דין מבוי שנפרץ. ובו ח סעיפים

מבוי שנפרץ בו פירצה מצידו כלפי ראשו אם נשאר עומד בראשו פס רחב ארבעה טפחים מותר והוא שלא תהא הפרצה יתר על י' ואם לא נשאר פס ד' אסור אלא אם כן היתה הפרצה פחות מג"ט:

Laws of an Alleyway That Was Breached. Contianing 8 Sections An alleyway that was breached on its side toward its end — if a post four handbreadths wide remains at its end, it is permitted, provided the breach does not exceed ten handbreadths. If no four-handbreadth post remains, it is forbidden unless the breach is less than three handbreadths.

An alleyway breached on its side not toward its end — the maximum is ten handbreadths, even if nothing remains of the wall at the base.(But if many people pass through it, even a breach of only four handbreadths must be rectified there.)

מבוי שנפרץ במילואו לחצר ונפרץ החצר מצד השני לרה"ר אם לא עירבו בני חצר עם בני המבוי חצר מותר ואפי' נפרץ נגד פרצת המבוי ואפילו בקעי בה רבים ובלבד שלא יהא יותר מעשר ומבוי אסור אפי' אינו כנגד פרצת החצר דכיון שלא עירבו עם המבוי אוסרת עליו וכגון שנכנסו כתלי המבוי בחצר בענין שאין הגיפופין שנשארו בחצר נראין למי שעומד במבוי אבל אם נראים עולים לו משום לחי ומותר ואם עירבו בני החצר עם בני המבוי והפרצה שבמבוי לחצר אינה מצד החצר ופרצת החצר מצד השני אינן מכוונות כנגד פרצת המבוי והחצר של רבים גם המבוי מותר אבל אם לא עירבו או אפילו עירבו ופרצת החצר למבוי מצדו או אפילו באמצע החצר ופרצת החצר מצד השני כנגדה או אפי' אינה כנגדה והחצר הוא של יחיד אסור ואם נפרץ לרחבה פחותה מסאתים או יותר על סאתים והוקף לדירה דינו כאלו נפרץ לחצר אבל אם יתירה על סאתים ולא הוקפה לדירה הוי כאלו נפרץ לכרמלית וצריך תיקון:

An alleyway breached across its full width into a courtyard, and the courtyard is breached on its other side toward a public domain — if the courtyard residents did not make an eruv with the alleyway residents, the courtyard is permitted, even if the breach faces the alleyway's breach and even if many people pass through it, provided it is no more than ten handbreadths. The alleyway is forbidden even if it does not face the courtyard's breach, since not having made an eruv with the alleyway restricts it — this applies when the alleyway walls extend into the courtyard such that the remaining side-sections within the courtyard are not visible to one standing in the alleyway. But if they are visible, they count as a lechi and it is permitted. If the courtyard residents did make an eruv with the alleyway residents, and the breach from the alleyway into the courtyard is not on the courtyard's side, and the courtyard's breach on the other side does not face the alleyway's breach, and the courtyard belongs to many — the alleyway is also permitted. But if they did not make an eruv, or even if they did but the courtyard's breach toward the alleyway is on its side, or even in the middle of the courtyard and the courtyard's breach on the other side faces it, or even does not face it but the courtyard belongs to a single individual — it is forbidden. If the breach opens into an area smaller than two se'ah, or larger but enclosed for dwelling purposes, it is treated as a breach into a courtyard. But if it is larger than two se'ah and not enclosed for dwelling, it is as if it opened into a karmelit and requires rectification.

מותר להשתמש תחת הקורה כנגד הלחי והני מילי בפתוח לרה"ר אבל בפתוח לכרמלית אסור בין תחת הקורה ובין כנגד הלחי מפני שמצטרף לכרמלית שאצלו שמצא מין את מינו וניעור:

One may use the space beneath the beam and opposite the lechi. This applies when the alleyway opens to a public domain, but when it opens to a karmelit, it is forbidden both beneath the beam and opposite the lechi, since it combines with the adjacent karmelit — like finds like and is stirred.

אע"פ שמותר להשתמש תחת הקורה לא ישב אדם בראש המבוי וחפץ בידו שמא יתגלגל החפץ מידו לרה"ר ויביאנו אליו כיון שאין היכר בינו לרה"ר אבל על פתח החצר מותר בין פתוח לרה"ר בין פתוח לכרמלית שיש בו הכירא:

Although use beneath the beam is permitted, a person should not sit at the entrance of the alleyway with an object in hand, lest the object roll from his hand into the public domain and he bring it back, since there is no visible distinction between his position and the public domain. But at the entrance of a courtyard it is permitted, whether it opens to a public domain or a karmelit, since there is a recognizable distinction there.

נשים היושבות על פתח המבוי וכדיהן בידן אין ממחין בידן דכיון דמידי דרבנן הוא מוטב שיהיו שוגגות ולא מזידות:

Women sitting at the entrance of an alleyway with their jugs in hand — one does not protest against them, since this is a rabbinic matter and it is better they sin unknowingly than deliberately.

מבוי שנפלו קורותיו או לחייו בשבת אף על פי שהותר למקצת שבת אסור משם ואילך בין פתוח לרה"ר בין פתוח לכרמלית ויש מי שאומר דהני מילי בעיר שאינה מוקפת חומ' אבל בעיר מוקפת חומה מותר: הגה ויש לסמוך על זה להתיר וכל זה שהיה ראוי לעמוד כל השבת אבל אם היה עומד לסתור מע"ש אסור לאחר שנסתר ואם ספק אם נסתר מע"ש או לא אזלינן לקולא: (תה"ד סימן ע"ג):

An alleyway whose beams or lechis fell on Shabbat — even though it was permitted for part of Shabbat, it is forbidden from that point onward, whether it opens to a public domain or a karmelit. Some say this applies only in a city not surrounded by a wall, but in a walled city it remains permitted.Rema: One may rely on this to be lenient. All of this applies when the arrangement was fit to stand the entire Shabbat, but if it was already intended to be demolished from before Shabbat, it is forbidden once it collapses. If there is doubt whether it collapsed before Shabbat or not, we rule leniently.

מבוי שנשתתפו בו ונשברה הקורה אותו חצר שהעירוב מונח בו וחצרות הפתוחות לו מותרות אבל חצרות שאין פתוחות לאותו חצר אסורות:

An alleyway in which a partnership eruv was made and the beam broke — the courtyard in which the eruv is kept, and the courtyards that open into it, are permitted. But courtyards that do not open into that courtyard are forbidden.
