התלולית הקרובות בין עיר לעיר ובין לדרך אחד חדשות ואחד ישנות טמאין מפני שהנשים קוברות שם את נפליהן ומוכי שחין את אבריהן הרחוקות חדשות טהורות ישנות טמאות שאני אומר שמא היה שם דרך או עיר ואיזו היא תלולית זו תלולית של עפר שעל גבי בקוע המאהיל על מקצתה טמא ואין צריך לומר כנגד כלה עפרה טמאה משום עפר תלולות התל ממנה עפר וסמכו לה אין בו משום עפר תלולות התלולות שהיתה טמאה וטהורה הרי זו טהורה ואינו חושש שמא נטמאת.

**Sefaria Community Translation:**
The mounds that are nearby, between one town and another town, or between roads: Whether they are new or old, they are impure, because women bury their stillborn fetuses there, and lepers bury their limbs there. New [mounds] that are far [from a town or road] are pure; old ones are impure, for I could say, "lest there was once a road or a town there." And what are these "mounds"? These are mounds of dirt that are on top of a cleft [in the earth]. One who erects a tent on top of part of [a mound] is impure and, needless to say, [one who pitches a tent] against all of it. Its dirt is impure on account of being "dirt of a mound." One who dug (חתר) dirt from it, and packed [more dirt] on it, it is not subject to the laws of "dirt of a mound." A mound that was impure and was purified, behold, it is pure, and one need not be concerned lest it revert to impurity.

אחד המוציא שלשה מתים ואחד המוציא שלשה כוכין ואחד המוציא כוך בקוע ומהרה ואחד מצא עשרה ואין ביניהן מארבע אמות ועד שמונה יש להם תפיסה ואין להן שכונה קברות דברי ר"ש וחכ"א רואה את האמצעיים כאילו אינן והחיצונים מצטרפין מארבע אמות ועד שמנה. מצא ראשו בצד מרגלותיו אין לו תפיסה ואין לו שכונת קברות ראשו של זה בצד מרגלותיו של זה וראשו של זה בצד מרגלותיו של זה יש להן תפיסה ואין להן שכונת קברות. והחסר אין לו תפיסה ואין לו שכונת קברות ואי זהו חסר כל שניטל מן החי וימות. מצא שנים בתחלה ואחד ידוע יש להן תפיסה ואין להן שכונת קברות. מעשה בר' ישבב שבדק ומצא שנים בתחלה ואחד היה ידוע עשה להן תפישה עשה להן שכונת קברות כשבא אצל ר"ע אמר כל שיגעת לריק אף אתה היית צריך לבדוק כל קברי ארץ ישראל הידועין ולא אמרו המוצא שלש כתחלה.

**Sefaria Community Translation:**
It is the same whether one finds three corpses, or whether one finds three sepulchers, or whether one finds a sepulcher and a cleft grave and a hastily dug grave [at the same time], or whether one found ten and they do not have between four and eight cubits in between them: They all are subject to [the laws regarding the impurity of the] "surrounding earth," but they are subject to [the laws regarding the impurity of] a "graveyard site" (i.e., a cemetery) (see Mishnah Oholot 16:3), the words of Rabbi Shimon. And the Sages say, one looks at the middle ones as if they were not there, and the outer ones join together from four to eight cubits. [If] he found a [corpse's] head next to its legs, it is not subject to [the laws of] "surrounding earth," and it is not subject to [the laws of] a "graveyard site." The head of this one next to the body of that one, and the head of that one next to the body of this one: They are subject to [the laws of] "surrounding earth," but they are not subject to [the laws of] a "graveyard site." And that which is missing is subject neither to "surrounding earth" nor to a "graveyard site." And what does "missing" mean? Anything that would cause someone to die if it was removed when he was alive. [If] he found two [corpses] for the first time, and one [more] is known [to exist], they are subject to "surrounding earth," but they are not subject to a "graveyard site." It so happened with Rabbi Yeshevav, that he inspected and found two for the first time, and one was known. He made (i.e., designated) for them [an area of] "surrounding earth," [and] he made for them [an area of] a "graveyard site." When he came to the place of Rabbi Akiva, he said, "All your work was in vain. You would have had to inspect every known burial site in the Land of Israel (i.e., according to your logic). They only ruled regarding one who finds three [corpses] for the first time."

מצא אחד בצד רה"ר מכאן ושנים בצד רה"ר מכאן בודק מכאן ומכאן ומניח את רה"ר שנים בצד גדר מכאן ושנים בצד גדר מכאן בודק את מקום הגדר שכן דרך הבונה להיות בודק עד שמגיע לסלע או לבתולה ואיזו היא בתולה כל שאין בה רשישים ואין עפר תחתיו בדק והגיע למים הרי זו בתולה בדק ומצא שם חרס הרי זו כבתולה. הבודק ב"ש אומרים בודק שתים ומניח אמה וב"ה אומרים בודק אמה ומניח אמה דברי ר' יעקב וחכ"א ב"ש אומרים בודק שתים ומניח אמה וב"ה אומרים בודק אמה ומניח שתים.

**Sefaria Community Translation:**
[If] one [grave] was found on one side of a public thoroughfare, and two [were found] on the other side, he inspects one side and the other side, and he leaves [a cubit] of the public thoroughfare [unchecked] (see Mishnah Oholot 16:4). Two on one side of a fence, and two on the other side of the fence: He inspects the area of the fence, for it is the [normal] way of a builder to inspect until he reaches the rock (i.e., the rocky substrata), or virgin soil. And what is "virgin soil"? Anything that does not have clods of fresh-broken ground, and does not have loose earth below it. [If] he inspected and reached water [below the surface], behold, that is virgin soil. [If] he inspected and found clay there, behold, that is like virgin soil. The one who inspects: Beit Shammai say, he checks two [cubits] and leaves one cubit [unchecked], and Beit Hillel say, he checks one cubit and leaves one cubit, the words of Rabbi Yaakov. And the Sages say, Beit Shammai say, he checks two [cubits] and leaves one cubit, and Beit Hillel say, he checks one cubit and leaves two.

המוציא את העפר ממקום הטומאה אוכל בדמעו ר' יהודה אומר צובר עפרה אמה של זו על גבי עפרה של זו ורבותינו אמרו עפרה טהורה. הבודק אוכל בדמעו מפקח אין אוכל בדמעו שאלו תלמידיו את רבן יוחנן בן זכאי בודק מהו שיאכל אמר להן אינו אוכל אמרו לו למדתנו שיאכל אמר להם יפה אמרתם מעשה שעשו ידי וראו עיני ושכחתי מה ששמעו אזני על אחת כמה וכמה ולא שהיה יודע אלא שהיה מבקש לזרז את התלמידים שהיה ר' יהושע אומר השונה ואינו עמל כזורע ולא קוצר והלמד תורה ושוכח דומה לאשה שיולדת וקוברת ר"ע אומר זמר בית דירה זמר.

**Sefaria Community Translation:**
One (i.e., a priest) who takes out dirt from an impure place may eat from his *dema* (i.e., terumah mixed with chullin). Rabbi Yehuda says, he piles this dirt on top of that dirt, but our Rabbis said, the dirt is pure. The one who inspects [the dirt to check for corpse matter] may eat from his *dema*. The students of Rabban Yochanan ben Zakkai asked him, "The inspector -- what should he eat?" He said to them, "He does not eat." They said to him, "You taught us that he does eat." He said to them, ""Well said. If I have forgotten an act that my own hands performed, and my own eyes witnessed, how much more so one that I have [only] heard with my ears!" And it was not that he did not know; rather, it was that he was trying to stimulate his students. For Rabbi Yehoshua would say, one who teaches and does not exercise [the minds of his students] is like one who sows and does not harvest. One who learns Torah and forgets it is like a woman who bears children and buries them. Rabbi Akiva says, "Review it; continuously review it."

נמצאת אומר שלש קברות הן קבר הנמצא מפנין אותו פנוהו מקומו טמא ואסור בהנאה. קבר המזיק את הרבים מפנין אותו פנוהו מקומו טמא ואסור בהנאה. קבר הידוע אין מפנין אותו פנוהו מקומו טהור ומותר בהנאה. שדה שאבד בה קבר טהור הנכנס לתוכה טמא בדק ומצא בה קבר הנכנס לתוכה טהור שאני אומר הקבר שאבד הוא הקבר הנמצא בדק ומצא בתוכה שלש קברות הנכנס לתוכה טהור ואין חוששין שמא שכונת קברות הן. המפנה קברו לרה"ר והלך לשם אדם מפנה עצם והכל טהור. מי שנפחת קברו בתוך שדהו אומרים לו מלקט עצם עצם והכל טהור מעשה ביהודה והלל אחיו בניו של ר"ג שהיו מהלכים בתחום עוני מצאו אדם אחד שנפחת קברו בתוך שדהו אמר לו לקט עצם עצם והכל טהור.

**Sefaria Community Translation:**
It turns out that one can say that there are three graves: A grave that is discovered: They may remove it, [but once] it is removed, the area is impure, and forbidden to derive benefit from. A grave which endangers the public: They may remove it, [and once] it is removed, the area is pure and permitted to derive benefit from. A grave which is known: They may not remove it, [but] if they did remove it, they area is pure and permitted to derive benefit from. A field in which a grave was lost (i.e., its location was forgotten) is pure, [but] one who enters [the field] is impure. [If] he examined [the field] and found a grave inside it: One who enters [the field] is pure, for I could reason, "The grave that was lost is the grave that was found." [If] he examined and found three graves inside it: One who enters [the field] is pure, and one need not be concerned lest they are subject to [the laws of] a "graveyard site" (i.e., a cemetery) (see Mishnah Oholot 16:3). One who removes his grave (i.e., a grave on his property) to the public thoroughfare, and a person was walking there, he removes one bone [at a time], and everything is pure. One who dug out his grave inside his field, they say to him, "Collect it bone by bone, and everything is pure." It so happened with the brothers* Yehuda and Hillel, the sons of Rabban Gamaliel, that they were walking on the border of Oney, [and] they found a certain man who had dug up his grave inside of his field. They said to him, "Collect it bone by bone, and everything is pure."

והנקבר שלא ברשות אין לו שכונת קברות ואין לו תפיסת קברות. רשב"ג אומר הנפלים אינן קונין את הקבר ואין לו תפיסה והנקבר שלא ברשות יש לו תפיסה. ר' יהודה אומר בור שמטילין בו נפלים טהור א"ר יהודה מעשה של מציק אחד ברמון שהפילה נפל לבור ובא כהן אחד והציץ לידע מה הפילה ובא מעשה לפני וטהרוהו מפני שחולדה וברדליס מצויין שם וגוררין שם.

**Sefaria Community Translation:**
One whose burial is unauthorized is not [considered] part of a "graveyard site" and is not subject to [the laws of] "the surrounding earth of the grave." Rabban Shimon ben Gamaliel says, a stillborn does not acquire a grave and is not subject to "surrounding earth," and one whose burial is unauthorized is subject to "surrounding earth." Rabbi Yehuda says, a pit into which stillborn are dropped is pure. Said Rabbi Yehuda, it so happened with a certain [Roman] tax collector in Rimon, that he dropped a stillborn into a pit, and a certain priest came with his front plate (*tzitz*) to determine what was dropped [into the pit], and that incident was brought before [the Sages] and they rendered it pure, because weasels and hyenas can be found there, and [it is presumed that] they would drag [the stillborn] from there (see Mishnah Oholot 18:8).

קבר שסתם פתחו אינו מטמא בכל סביביו פרץ את פצימיו וחזר וסתמו מטמא את סביביו נפרצה בו פרצה אחת של ארבעה טפחים בין מלמעלה בין מלמטה אינו טמא אלא כנגד הפרצה בלבד. היה לו פתח אחד לצפון ופתח לו פתח אחר לדרום טיהר דרומי את הצפוני.

**Sefaria Community Translation:**
A grave that was sealed: [If] he opened it, it does not import impurity in any of the surrounding area. [If] he broke open its boards, and went back and sealed it, it imparts impurity on its surrounding area. [If] he made a breach in it, one breach of four handbreadths, whether above or below, it only imparts impurity opposite the breach. [If] he had opened one aperture to the north, and opened another aperture to the south, the south purifies the north.
