גט כריתות כותב לאשתו - שאם ימות במלחמה יהא גט מיום כתיבתו והרי מת אוריה במלחמה:
He would write a bill of divorce for his wife- For if he died in war the bill would take effect retroactively from the day it was written-And it happened that Uriah [the Hittite] died in war.
דכתיב - במלחמת שאול ואת אחיך כו' ודוד למד מישי אביו להנהיג שאף היוצאין למלחמותיו עושין כן:
For it is written-During the war of Shaul and your brothers etc. and David learned from his father Jesse to even lead [properly] like this when going out to war
דברים המעורבים בינו לבינה - אלו קדושין:
תקח - תטול מביניהם על ידי גט:
אף אנן נמי תנינא - דטוען פתח פתוח מצאתי אסרה עליו ולא אמרינן לא קים ליה:
איקרורי דעתא - עד שני בשבת הבאה:
ולמאי - קפדי רבנן אי מקררא דעתיה:
ניתיב לה - מה לנו להפסידה והרי הוא נותן מדעת:
Let him give it to her - why should we cause her to lose it, since he is giving it willingly?
אלא לאו לאוסרה - הוא דקפדינן שלא יקרר דעתו ויקיים את האסורה לו אלמא כי אתי וטעין אסרינן לה עליה:
Rather, is it not to prohibit her to him - we are strict about that he should not cool off in his attitude and maintain a woman who is forbidden to him. Thus, when he comes and makes the claim, we prohibit her to him.
טענת דמים - דטענה מבוררת היא וליכא למימר לא קים ליה אבל בפתח פתוח אימא לך לא קים ליה:
להפסידה כתובתה - על פי עצמו וטעמא לקמן מפרש חזקה אין אדם טורח בסעודה ומפסידה:
האוכל אצל חמיו - בימים שבין אירוסין לנשואין:
אין יכול לטעון טענת בתולים - כשתכנס לחופה:
מפני שמתייחד עמה - ביהודה היו מיחדין אותם כדי שיהא לבו גס בה:
ביהודה אמאי לא - האומר פשיטא לי שלא באתי אליה והא ודאי מאחר זינתה שוייה עליה חתיכה דאיסורא מה לי גליל מה לי יהודה:
אלא לאו להפסידה כתובתה - וביהודה לא מפסידה על פיו דאמרינן הוא בא עליה בארוסין ובגליל מצי טעין דהא לא נתייחד:
מאי לאו דקטעין טענת פתח פתוח מצאתי - דאע"ג דאין עדים בדבר זה ולא טענה מוכחת אלא עליה סמכינן דאמרינן אי לאו דקושטא הוא לא היה מפסיד סעודתו ואם היה שונאה מתחלה היה מגרשה ולא טרח בסעודת נשואין ומיהו ביהודה לא מהימן שמא בעל בימי אירוסין ושכח או הערה בה מתוך חבתה ולא ידע ששיבר בתוליה:
לא דקא טעין טענת דמים - לעולם אימא לך בדבר שאינו יכול לבררו אינו נאמן להפסיד כתובתה ודיוקא דמתני' דדייקינן הא בגליל מצי טעין דטעין טענת דמים וכגון שהיו להם שושבינים שמשמשו אותן ולא נעשית אונאה בדבר ולא ראה ואיבד וטענה ברורה היא:
Not in a case where he is making a claim about blood.. Rather, I can always say to you: when it’s a matter that he cannot verify, he is not believed to cause her to lose her ketubah. And the inference from the Mishnah, where we inferred, ‘but in the Galil he can make a claim’, that is referring to where he is making a claim about blood, and it is a case where they had attendants who served them, so that there was no deception/overreaching in the matter: he did not see (blood), and it was lost. And that is a clear claim.
