שאין הנדרים חלים על דבר שאין בו ממש. ובו ג' סעיפים

נדרים אין חלין על דבר שאין בו ממש כיצד אמר קונם שאני מדבר עמך שאני עושה לך שאני מהלך לך שאני ישן עמך אינו נדר וכן אם אמר דיבורי ועשייתי והליכתי אסורים עליך ושינה אסורה עלי אינו נדר ומיהו מדרבנן צריך שאלה (פי' לשאול על נדרו ולמצוא פתח להתירו) לפיכך ראובן האוסר עליו שמיעת תפילת שמעון צריך שאלה מדרבנן אבל אם אמר קונם פי מדבר עמך קונם ידי עושות לך קונם רגלי מהלכות לך קונם עיני בשינה הוי נדר גמור מן התורה וכל שכן אם אמר יאסר עליך פי לדבורי וידי לעשייתי ורגלי להילוכי: הגה האומר דבור פי עליך או נטילת אבן עלי י"א דהוי נדר הואיל והזכיר הפה והאבן (תא"ו ני"ד וכן משמע בר"ן בשם התוס' שבב"י ס"ס רל"ט):

Translation v.1

Vows do not apply to intangible substances. For example, if one says: "Konam that I speak to you!" or "serve you" or "go for you" or "sleep with you" - this is no vow. So too, if one phrases it this way: my speech, my servitude, or my going is forbidden to you, or sleep is forbidden to me - this is no vow. However, on a rabbinic level one should have these annulled. Therefore, if Reuben forbids himself from hearing Shimon's prayer, on a rabbinic level this should be annulled. Yet if he says "Konam is my mouth from speaking to you", "Konam is my hand from serving you", "Konam are my feet from walking for you", "Konam are my eyes for sleep" - these are all absolute Torah-level vows. All the more so if one says: "Forbidden to you is my mouth for my speech", "my hands for my work", "my feet for my walking". RAMA: There are those who say that the phrases: [Konam is] "The speech of my mouth to you" or "The lifting of the stone is to me" are a vow, since one has mentioned the [tangible objects] mouth and stone.

האומר אשנה פרק זה הוי כאלו נדר לתת צדקה (או לעשות שאר מצות ונדרו קיים) (וכן משמע בטור ורא"ש ופוסקים):

Translation v.1

Si une personne dit: «Je fais vœu d’étudier tel chapitre de la Loi» le vœu est réel comme s’il s’agissait du vœu de faire une aumône.¹

אמר קונם עיני בשינה היום אם אישן למחר לא יישן היום שמא ישכח ויישן למחר אבל אם אמר קונם עיני בשינה למחר אם אישן היום יכול לישן היום ולא חיישינן שמא למחר ישכח נדרו ויישן:

Translation v.1

Quand une personne dit: «Que le sommeil soit défendu à mes yeux aujourd’hui, si je dors demain», il faut qu’elle veille cette première nuit, parce qu’elle pourrait oublier la condition qu’elle s’est posée et dormir la nuit suivante; mais si elle a dit: «Que demain le sommeil soit défendu à mes yeux, si je dors aujourd’hui», elle peut dormir la première nuit, et l’on ne craint pas qu’elle oublie de veiller la nuit suivante.¹

footnotes: ¹ Parce qu’on n’oublie pas un vœu qu’on a prononcé (deuxième cas envisagé), tandis qu on peut oublier une condition qu’on s’est posée (premier cas). Dans le premier cas, je m’engage pour aujourd’hui («que le sommeil soit défendu à mes yeux aujourd'hui»), donc je dois veiller aujourd’hui. Dans le second cas je ne m’engage que pour demain («que demain le sommeil soit défendu à mes yeux»), donc je puis dormir aujourd’hui et je veillerai demain. Subtil, mais exact.
