מתני' השותפין - שיש להן חצר בשותפות ובתי שניהן פתוחין לתוכו וכל חצירות ששנו חכמים לפני הבתים הן ורוב תשמישן בחצר:
באמצע - זה נותן מחלקו חצי מקום עובי הכותל וכן זה:
גויל גזית כפיסין - הכל מפרש בגמרא:
הכל כמנהג המדינה - אם מנהג לבנות בגויל אין חבירו יכול לומר איני חפץ אלא גזית:
זה נותן ג' טפחים כו' - שעובי כותל גויל ו' טפחים ושל גזית חמשה ושל כפיסים ד' ושל לבינים ג':
לפיכך - הואיל ובתחלת הבנין חייבום חכמים לבנות בין שניהם אם נפל הכותל לאחר שנים רבים אין האחד יכול לומר כל הכותל נבנה בחלקי ומשלי היו האבנים אע"פ שהוחזק יותר מחבירו וכגון שנפל הכותל בחלקו כדמפרש בגמ':
וכן בגינה - מחייבין את שניהן לבנות במקום שנהגו לגדור באמצע:
אבל בבקעה - שדה הלבן:
מקום שנהגו כו' - בגמ' מפרש מאי קאמר:
ועושה חזית מבחוץ - מפרש בגמ':
ועושין חזית מכאן ומכאן - להודיע ששניהם עשאוהו:
גמ' גודא - כותל:
Guda: A wall.
(כדתנן) - דקרי תנא לגודא מחיצה:
As it was taught (in the mishnah) [in a baraita]: Since the tanna (teacher) called a wall, mechitzah.
מחיצת הכרם - שסמוך לשדה הלבן של חבירו:
Mechitzat (A partition of) a vineyard: That is next to his fellow's cultivated field [of grain].
אומר לו - לבעל הכרם גדור אתה שלא יאסרו גפניך את תבואת השדה משום כלאים לפי שסמך בעל השדה את זרעיו סמוך לגדר כדתנן בפרק שני (דף כו.) היה גדר בינתים זה סומך לגדר מכאן את אילנותיו וזה סומך לגדר את זרעיו מכאן וכשאין שם גדר תנן בפ' שני לא יטע אדם אילן סמוך לשדה חבירו אא"כ הרחיק ממנו ד' אמות כדי עבודת הכרם דבהכי הוי כלאים:
He may say to him: To the owner of the vineyard, "You must build a fence, so that your vines do not prohibit the produce of the field, on account of forbidden mixtures." For the owner of the field [planted] his seeds adjacent to the fence, as we learned (in the mishnah, Bava Batra 26a), "If there was a fence between them, this one may place his trees close to the fence from here, and that one may place his produce close to the fence from there." But when there is no fence there, we learned in the second chapter [as well], "A person may not plant a tree near the field of another unless he distances it four ells" - enough for the work of the vineyard. As [otherwise] it is [a case of] forbidden mixtures.
חזרה ונפרצה אומר לו - לגדור:
If it was breached again, he may say to him: To make a partition.
