Sefaria Community Translation
  1. "Every court", even a court outside of Israel

Sefaria Community Translation
  1. "Even though they are not semuchin in Eretz Yisrael". See what I wrote in the siman before this, at the end of se'if katan 8. Its explanation is:

  1. "that the people are unrestrained, etc.": See in the Prishah there. I wrote that even though not all the people are unrestrained, but rather an individual among them, they can punish that individual and fine him outside the letter of the law according to what their eyes see. But when the people are unrestrained, they can enact and fence in all the people and punish each one who transgresses their enactment, even though they did not see that man as one who was unrestrained in his deeds, but rather in order to fence in the people. See there, and it is easy to understand.

Sefaria Community Translation
  1. They judge both death [and money], etc.: meaning, even one who is not liable to death. And so wrote the Rambam, and the Tur cited it. And see the Prishah and Drishah, what I wrote there in the name of the Nimukei Yosef.

Sefaria Community Translation
  1. And even where there is no complete testimony in the matter, and even without warning, for one does not require witnesses and warning except to judge by Torah law. But one who transgresses the ordinances of the state, they can act according to the need of the hour. So wrote the Ramban in a responsum, siman 279.

Sefaria Community Translation
  1. And even where there is no complete testimony, etc.: The Beis Yosef wrote in the name of the Rashba, of blessed memory, that for capital cases they must be cautioned to act with the agreement of the elders of the city, so that they act after great need and with deliberation. End quote.

Sefaria Community Translation
  1. They strike him by means of a non-Jew: from the fact that he did not conclude by writing "and we say to him, do what the Jew tells you," as the Tur wrote, it implies that he holds that even the final judgment they may carry out by means of a non-Jew, since he is a violent man, and especially when they are coming to fine him, for that is not [strict] law. And see the Prishah, what I wrote about this.

Sefaria Community Translation
  1. And they have the power to declare ownerless, etc.: and he concluded there, in these words: and to fine a violent man, and to place him under niduy, and to place him under cherem, and to curse him, and to strike him, and to pull out his hair, and to bind him in the prison house, and to make him swear by the Name that he did not do and that he will not do these things; and in all this his intent (meaning, the intent of the judge) shall be for the sake of Heaven, and let the dignity of others not be light in his eyes, etc. And he wrote further there: and likewise they flog and disgrace one whose reputation is bad, etc. And in the Beis Yosef and the Darchei Moshe they cited what the Ran wrote on this: and this applies to an ordinary person, but a Torah scholar — "cover him completely like the night." End quote. And it is from the Gemara in Menachos, chapter Shtei HaLechem, in these words: Reish Lakish said, a Torah scholar who has sinned, one does not place him under niduy in public, as it says (in Hosea 2): "and you shall stumble by day, and the prophet also shall stumble with you by night" — cover him like the night. End quote.

Sefaria Community Translation
  1. That the beis din has appointed them over them: the language of the Tur is "that the public has appointed them over them." And according to what the Mechaber wrote, "beis din," it appears that he means that the public appointed the beis din over them. And it is easy to understand.

Sefaria Community Translation
  1. And so they practice, etc.: the language of the Mordechai, beginning of the second chapter of Bava Metzia, in the name of a responsum of Rabbeinu Gershom: anyone who has been appointed over the public, he is like the mightiest of the mighty, and Yiftach in his generation is like Shmuel in his generation, and whatever he did is done. And so the Rashba wrote, siman 729, that every community in its place is like the Geonim to all Israel, who enacted many enactments for all Israel.

Sefaria Community Translation
  1. Even though there is, etc.: and so wrote the Maharik in shoresh 8 and in shoresh 14, who wrote that even according to the one who holds that the town's leaders can enact whatever they wish, that is specifically regarding what is for the needs of the community; but to expropriate money from one person to another, which is not a communal need, it is obvious that they cannot. And so it implies in the Piskei Maharai, siman 273, and that we do not say hefker beis din hefker except with a great one who has none like him in his generation.

Sefaria Community Translation
  1. Or that he accepted upon himself, etc.: meaning, that then, through speech alone, it is established, even in a matter that was not the prior practice there.

  1. And there is loss to this one, etc.: in the Darchei Moshe he wrote that the Mordechai concluded and wrote on this: "and if it is not for the sake of fencing the matter [l'migdar milsa], we do not listen to them." End quote. And it implies from this that for the sake of fencing the matter, all agree that the town's leaders have power. And according to this, one must say that Rema did not write "there are those who disagree" except on what was said, "that so they practice," meaning that they practice this even without a need of the hour, [namely] for fencing the matter; and if so, he was brief in a place where he should have been expansive and explained. And know that I have seen that it is written in the Mordechai "lav migdar milsa," with "lo" [spelled] without a vav and "lo" before "migdar" with a lamed; and according to this it appears that he means: any case like this is not included in the permission of fencing the matter, and we do not listen to them. And it is possible that this is what Rema intended, and for this reason he did not mention it here at all. But it is forced to explain so, and it requires further study.

Sefaria Community Translation
  1. And all the more so if they accepted them, etc.: and the Mordechai wrote in Bava Basra, folio 249, column 3, that the people of the city are not permitted to establish any matter where there is an expert judge or an important person in the city. So wrote Rabbeinu and the Mechaber further on, at the end of siman 231. And there are those who say this is specifically in a matter that is a fine. And all this the Darchei Moshe cited; see there.

Sefaria Community Translation
  1. He gives forty gold pieces: and Maharam Mirzburg wrote: one who is fined a maneh by law absorbs forty; for two hundred, eighty; for each maneh, forty. End quote. And the Darchei Moshe cited it on the words of the Mahari"v mentioned above (who said that forty gold pieces is in place of lashes) in the language of a dispute; and also in the Shulchan Aruch he wrote only the words of the Mahari"v. And see what I wrote in the glosses to the Darchei Moshe, and see further siman 420, se'if katan 41, what I wrote there.

  1. But in the hand of the beis din: it is written in the Hagahos Maimoni, chapter 7 of Sanhedrin, [there was] an incident with one who sat on the ground to be flogged and the appointed officer did not come to flog him, and they exempted him, and he brought a proof for the matter; see there what he wrote further from the laws of flogging.
