האדם אף שנאמר בו "נפש חיה", לא נקרא בשם 'חיה' (ולא כפי הנראה משטחות דברי הרמב"ם בהל' מאכלות אסורות). (שמיני ס' עב).
The human being, even though it says נפש חיה (living soul)⁵⁹² about him, he is not called a חיה (a human being is not called according to his superficial appearance, according to Maimonides in the Laws of Forbidden Foods, Mishnah Torah).

וחיית הים נקראים בשם "חיה אשר במים". ובלשון "נפש חיה אשר במים" נכלל גם חיית הים שיש לה צורת אדם. (שמיני ס' פ)
And sea creatures are called a חיה אשר במים. And the language נפש חיה אשר במים (living creatures that are in the waters)⁵⁹³ also includes creatures of the sea that have the appearance of a human.
