רעו. ועל ראובן שתובע משמעון מנה לי בידך ושמעון משיבו לא כי אלא מנה לי בידך תשבע שיש לך מנה בידי או אשבע שיש לי מנה בידך נ"ל אם שמעון מהפך שבועתו בלא תנאי ישבע ראובן ויטול ועל תביעת שמעון ישבע ולא ישלם שהרי ראובן אינו מהפך שבועתו על שמעון ואם אין שמעון מהפך שבועתו אלא על תנאי שאם ישבע ראובן ששמעון ישבע כמו כן א"כ לא היפך שבועתו וחייב שמעון שבועת היסת ונזקקי' לתובע תחלה.

*Q*. A says to B: "You owe me one *Minah*." B answers: "On the contrary, you owe me one *Minah*; either take an oath that I owe it to you or I will take an oath that you owe it to me."
*A*. If B meant to transfer his oath to A, A will swear that B owes him one *Minah*, and, again, that he owes nothing to B, and he may collect his money from B. But if B meant that he will allow A to take an oath and collect, on condition that A allow him to do the same, B's words are of no avail and the usual procedure [that the defendant takes the oath to free himself from obligation] is followed.
