  1. A beis din is never fewer than three — this is rabbinic, but by Torah law, in monetary cases, one judge suffices. And so the Rambam writes explicitly in perek 2 of Sanhedrin, that he paskens like Rav Acha; and so it is implied in the Rosh at the end of the first perek of Sanhedrin, and not like what is written in the Ir Shushan — see there.

  1. For it is impossible that there should not be among them one who knows sevaros, etc. — the language of the Tur: it is impossible that there should not be among them one who is gamir, who has heard or has read in the seforim and knows the reasonings in the dinim, end quote. And this is not the "gamir and savir" mentioned in the Gemara and poskim, for that one is called a mumcheh and may judge alone — and see the Perishah.

  1. That he does not wish to litigate with the plaintiff — in siman 13 it will be explained that only the defendant cannot push him off from litigating with him in his city, but the plaintiff can compel him to go with him to the beis havaad. And to the great beis din the defendant too can push him off — see there.

  1. Fewer than three, no, etc. — and so the Rambam writes in perek 2 of Sanhedrin, to the exclusion of the Mordechai in perek 2 of Sanhedrin, and the Hagahos Maimoniyos there, and in the Rambam there. And in the Tur he writes further that if one took authority from the Reish Galusa or from the Nasi who is in Eretz Yisrael, he may judge alone even if he is gamir but not savir — only because we now have neither a Nasi nor a Reish Galusa to take authority from, and as the Tur writes, therefore the Mechaber did not want to go at length into the details of this din, and relied on what he writes at the end of this siman, that one who is not a mumcheh, etc., even though he took, etc. — that we should derive from it that for a mumcheh, taking authority does help. And this is easy to understand.

  1. Or one who is an expert to the public — this is the language of the Tur: anyone who is esteemed like Rav Nachman in his generation, expert in Mishnah and Talmud, expert also in judgment, and has reviewed cases for many years and they have tested him many times and found no error in him — such a one was an expert to the public, end quote. And the meaning of "mumcheh" is "tested," as we say regarding going out on Shabbos, that one may go out with an amulet that is mumcheh — and see the Perishah.

  1. And nowadays we do not judge, etc. — and so the Tur writes in Yoreh Dei'ah siman 228 regarding the annulment of vows by a single expert, and in siman 334 regarding the giving of a litra of gold to one who shames a talmid chacham.

  1. And they are not experts to the public — this implies that if they are experts, even if they are fewer than three, an admission made before them is a valid admission; and so the Tur writes in the name of the Rosh. But the Rambam holds that his admission is not a valid admission even if they are experts and ordained, unless they are three — and then even with laymen it suffices. And this is what the Mechaber concludes when he writes "even if they are ordained," for whoever is ordained is presumably an expert; and so the Rambam writes explicitly, "even if he is an expert." And even though the Rambam wrote this about an individual who is an expert, presumably one must say the same even when there are two experts, as long as they are not three. And it is astonishing regarding the Rama that he mixed the two opinions together and did not write them in the language of a dispute, as the Tur wrote them, that they argue with one another. And one cannot say that he holds the Rambam concedes in the case of an expert to the public, for in the Maimoni it is written there explicitly that even with an expert to the public and ordained the din is so. (And in the Perishah I wrote the reason why the Tur omitted, in the name of the Rambam, the words "expert to the public.") And one can answer, with difficulty, that what the Rama wrote "expert to the public" means that the public appointed them over themselves, for in such a case it does help.

  1. He is not established as a denier — that is, as long as he did not say before them "you are my witnesses," for this is effective according to all opinions, for all witnesses, as the Tur and the Mechaber write in siman 32, and in chapter 1 regarding admission, and in siman 79 regarding being established as a denier. And even without "you are my witnesses," whenever he spoke before them in the language of a complete admission, the Rambam who holds this view holds that it is effective; and here it deals with where he did not speak before them in the language of a complete admission — see there.

  1. Even though a single expert to the public is permitted, etc. — the Tur wrote this regarding one who took authority; and see the Perishah and Derishah.

  1. That he should seat others with him — so is the language of the Rambam, "others," and the language of the Tur is "that he should seat another with him" — and see the Perishah.

  1. And it is better that he should decide the din with eleven, etc. — for when they are many they all examine carefully, and the din comes out truer. And what he says "with ten" is not precise, for that would be an evenly balanced beis din; and see the Perishah, where I wrote there why he took the measure of ten and eleven.

  1. And it is necessary that all who sit in the beis din be talmidei chachamim and fit — that is to say, all ten mentioned above who sit in the beis din; but it does not refer to a student who sits before his teacher, for as is the implication of the Beis Yosef there, he need not be a talmid chacham, only that he not be an ignoramus.

Sefaria Community Translation
  1. Until he knows with whom he sits — in the responsa of the Mahari Weil siman 147 he wrote to the Maharash, of blessed memory: "And if you will heed my advice, do not sit with the community in any din, for you know that the rulings of the laymen and the rulings of the learned are two opposites; and they said in perek Zeh Borer that this is what the refined ones of Yerushalayim used to do — they would not sit in judgment unless they knew who would sit with them, etc." — see there.

Sefaria Community Translation
  1. One who is not an expert, etc. — meaning that he is neither gamir nor savir; for one who is gamir but not savir is called a stam "mumcheh" in the Rambam's terminology, and taking authority is effective for him, while one who is gamir and savir is called "mumcheh to the public" in the Rambam's terminology. All this I have proven in the Perishah — see there.

Sefaria Community Translation
  1. His ruling is not a [valid] ruling. And the Rambam and the Tur concluded on this, in their language: "And if he erred and engaged in the matter by hand, he is liable to pay, etc." — see the Perishah and Derishah.

Sefaria Community Translation
  1. And he was judged before a beis din — in the Tur it is written "before another beis din," but in the Rambam the word "another" is not written; and indeed it is not needed, for these who judged are not called a beis din, and therefore he wrote that they may go back and be judged before a beis din. And this is easy to understand. And so the Mechaber writes later at the end of siman 25 — see there.

Sefaria Community Translation
  1. To appoint judges, whomever he wishes — however, he must be gamir and savir, as written before this.
