האומר נדר שאני רוצה לידור לא יהא נדר ונדר אינו נדר בד"א שהוציא תחילה בשפתיו לומר שלא יהא נדר אבל אם חשב כך בלבו הוי דברים שבלב ואינם מבטלים הנדר שהוציא בשפתיו וי"א דאפילו אמר כן בלחש הוי דברים שבלב: הגה והא דאמרינן כל נדרי בליל יום כיפורים הוי כאילו התנו בהדיא ומכל מקום לא סמכינן על זה להתיר בלא שאלה לחכם כי אם לצורך גדול (מהרי"ו סימן ב'):
One who states: "The vows I wish to vow shall not be vows", and then vows - this is no vow. This is only the case when one expresses the condition verbally, but if one merely thought of this, it is a matter of the heart, and cannot cancel the vow that was spoken. There are those who say that even if one whispers such a condition, it is like a mater of the heart. RAMA: As for us, when we say Kol Nidrei on the eve of Yom Kippur, it is as if we are making this condition. Nonetheless, we do not rely on this to permit things without asking the rabbis, except for urgent cases.
מי שהתנה ואמר כל נדרי שאדור עד זמן פלוני יהיו בטלים ונדר בתוך הזמן אם הוא זוכר לתנאו בשעת הנדר נדרו קיים שהרי מבטל תנאו בשעה שנודר ואם אינו זוכר לתנאו בשעת הנדר התנאי קיים והנדר בטל ויש אומרים שאין התנאי מועיל לבטל הנדר אלא אם כן יזכרנו תוך כדי דיבור לנדר ויאמר בלבו שהוא סומך על התנאי ויש לחוש לדבריהם:
One who makes the condition: "All vows that I vow until the following time shall be void," and then vows within this time - if they remember the condition at the time of making the vow, then the vow is valid, since the condition is annulled by the vow. If they did not remember the condition at the time of the vow, the condition remains valid and the vow is annulled. There are those who say that the condition cannot annul the vow unless one mentions quickly (toch k'dei dibbur) after the vow that it is being done according to the condition - and one should heed to this opinion.
התנה על קצת דברים שיהא נדרו בטל בהם ואינו יודע על מה התנה אם על אכילת בשר או שתיית יין אם אומר בשעת הנדר על דעת ראשונה אני נודר שאם אזכור על מה שהתניתי שאלך אחר התנאי ונזכר על מה התנה התנאי קיים והנדר בטל ואם לא אמר על דעת ראשונה אני נודר התנאי בטל והנדר קיים:
Un homme s’est promis que les vœux qu’il formulerait pour certaines choses seraient nuls, puis il a oublié les choses dont il avait fait mention (il s’agissait, par exemple, de viande et de vin), il a prononcé un vœu en disant: «Si je me souvenais des conditions d’annulation de mes vœux, je les maintiendrais en ce moment», et il se rappelle ensuite ces conditions: le vœu qu’il a fait est alors nul, il peut manger la viande et boire le vin. Mais s’il n’a pas dit qu’il prononçait son vœu avec le désir de maintenir son ancienne promesse d’annulation, le vœu est réel.
אין דברים הללו אמורים אלא בשבועה או נדר שנשבע ונדר לעצמו אבל מי שהשביעו חבירו או הדירו אין ביטול זה מועיל לו כלום:
All this applies only to vows and oaths one makes alone. However, for a vow or an oath concerning someone else - these conditions make no difference.
