**ושנים**שבאו לדין בלילה ואמרו דנו דינינו אנו מקבלים עלינו דין שלכם אע"פי דאין דנין בלילה כל דבר שבממון והם מקבלי' עליה' הרשות בידם מידי דהוה אפסולין ונשים שיכולין לקבל כמו נאמן עלי אבא וכמו דבורה ששפטה את ישראל שקבלוה עלייהו וחד דקבליה עליה כבי תרי בפרק זה בורר (דף כא). וא"כ קניא אסמכתא שנעשית בלילה בב"ד חשוב הוא קניין גמור כיון שנעשו מדעת שניהם דאפילו דין גמור דנין בלילה מדעת שניהם ושלום מאיר בר ברוך:

If litigants request that the judges adjudicate their case at night, and they solemnly agree to abide by such adjudication, the judges are permitted to hold court at night, and their decision, in such case, is binding. Therefore, a *kinyan* of an *Asmakta* transaction, made at night before an authoritative court, is binding since it is made with the consent of both parties.
