חדא מכלל דחבירתה איתמר. פירש בקונט' בתרייתא מכלל דקמייתא ואיפכא נראה דבתרייתא משמיה דשמואל קאמר לה:
ענשיתו [אעשה. כי האי] [שאין אדם חייב] לקנות טלית המחוייב אם אין (לו) אבל עשה גמור אפילו בית דין שלמטה היו מכין אותו עד שתצא נפשו:
Do you punish [even for a positive commandment: of this type]. For a man is not obligated to purchase a cloak that requires [tsitsit], if [he] does not [have one]. But concerning a full positive commandment (in which the Torah obligates us to do something), even the earthly court may strike him until he dies.
הכי קאמר ליה טצדקי למפטר נפשך מציצית. ומ"מ אי לאו חובת גברא לא שייך למיענש עליה כיון דלית ליה ובקונטרס גרס אלא ומשמע דלא מוכח מידי:
