Q. Must a remission, when the remittor is in possession of the remitee's pledge, be accompanied by a kinyan in order to be valid? A. Remission is valid even when not accompanied by a kinyan. Although a creditor acquires a pledge deposited with him to the extent that his responsibility therefor is that of a paid bailee, the pledge itself does not belong to him. Therefore, as soon as the creditor remits the debtor's obligation, the pledge reverts to the latter and becomes his exclusive property wherever it be. SOURCES: Cr. 220; Am II, 232; Mord. Sanh. 681.
