שמב. על ר' מרדכי שפסק לתן י' ידנר לצדקה להזכיר נשמת אמו בריזבורק ושוב כשנודע לו שהיא בעצמה נתנה לצדקה להזכיר נשמתה חזר בו ואמר אלו הייתי יודע לא הייתי נודר נ"ל דאינו יכול לחזור בו דנדר בסתם בלא תנאי אף אם בלבו לא הי' כך דברי' שבלב אינם דברי' בכה"ג ויתן י' דינרי' להזכיר נשמתה.

*Q*. A promised ten *denarii* to the charity fund of Merseburg to commemorate the soul of his departed mother. Subsequently he learned that his mother had already contributed to the same fund for the same purpose. Can he retract his promise?
*A*. No, since he made the promise without any verbal reservation, he must keep his promise.
*Q*. May A give ten *denarii* to a charity fund of another place?
*A*. No, A's promise to give money to the poor of Merseburg is in the nature of a vow and must be fulfilled.
