מורד במלכות הוא ולא צריך למידייניה - קשה א"כ היאך גרס פרק אחד דיני ממונות (סנהדרין דף לו. ושש) דדיני נפשות מתחילין מן הצד מדכתיב גבי נבל ויחגרו איש חרבו ויחגור גם דוד חרבו (שמואל א כ״ה:י״ג) והא מורד במלכות הוה ולא בעי למידייניה ועוד קשה היאך ישב דוד בדין והא אין מושיבין מלך בסנהדרין כדאמרינן במסכת סנהדרין פרק כ"ג (סנהדרין דף יח:) וע"ק מפ' במה בהמה יוצאה (שבת דף נו.) גבי אוריה דקאמר שהיה לו לדונו בסנהדרין ואמאי והא מורד במלכות היה וי"ל דהכא ה"פ מורד במלכות הוא ולא צריך למידייניה כשאר דיני נפשות שדנין בו ביום לזכות וביום שלאחריו לחובה אלא אפילו בו ביום גומרין לחובה והיינו הא דקאמרה ליה אביגיל וכי דנין דיני נפשות בלילה היה לך להמתין לגמור עד למחרת והוא השיב לה מורד במלכות הוה ואין צריך להמתין עד למחר אבל לדונו ודאי צריך וגם לא קשה מהא שישב דוד בסנהדרין דהא דאין מושיבין מלך בסנהדרין היינו משום דלא הוי כבודו להיות יושב ושותק אבל גבי מורד כבודו הוא להיות יושב ושותק לפי שהוא נוגע בדבר:

**He was rebelling against the kingship, and there was no need to judge him -** This is difficult: If so, how in tractate Sanhedrin (36a) it states that capital cases begin from the side, as it is written regarding Naval "And every man girded his sword, and David too girded his sword" (I Samuel 25:13). But he (Naval) was rebelling against the kingship, so he shouldn't have needed to be judged! And further, it is difficult - how could David sit in judgment, when we do not seat a king in the Sanhedrin, as we learned in Tractate Sanhedrin (18b)? And there is a further difficulty from the tractate Shabbat (56a) regarding Uriah, where it says David should have judged him in the Sanhedrin - but why, if he was rebelling against the kingship? The resolution can be said that here the meaning is: He was rebelling against the kingship and did not need to be judged like other capital cases, where we judge during the day to acquit and on the next day to convict. Rather, even on that same day we can render a final guilty verdict. And this is what Avigail said to him: "Do we judge capital cases at night? You should have waited until the next day to render the final verdict!" And he (David) responded to her: "He was rebelling against the kingship, so there was no need to wait until the next day." But to judge him, certainly it was required. And it is also not difficult from the fact that David sat in judgment, for the reason we do not seat a king in the Sanhedrin is because it is not honorable for him to sit silently. But regarding one rebelling against the kingship, it is honorable for him to sit silently, since he is personally involved in the matter.

שגלתה שוקה והלך דוד לאורה ג' פרסאות - קשה היאך אותה צדיקת גלתה שוקה לפני דוד ועוד קשה דמחזי כגוזמא לומר שהלך לאור שוקה ג' פרסאות וי"ל דנמצא בספרים מדויקים שנקוד בהן לאורה כלומר לאור שלה פירוש נתאוה לה דוד והלך באור חמימות שלש פרסאות:

דאיגיירה ונסבה יהושע - קשיא היאך נסבה הא אמרי' פ' הערל (יבמות דף עו. ושם) דאפילו בגירותן לית להו חתנות וצריך לומר שלא היתה משבעה עממין אלא משאר עממין ובאת לגור שם ויש מפרשים שרצו לומר שלא הוזהרו על לאו דלא תתחתן עד לאחר שנכנסו לארץ וזה אינו דאמרי' במדרש דנתינים באו להתגייר בימי משה כמו בימי יהושע ואף על פי כן לא הותרו לבא בקהל אלא היו חוטבי עצים ושואבי מים אלמא דקודם שעברו את הירדן ונכנסו לארץ הוזהרו עליהם:
