**ושכתבתם**כיון שבכתב התנאים אין כתוב בו קניין אינו חשוב שטר והימניה טפי משטרא זה אינו מכמה טעמים חדא דכמה שטרות יש שאין בהן קנין שטר קדושין. שטרי בירורין. ואגרות שום. ואגרות מזון. וכהנה. איש תבונות ידלנה. וכולן דין שטרות להן. וכן כותב אדם עדותו על השטר ומעיד עליה אחר כמה שנים. ואף על גב דמסיק והוא שזוכרה מעצמו ה"מ בעד אחד אבל בשני עדים חתומים על השטר ונכתב מדעת שניהם כי הכא שטר גמור הוא לכל דבר ומביאין השטר לבית דין ונאמין לכל דברי השטר אפילו כשאינו זוכרה וכן פירש ר"י בפרק ב' דכתובות (דף יח ויט) ושלום מאיר בר ברוך:

*Q*. Since the written betrothal agreement makes no mention of a *kinyan*, it should not have the force of a legal document. Obviously, greater trust was place in him (the intended father-in-law) than in a legal document. Moreover, the witnesses do not recall the contents of the written agreement that bears their signature.
*A*. There are a number of documents that contain no *kinyan* clause and yet have the force of legal documents. Although the witnesses do not recall the contents of the document that bears their signature, the document is legally binding nevertheless.
