibition itself, and this is obvious to me. Therefore, all the challenges raised by the Mas'at Binyamin against the Rav are now nullified.

29) **It appears**that even the Rav [the Rema] here in his gloss did not mean that we permit a Double Doubt in the face of a Presumption of Prohibition, except specifically in a case such as a broken wing of a bird, where the doubt does not concern the slaughter (shechitah) itself. It seems that in the edition of Issur V'Heter [HaAroch] that the Rav had before him, it was written that in such a case it is forbidden due to the Presumption of Prohibition. This is also written in Darkei Moshe at the end of Chapter 57: "The Issur V'Heter wrote: even though we do not apply a Double Doubt to something that has a Presumption of Prohibition, nevertheless, where there is a remedy through inspection, it is permitted. For example, if a bird's wing was broken and we do not know if it happened before or after slaughter—and if you say it was before slaughter, perhaps the lung was not pierced—it is permitted based on a Double Doubt. Since there is a remedy through inspection to see if the lung was pierced, but we are simply stringent and do not inspect, the existence of a Double Doubt makes it permitted." Thus, it is explicit that the Rav's version of the Issur V'Heter HaAroch considered a broken wing to be a Presumption of Prohibition. Although our current editions of Issur V'Heter do not imply this (as will be explained), the Rav already wrote in Responsum 131, Law 12, that when he was writing and collecting his insights from the Issur V'Heter, he had a manuscript version where the language was styled differently, and many things there do not match the current printed editions. This resolves the Rav's challenge in Darkei Moshe and Torat Chatat against the Issur V'Heter's prohibition of a Double Doubt in a case of Presumption of Prohibition. He challenged this from the fact that the Tur (Chapter 57) and other authorities seek to permit a doubt regarding a predator's attack (derusah) based on a Double Doubt. While some authorities hold it is not a "true" Double Doubt because the first doubt involves a Torah prohibition, everyone agrees that a Double Doubt is effective even with a Presumption of Prohibition, as a living animal is always under a "Presumption of Prohibition" [until properly slaughtered]. Now, if the Rav is challenging a doubt that occurred during the slaughter itself, this is certainly not a valid challenge—as noted in Mishbetzot Zahav—for what does a doubt in slaughter have to do with a doubt regarding a predator's attack? We only say a Double Doubt is ineffective against a Presumption of Prohibition when they are interdependent (i.e., the presumption and the doubts concern the same matter). For instance, regarding a living animal's presumption of prohibition, the presumption concerns the validity of the slaughter, and the doubts also concern the slaughter. But where the doubt is not about the slaughter—such as a doubt of derusah—a Double Doubt is certainly permitted, because regarding derusah, we have no Presumption of Prohibition; on the contrary, every animal is presumed not to have been attacked. This was also written in the book Elya Rabbah (page 50b) in the margin. However, if the Rav's challenge refers to the "Presumption of Prohibition" regarding the wing, he is certainly correct in his challenge, and even the Mishbetzot Zahav would agree. But a Double Doubt regarding the slaughter itself certainly cannot be permitted, as it constitutes a literal Presumption of Prohibition.

35) A double‑doubt even though it can be clarified by inspecting the lung, etc. — that is, there is no need for an examination at all. Likewise in Darkhei Moshe (sec. 57) in the name of the rulings of the Mahari (sec. 47). Indeed the Rashba in his Chiddushim (folio 53) wrote that even where there is a double‑doubt and an examination can clarify, an inspection is required where it can resolve the matter. From this one can also derive proof from the Talmud, for the Mahari there in his rulings derived this law from the following: he says regarding a doubt of crushing that became mixed with others that the halakha is a double‑doubt even though one could clarify by inspection. Rabbi Y. would likewise permit because of the double‑doubt if not, since the first doubt is from the Torah. And in tractate Zevachim, chapter “Ta’arovot” (74b), it is asked: why does the Mishnah teach that all the sacrifices that were mixed with a treifah graze until the treifah is salted — whether that treifah was known or not known — and from where do we know that it mixed and secondly that it mixed by falling? Now if there were absolutely no possibility of inspection, one would have difficulty, for then all would be permitted because of a double‑doubt (either that it was crushed and mixed or that it fell). One must resolve this by saying that where there is no possibility of inspection nevertheless if one sees blemishes in the internal organs it is obvious that even a double‑doubt does not help, as stated in Siman 53, se’if 12. Therefore in Kodashim, as Rashi explained there, where a doubt of treifah was established they do not admit it into the azarah for the slaughterer because it was offered and you would suffer loss; therefore we are also concerned that blemishes might be found and pressed. Hence it appears that where it is possible to examine — for example when it is before us and there is no loss involved — one should examine, but otherwise one should not be stringent. Moreover the Shach and the Semag wrote regarding seeing blood because of intercourse that it is permitted without inspection by a tube because of a double‑doubt, and the Beit Yosef cites them later in Siman 177. The Mordechai also wrote in the chapter on Shevuot in the name of Rabbi Y. See there.

36) **And he answered** that the laws of a double doubt (safek s’fika) are broader than the sea, and none of the great Rishonim or Acharonim reduced them to their rulings or mentioned everything in the Be’er Heitev, and there are many matters and disputes among them as was explained at length above in section 64. Therefore it seems that we should not now invent any doubt in order to be lenient, even to equate word for word, unless it is one of those cases explained above or exactly like them, or unless there are reasons to permit in any event. Thus I brought above, subsection 63, law 15, in the name of the responsa Menachem Azariah, who wrote regarding a double doubt that turns around, that whoever wishes to be lenient in ordinary cases needs to show a clear basis for doing so, for where one does not touch a Torah prohibition by a doubt, etc. And also in the responsum of our teacher Baruch, who answered R. Sh. of Radovitz, quoted by the Mordechai in the chapter HaCholatz, he wrote that one should not act initially to permit, for in several places it is found that even in a double doubt we are stringent. For example, in the tractate Bekhorot, the case of those who are disqualified regarding yibum, a doubt whether male or female, and they say male because perhaps a eunuch will be found; and in the chapter of the animal that hardens, where they impose the stringency of two births, there too it is a double doubt that perhaps there was no birth there and they say there was because perhaps it was male; and in the chapter of those treifot concerning that which was only scratched, where there is a doubt of crushing, etc.; and likewise in the chapter Ten Lineages, Rav said that a matter of Torah law stands as valid, etc. Even in a rabbinic doubt we say we lean to stringency, and in chapter two regarding an egg, a vessel that became impure on Yom Tov, etc., because it appears as if it were a corrective from where? And in the chapter “There Are No Sides” they dispute in doubt and we rule halakha like the one who is stringent. And so it is in the Tosafot at the beginning of the tractate Bava Kamma, folio 11, end of folio 70, that we are stringent in a double doubt, and likewise in the responsa Nifla’ot Lev, part 3, section 50, which says: and if you wish to say that since the inspection is rabbinic this is a rabbinic dispute and a double doubt would be for leniency, this is not the case, for R. Baruch wrote in the chapter HaCholatz that it is found in several rabbinic matters that there are double doubts in which we go to stringency, and likewise other later authorities in several places. All this shows that there are many and various differences of law regarding a double doubt; therefore one should not decide anything from a mere utterance unless in the manner I mentioned above.
