**ואדם**המתייאש מן החוב. אין הקהל יכולין להשביעו. דשבועה כזו לא מצינו כל כמה דלא אתי לידיה. אין זה לא מן הנשבעין ולא משלמין. ולא מן הנשבעין ונוטלין. וכשיפרעו החוב יקח ממנו השוחד לפנים **א** דשותף כיורד ברשות דמי והמותר יחלוקו:

A community may not force one of its members, who claims to have given up hope of ever collecting a certain debt, to take an oath to bolster such a claim. If such member by the use of bribery subsequently succeeds in collecting the debt, he shall be entitled to deduct the full cost of the bribe before he divides the balance with the community.
