**¹ וששאלתם**במילתא דאיכא פלוגתא דרבוותא אם יש לכם לעשות שודא נ"ל דודאי לא עבדינן שודא אלא מי שהוא גדול הדור ומומחה לרבים. תדע דבס' פ' מי שהיה נשוי (כתובות ד' צד:) דא"ל רב² נחמן לר' ששת מאי טעמא עבד מר א"ל שודא א"ל אנן למי ניעבד הכי שודא א"ל חרא דאנא דיינא ומר לאו דיינא וכו' אלמא דר' ששת לא הוי מצי למיעבד שודא אלא³ אמר רב נחמן דיין מומחה והילכתא כוותי' בדיני ועוד דלא עבדו שודא אלא היכי דאתמר בהדיא בגמ' והיכא דלא איתמר המוציא מחבירו עליו הראי':

*Q*. When we are confronted with a case regarding which authorities differ in their decisions, are we permitted to exercise our discretion in adjudicating such a case?
*A*. Only the outstanding scholar of the age and an authorized judge are permitted to exercise judicial discretion (שׁודא דדיינא) in a few cases prescribed by the Talmud. Otherwise the rule prevails that the burden of proof is upon the person seeking to collect money from his friend.
