We go out to the cemetery and examine¹ Y.D., §394. the dead within three days and do not fear [being suspected of] superstitious practices.² It once happened that [a man who was buried] was examined [and found to be living], and he lived for twenty-five years and then died. Another³ which omits ‘another’, this refers to the same man. [so examined lived and] begat five children before he died.

We erect a canopy⁴ for bridegrooms and brides [who died before marriage] and suspend from it articles which have and have not reached the edible stage; this is the opinion of R. Meir. R. Judah⁵ said: We only suspend from it articles which have not reached the edible stage.⁶ These are what are suspended from it: Nuts which have not reached the edible stage,⁷ loaves of bread which are not edible,⁸ strips of purple wool, flasks of perfumed oil. And these are the articles which may not be suspended from it: Nuts which have reached the edible stage, pomegranates which have reached the edible stage, loaves of bread which are edible, and flasks of sweet oil. The general rule is: no benefit may be derived from anything that is suspended from the canopy.

מבזבזין לפני חתנים ולפני הכלות מחרוזות של דגים וחתיכות של בשר בימות החמה אבל לא בימות הגשמים אבל לא חתיכות של דגים מבושלים ולא כמהים ופטריות ולא שומשמין בין בימות החמה בין בימות הגשמים אבל קליות ואגוזים נוטל הוא בתוך וזורק כללו של דבר כל שהוא אבד אין מבזבזין לפניהן.

We scatter before bridegrooms and brides strings of fish⁹ and pieces of meat in summer but not in winter; but not pieces of cooked fish, mushrooms, truffles or sesame both in summer and winter; but one takes roasted ears of corn and nuts and throws them. The general rule is: we may not scatter before them anything that is perishable.

We may let wine and oil flow through pipes¹⁰ before bridegrooms and brides and we do not fear [being suspected of] superstitious practices; nor do we fear of sinning by putting food to shame.¹¹ It is related that Judah and Hillel, the sons of Rabban Gamaliel, came to Ben Zakkai at Kabul¹² and the citizens let wine and oil flow through pipes [in their honour].

We may burn [articles]¹³ at the funerals of kings and mutilate [their animals], and we do not fear [being suspected of] superstitious practices. Any mutilation which disqualifies the animal as food makes it forbidden to be eaten, but benefit may be derived from it; and when the mutilation does not disqualify the animal it may be eaten and obviously benefit may be derived from it. Which mutilation disqualifies it? From the knee downwards.¹⁴

We may burn articles at the funeral of kings but not at the funeral of princes.¹⁵ GRA reads: ‘As we burn articles at the funeral of kings, so do we likewise at the funeral of princes’. When Rabban Gamaliel the Elder died, the proselyte Onḳelos burnt after him more than eighty Tyrian *minas*. They asked him, ‘What was your purpose in doing this?’ He replied, ‘It is written, *Thou*¹⁶ *shalt die in peace; and with the burnings of thy fathers, the former kings that were before thee, so shall they make a burning for thee*.¹⁷ And is not Rabban Gamaliel worth more than a hundred useless kings?’

We cover the hair of [dead] brides, uncover the face of [dead] bridegrooms,¹⁸ and place ink and pen at their side,¹⁹ for his bride. and we do not fear [being suspected of] superstitious practices.
²⁰(When Rabban Gamaliel the Elder entered [the meeting place of the Rabbis to intercalate the year], he found eight [present]. He asked, ‘Who is it that entered without permission?’ Samuel the Small arose and said, ‘Rabbi, I entered only to inquire about the law [of intercalation]’.²¹ He answered, ‘O Eldad and Medad,²² all Israel know that if I had ordered that only two should enter, you would have been one [of them] to enter’.)²³
We suspend the key and writing-tablet of a dead man from his coffin from grief of soul. When Samuel the Small died, they suspended his key and writing-tablet from his coffin because he had no son, and when Rabban Gamaliel the Elder and R. Eleazar delivered their funeral orations over him, they exclaimed, ‘For this one it is fitting to weep, for this one it is fitting to mourn. When kings die they leave their crowns to their sons; when wealthy men die they leave their riches to their children; but Samuel the Small has taken away with him all the desirable things in the world and has departed’. And thus he²⁴ spoke at the time of his death, ‘Simeon [b. Gamaliel] and Ishmael [the son of Elisha the High Priest]²⁵ are destined for the sword and the rest of the people for spoliation; great distress will befall [Israel] after them’. He uttered these words in Aramaic.

²⁶ When R. Simeon b. Gamaliel and R. Ishmael came [to be tried], it was decreed against them that they should be put to death. Whereupon R. Ishmael broke into tears; and R. Simeon said to him, ‘*Abrek*,²⁷ why do you weep? Two steps more²⁸ and you will be in the bosom of the righteous, and yet you weep!’ He replied, ‘Do I then weep because we are about to be executed? It is because we are about to be executed [in the same way] as murderers and desecrators of the Sabbath’. He said to him, ‘Perhaps you were having a meal or you were sleeping when a woman came to ask [a ruling] concerning her ritual impurity or her cleanness, and your servant told her that you were asleep. And the Torah states, *Ye shall not aflict*²⁹ *any widow or fatherless child. If thou afflict them in any wise*—*for if they cry at all unto Me, I will surely hear their cry*.³⁰ And what is written after this? *My wrath shall wax hot, and I will kill you with the sword*’. Some say that it was [47*b*] R. Simeon b. Gamaliel who was weeping and R. Ishmael who answered him in these words.
When R. Simeon and R. Ishmael were executed and the report reached R. ‘Aḳiba and R. Judah b. Baba, they arose, girded their loins with sackcloth, rent their garments and exclaimed, ‘Our brother-Israelites, if good were destined to come to the world, at first none would receive it but R. Simeon and R. Ishmael; but now that it is revealed before Him Who spake and the universe came into being that eventually great punishments will come upon the world, they have consequently been taken out of the world; [as it is stated,] *The righteous perisheth, and no man layeth it to heart*,³¹ and it continues, *He entereth into peace, they rest in their beds*’.³². 2.

When R. ‘Aḳiba was executed in Caesarea and the news reached R. Judah b. Baba and R. Ḥanina b. Teradion, they arose, girded themselves in sackcloth, rent their garments and exclaimed, ‘Our brethren, hearken unto us! R. ‘Aḳiba was not executed for robbery or because he did not labour in the Torah with all his strength. He has only been put to death as a sign,³³ as it is stated, *Thus shall Ezekiel be unto you a sign; according to all that he hath done shall ye do; when this cometh, then shall ye know that I am the Lord God*.³⁴ Within a short while there will be no place found in the land of Israel where no [slain] will be cast forth, as it is stated, *Speak: Thus saith the Lord*—*And the carcasses of men fall as dung upon the open field, and as the handful after the harvestman, which none gathereth’*.³⁵ It is reported that it was not long before war came and disturbed the world, and within twelve months the municipalities³⁶, the Greek for ‘senate, city-council’. Büchler, *The Economic Conditions of Judaea*, p. 28, n. 2, defines the term as ‘open places as opposed to fortified towns’. in Judea ceased; as it is stated, *Tremble, ye women that are at ease; be troubled, ye confident ones:*³⁷ *Ye women that are at ease* refers to the municipalities in Judea, *ye confident ones* refers to the fortified towns.³⁸ *Confident ones* is nothing else than a term for walled cities.³⁹ which Jastrow takes to be a corruption of *kerakim*, ‘walled cities’. [The sentence is apparently a marginal note, and it is difficult to see how a common word should have been misread as an unusual one. Krauss, *Lehnwörter*, pp. 274f more probably ‘enclosures’.] It is reported that twelve months had not passed before what had been said was fulfilled.

R. Meir illustrated it by a parable. To what is the matter like? To a king who prepared a banquet and invited guests without fixing a time when they should leave. The shrewd among them left at the ninth hour,⁴⁰ returned home and went to bed while it was still light; others left at sunset while the shops were still open and the lamps burning, entered their homes and went to bed by the light of the lamps; still others left at two or three hours in the night when some shops were open and some shut, some with their lamps alight and some with their lamps extinguished, entered their homes and went to bed in the dark. Those remaining at the banquet became intoxicated, and wounded and killed each other; as it is stated, *I saw the Lord standing beside the altar; and He said: Smite the capitals, that the posts may shake; and break them in pieces on the head of all of them; and I will slay the residue of them with the sword*.⁴¹

וכשנכנס רבי חנניא בן תרדיון למינות גזרו עליו שריפה ועל אשתו הריגה ועל בתו לישב בקופה אמר להם מה גזרו על אותה עניה אמרו לו הריגה קרא עליה המקרא הזה (תהלים קמה) צדיק ה׳ בכל דרכיו. אמרה להם מה גזרו על אותו רבי אמרו לה שריפה קראה עליו המקרא הזה (ירמיה לב) גדול העצה ורב העליליה וכששרפו אותו כרכוהו בס"ת ושרפוהו והיתה בתו צועקת ובוכה ומתחבטת לפניו אמר לה בתי אם עלי את בוכה אם עלי את מתחבטת מוטב שתאכלני אש שנופחה ולא אש שלא נופחה שנא׳ (איוב כ) אש לא נופח ואם על ס"ת את מתחבטת הרי התורה אש ואין אש אוכלת אש הרי אותיות פורחות ואין האש אוכלת אלא על הנייר שאף כל עבדי המלך גדולים לוקין על ידי קטנים על כן חצבתי בנביאים הרגתים באמרי פי (הושע ו)

When R. Ḥanina b. Teradion was arrested⁴² on the charge of heresy,⁴³ [the Romans] sentenced him to be burnt, his wife to be executed and his daughter to be consigned to a brothel. He asked, ‘What have they decreed against that poor woman?’ They replied, ‘She is to be executed’. Thereupon he recited of her the verse, *The Lord is righteous in all his ways*.⁴⁴ She asked, ‘What have they decreed against the Rabbi?’ They replied, ‘He is to be burnt’. Thereupon she recited of him the verse, *Great in counsel, and mighty in work*.⁴⁵
When they burnt him, they wrapped him in a scroll of the Torah and burnt him. His daughter wept, wailed and threw herself before him. Whereupon he exclaimed, ‘My daughter, if for me you weep, if for me you throw yourself down, it were better that a fire which [a man] has fanned should consume me and not one which [a man] has not fanned;⁴⁶ as it is stated, *A fire not blown by man shall consume him*.⁴⁷ If, however, you threw yourself down because of the scroll of the Torah, behold, the letters are flying upwards and only parchment is being consumed. For even great servants of the king are punished by inferior servants, [as it is stated,] *Therefore have I hewed them by the prophets, I have slain them by the words of My mouth’*.⁴⁸

רבי עקיבא אומר ד׳ בנים למלך אחד לוקה ושותק ואחד לוקה ומבעט ואחד לוקה ומתחנן ואחד לוקה ואומר לאביו הלקני. אברהם לוקה ושותק שנא׳ (בראשית כב) קח נא את בנך את יחידך אשר אהבת את יצחק והעלהו לעולה היה לו לומר אתמול אמרת לי (שם כא) כי ביצחק יקרא לך זרע שנאמר (שם כב) וישכם אברהם בבקר וגו׳ איוב לוקה ומבעט שנאמר (איוב י) אומר אל אלוה אל (תריבני) [תרשיעני] הודיעני על מה תריבני. חזקיה לוקה ומתחנן שנאמר (מלבים ב כ) ויתפלל (חזקיה) אל ה׳ וגו׳ וי"א חזקיה לוקה ומבעט אח"כ היה לו לומר והטוב בעיניך עשיתי. דוד אמר לאביו הלקני שנאמר (תהלים נא) הרב כבסני מעוני ומחטאתי טהרני:

One was silent when punished, another protested when punished, another begged for mercy when punished, and another when punished said to his father, ‘Go on punishing me’. Abraham remained silent when punished, as it is stated, *Take now thy son, thine only son, whom thou lovest, even Isaac … and offer him there for a burnt-offering*.⁵⁰ He could have argued, ‘Yesterday You said to me, *For in Isaac shall seed be called to thee!*’⁵¹. XXI, 12. Then it is stated, *And Abraham rose early in the morning*.⁵². XXII, 3. He submitted to God’s decree in silence. Job protested when punished, as it is stated, *I will say unto God: Do not condemn me; make me know wherefore Thou contendest with me*.⁵³ Hezekiah besought God for mercy when punished, as it is stated, *Then he turned his face to the wall, and prayed unto the Lord, saying*,⁵⁴ etc. Some say that Hezekiah protested when he was punished since he later added, *And have done that which is good in Thy sight*.⁵⁵. 3. The verse, in which he claimed innocence, is understood as a protest against his fate. David [when punished] said to his Father, ‘Continue to punish me’, as it is stated, *Wash me thoroughly from mine iniquity, and cleanse me from my sin*.⁵⁶.

We do not interrupt the study of the Torah until the soul departs from the dying man.⁵⁷, pp. 298f.] When R. Simeon, the son of R. ‘Aḳiba, fell ill, the latter did not interrupt his expositions in the Academy but made inquiries after him through a messenger. The first messenger came and reported, ‘He is very ill’. He said to [his disciples], ‘Continue to ask questions’. Then a second came and reported, ‘He has grown worse’. R. ‘Aḳiba resumed the study of the Torah. A third came and reported, ‘He is dying’, and he said [to his disciples, ‘Continue] to ask questions’. A fourth came and reported, ‘He is dead’.⁵⁸ Whereupon he arose, removed the *tefillin*,⁵⁹ rent his garments and said to them, ‘Our brother-Israelites, hearken! Until now we had the duty to study the Torah; but from now onward we have the duty to occupy ourselves with honouring the dead’.
A large assembly gathered to bury R. ‘Aḳiba’s son, and he said to them, ‘Bring a bench⁶⁰ for me to the cemetery’. He stood⁶¹ upon it and expounded, ‘Our brother-Israelites, hearken! Not because I am a scholar [have you come here], there being greater scholars here than I; not because I am a rich man [have you come here], there being richer men here than I; the men of the Darom⁶² know R. ‘Aḳiba, but how should the men of Galilee know him?⁶³ Men know him, but how should women and young children? I know, however, that your reward is great because you have only taken the great trouble to come here for the honour of the Torah and for the sake of the commandment [to attend the dead to the grave]. I should be comforted though I had seven sons whom I [now] buried. Not that a man desires to bury his children, but I know that my son is destined for the World to Come because he caused the many to be righteous, and⁶⁴ whoever causes the many to be righteous, sin occurs not through him, and whoever causes the many to sin, they do not afford him the faculty to repent. Moses was righteous and caused the many to be righteous, [therefore] the righteousness of the many was [considered] dependent on him, as it is stated, *He executed the righteousness of the Lord, and His ordinances with Israel*.⁶⁵ Jeroboam, the son of Nebat, sinned and caused others to sin, [therefore] the sin of the many was [considered] dependent on him, as it is stated, *For the sins of Jeroboam which he sinned, and wherewith he made Israel to sin’*.⁶⁶

Further [R. ‘Aḳiba] sat on the bench [and taught]: Good things are brought about through the agency of good men.⁶⁷ Even if Moses and Aaron had not arisen, Israel would still have been worthy to be redeemed from Egypt,⁶⁸ as it is stated, *And afterward shall they come out with great substance*.⁶⁹ Had not Moses and Aaron and the Generation of the Wilderness arisen, Israel would still have been worthy to receive the Torah, as it is stated, *He layeth up sound wisdom for the upright*.⁷⁰ being a synonym for the Torah and *the upright* for Israel. The section of ‘the judges’⁷¹ would have been worthy to be promulgated even if Jethro had not arisen. The section of ‘the smaller Passover’⁷² would have been worthy to be promulgated even if the ‘unclean’ had not arisen, as it is stated, *We are unclean by the dead body of a man; wherefore are we to be kept back, so as not to bring the offering of the Lord in its appointed season among the children of Israel?*⁷³. The section of ‘inheritance’⁷⁴ would have been worthy to be promulgated even if the daughters of Zelophehad⁷⁵. 1-5. had not arisen. The Temple would have been worthy to be built even if David and Solomon had not arisen, as it is stated, *The sanctuary, O Lord, which Thy hands have established*.⁷⁶ Israel would have been worthy to be redeemed in the days of Haman even it Mordecai and Esther had not arisen, as it is stated, *And yet for all that, when they are in the land of their enemies, I will not reject them, neither will I abhor them, to destroy them utterly*,⁷⁷ etc.
Israel were destined to be enslaved even if Pharaoh had not arisen in Egypt, as it is stated, *And* [they] *shall serve them; and they shall afflict them four hundred years*.⁷⁸ Israel were destined to serve idols even if Jeroboam, the son of Nebat, had not arisen, as it is stated, *And this people will rise up, and go astray after the foreign gods of the land*.⁷⁹ The section of ‘the blasphemer’⁸⁰ and of ‘the gatherer of sticks’⁸¹ would have been worthy to be promulgated even if the son of the Israelitish woman and the gatherer of sticks had not arisen. Israel would have been destined to be destroyed by the sword even if so and so⁸² had not arisen, as it is stated, *All the sinners of My people shall die by the sword;*⁸³ and it declares, *By sword and famine shall they be consumed*.⁸⁴ Israel would have deserved to be destroyed even if Nebuchadnezzar and his companions had not arisen, as it is stated, *Therefore shall Zion for your sake be ploughed as a field, and Jerusalem shall become heaps, and the mountain of the house as the high places of a forest*.⁸⁵

They replied, ‘Hananiah, Mishael and Azariah were worthy men and Nebuchadnezzar was a worthy king, and it was fitting that a miracle should be wrought through their agency; but you are a wicked king and are not worthy that a miracle should be wrought through your agency. As for us, we deserve death at the hand of God, and if you do not slay us, the Omnipresent has many other agents of death; He has many demons, many bears, many leopards, many snakes, many venomous serpents, many scorpions which will come and attack us; but when we die you will learn that we are the descendants of Hananiah, Mishael and Azariah’. It is reported that before they died they witnessed his eyes gouged out.⁸⁷

The allegorical interpreters⁸⁸ (new series), I, pp. 503ff. of Scripture said: *And ye shall break down their altars:*⁸⁹ wherein have the trees and the stones sinned?⁹⁰ Because they were a stumbling-block to man Scripture decreed, *And ye shall break down*. This is an argument from minor to major: if with trees and stones, which are capable neither of merit nor guilt, neither of good nor evil, because they were a stumbling-block to man the Torah declared, *And ye shall break down*, how much more [will a man be punished] who causes his neighbour to sin and turns him away from the way of life to the path of death! Similarly, *And if a woman approach unto any beast, and lie down thereto, thou shalt kill the woman, and the beast*.⁹¹ If a human being sinned, how has the animal offended?⁹² Because evil came to a human being through it, and so that the animal shall not pass through the street and people say, ‘This is the animal on account of which So-and-so was stoned’. This is an argument from minor to major: if with an animal, which is capable neither of merit nor guilt, neither of good nor evil, because it was a stumbling-block to a human being the Torah declared, *It shall be stoned*, how much more [will a man be punished] who causes his neighbour to sin and turns him from the way of life to the path of death!
Similarly Scripture declares of the stones of the altar, *Thou shalt lift up no iron tool upon them*,⁹³ and elsewhere it states, *For if thou lift up thy tool upon it, thou hast profaned it*.⁹⁴ Wherein is iron different from all other metals to be unfit for [the building of] the altar? Because the sword is a symbol of curse and the altar an agent of atonement; so we remove the symbol of curse on account of the agent of atonement. This is an argument from minor to major: if with the stones of the altar which do not see and speak, eat or drink, because they make peace between Israel and their Father in heaven the Torah declared, *Thou shalt lift no iron tool upon them*, the children of the Torah,⁹⁵ who are an atonement for the world, how much more [should they not lift an iron tool against each other!] Similarly Scripture declares, *Thou shalt build the altar of the Lord thy God of unhewn stones*⁹⁶—stones that bring peace to the world. This is an argument from minor to major: if with stones which do not see or hear, speak or eat or drink, because they make peace between Israel and their Father in heaven they must be ‘whole’ [48*a*] before [the Holy One, blessed be He], how much more the children of the Torah, who are an atonement for the world, must be ‘whole’ before the Holy One, blessed be He!
