¹ וששאלתעל ראובן שאמר אם אשחק עבור שום דבר אתן זקוק להקדש ונתן לאחר לשחוק עבורו בנדרים הלך אחר לשון בני אדם (נדרים ד' ל:) ויש לחקור אם בלשון בני אדם הוא כך שכל האומר כך רוצה לומר לא הוא² אלא אחר עבורו או לאו ואם לא יוכל להתברר בלשון בני אדם הלך אחר לשון תורה שבכל דבר שלוחו של אדם כמותו (קידושין ד' מא:) כיון ששחק בשבילו כאלו שחק הוא עצמו ונהי נמי דאין שליח לדבר עבירה הא מסיק פ"ק דב"מ (ד' י':) דה"מ דשליח בר חיובא הוא אבל היכא דשליח לאו בר חיובא הוא כגון שאמר לו כהן לישראל קדש לי אשה גרושה מיחייב³ שלוחו ונהי נמי דשליח עבר אלפני עור וגו' כיון דלאו בר חיובא הוא לההיא עבירה גופא שלא לקדש לעצמו אשה גרושה לא מיקרי בר חיובא ומחייב⁴ שלוחו וה"נ שליח לאו בר חיובא הוא שאינו נדור שלא לשחוק מחייב⁵ שלוחו ואע"ג דרב סמא⁶ (חמוה דרבינא משמיי דרב חייא) אמר הני מילי היכי דאי בעי עביד ואי בעי לא עביד לא מחייב⁷ שלוחו א"כ ה"נ לא מחייב. נ"ל דהלכתא⁸ כרבינא דהוי בתראה וכ"ש רבינא שהי' תלמיד חבר דרב אשי דסוף אמוראי נינהו דהלכתא כוותי':

Q. A vowed to quit gambling and promised to give one mark for a holy cause should he break his vow. He subsequently gave money to a friend to gamble for him. Must he pay the promised mark? A. Vows are interpreted according to common parlance. If the phrase "I will not gamble again" includes, in common parlance, gambling by proxy, he must pay the fine. If, however, the implications of the phrase in common speech can not be determined, we must follow Biblical use of terms. In Biblical law a person is responsible for the acts of his agent unless the agent himself commits a sin by carrying out his mission. Although A's vow was made in the form of Asmakta, it is binding since all promises to a holy cause, even when made in the form of Asmakta, are binding.
