מידי דהוה אמקדש אחותו - ולפי האמת יש לחלק דלא שייך התם למימר אדם יודע כמו במקדש אחותו דהא רב קאמר דמכורה ויוצאה:

**מידי דהוה אמקדש אחותו—For it is similar to one who betroths his sister**

OVERVIEW
שמואל ruled that if one sold his field during the יובל year the sale is not valid. רב ענן was not sure whether the buyer receives back the money or not. The גמרא explained that even though שמואל stated אינה מכורה it does not necessarily mean that the money goes back, because this case may be similar to one who is מקדש אחותו where שמואל rules that the money remains as a gift for the woman.

**ולפי האמת¹ יש לחלק דלא שייך התם למימר אדם יודע כמו במקדש אחותו² –
And according to the truth** that מעות חוזרין (by מוכר שדהו ביובל), **we can differentiate, because there** (by יובל) **it is not** that **applicable to say that a person knows** that one cannot sell his field on יובל, **as it is** plausible to say that by **מקדש אחותו,** where everyone knows that one cannot be מקדש אחותו –
**דהא רב קאמר דמכורה³ ויוצאה:⁴**
**For רב maintains that it is a sale, but it goes out** from the buyer to the seller, so obviously there is no universal agreement that a field cannot be sold on יובל.

SUMMARY
People (even according to שמואל) are more aware that אין קידושין תופסין באחותו than being aware that a field cannot be sold on יובל.

THINKING IT OVER
Since even according to רב the field returns to the owner,⁵ so all the buyers know (even according to רב) that the sale will be reversed (just as the קידושין will not take effect) so (according to שמואל) he is giving the money לשם מתנה just like by מקדש אחותו; what is the difference?!⁶

¹ The גמרא resolved the issue from a ברייתא that in the case of המוכר שדהו ביובל the ruling of שמואל is that מעות חוזרין. The question is why is this case different from מקדש אחותו, where מעות מתנה, but not מעות חוזרין.
² Therefore by מקדש אחותו it is understood why שמואל maintains מעות מתנה, because everyone knows that one cannot be מקדש his sister.
³ Therefore שמואל can maintain that even though he personally maintains אינה מכורה however there is an opinion (of רב) that it is מכורה, and therefore the person who sold it on יובל can claim he was not aware that it may not be sold, and therefore he is entitled to receive his money back.

דלא ליגרבו ולייתו - והא דתניא בפ' נערה (כתובות נב.) נשבית והיו מבקשין ממנה עד עשרה בדמיה פעם ראשון פודה שאני אשתו דהויא כגופו יותר מבתו דהכא ועל עצמו לא תיקנו שלא יתן כל אשר לו בעד נפשו ור' יהושע בן חנניא דפרקיה לההוא תינוק בממון הרבה בהניזקין (לקמן גיטין דף נח.) לפי שהיה מופלג בחכמה אי נמי בשעת חורבן הבית לא שייך דלא ליגרבו:

**דלא ליגרבו ולייתו—They should not seize and bring**

OVERVIEW
The משנה ruled that we should not redeem captives for more than they are worth. The גמרא asked, is it because it will place a greater burden on the community to pay for their redemption (so if an individual wants to redeem someone he may do so)¹, or is it because this will cause the gentiles to seize more and more people (in which case even an individual may not redeem for more than the value). תוספות reconciles this latter view with seemingly contradictory גמרות.

תוספות anticipates a difficulty:
**והא דתניא בפרק נערה (כתובות נב,א) נשבית והיו מבקשין ממנה עד עשרה בדמיה –
And this which the ברייתא taught in פרק נערה, ‘**if one’s wife **was captured and they wanted ten times her value** in order to release her –
**פעם ראשון פודה² –
The first time** it happens **he should redeem her’;** this would seemingly contradict this view of דלא ליגרבו!
תוספות replies:
**שאני אשתו דהויא כגופו יותר מבתו דהכא³ –
His wife is different** (than all other captives) **for she is like his** own **body,** even **more** so than the case of the **daughter** mentioned **here,** so since she is כגופו **–
ועל עצמו לא תיקנו שלא יתן כל אשר לו בעד נפשו –**
**There was never an enactment that regarding one’s self he should not give whatever he possesses for himself,** rather there is no limit; the same applies to אשתו.
תוספות anticipates another difficulty:
**ורבי יהושע בן חנניא דפרקיה לההוא תינוק בממון הרבה בהניזקין (לקמן דף נח,א) –
And** regarding **ריב"ח who redeemed that child for much money,** which is mentioned **in** פרק **הניזקין,** how was he permitted to do so if we assume דלא לגרבו?
תוספות responds:
**לפי שהיה מופלג בחכמה⁴ אי נמי בשעת חורבן הבית לא שייך⁵ דלא ליגרבו :**
**For he was exceedingly bright, or** you may **also** say **that during** the time of the **destruction** of the ביהמ"ק, the reason of **'לא ליגרבו', does not apply.**

SUMMARY
Redeeming one’s self or his wife as well as someone who is מופלג בחכמה are exceptions to the concern of לא לגרבו (as well as redeeming during the חורבן).

THINKING IT OVER
Why is מופלג בחכמה a sufficient reason to redeem even יותר מכדי דמיו?⁶

² A husband is obligated (by the תנאי כתובה) to redeem his wife if she is taken in captivity. See ‘Overview’ that according to the reasoning of לא לגרבו, even an individual should not redeem for more that the value of the captive, so why does the ברייתא state that he should redeem her even for עשרה בדמיה?!
³ אביי argued that לוי בר דרגא may have redeemed his daughter for an exorbitant price שלא כדין. However a wife who is more כגופו than a daughter may be redeemed for more than her value
